convened at 2:30 P. M. and closed at q:45 P. M.
Record of such hearing was taken on tape an is on file in the
Planning Office. Present at the hearing were Chairman Kruse) Members
Galloway) Reade, Spier and Morris, Mr. Rettig of the Engineering Depart-

MEETING AFTER PLANNING g 'ZONING BOARD PUBLIC HEARING JULY 23, 1968
Annexation and Zoning - Action from Public Hearing -
The Planning and Zoning Board reconvened in the City Ball Auditorium
for study sessions on the numbered items of public hearing as, advertised.
and hereby.made a part of these minutes for reference and record.
It was agreed that discussion of Item #1 (Curtis, II and Curtis
PQols, Inc.) would be discussed at the July 30 meeting.
Item #2 (Bartles and Burket) - After considerable discussion and ex-
planation of the present location of city sewers and the street improve-
ments wi thin existing right-of-.way, the follo!'<1ing points were noted:
. 1. City sewer was now available at the west end of the 8 lots
of t'equ~st. 1" .'
2. All of Grand View is with full right-of-way with street im-
provement west of Moss Ave.
3. Merrill Ave. improvement ends approximately 90 ft. west of
Moss Ave. and is with full right-of-way (south of lots 9 and
10 incl. which are part of the request), and half right-of-way
(south of lots 7 and 8).
4. General objection was to the annexation--based upon a presump-
tion that this vlOuld force the neighboring properties into an-
nexation and increased taxes for street and sewer improvements.
Petition of Kapok Civic Association) 1nc.,in opposition to the
reques~ was received by the Planning and Zoning Board.
Motion was made, seconded, and p~ssed unanimously to recommend app~oval

. Item U3 (EaGtwood Terrace! Inc. and ^drot Inc.) -
Upon discussion, the following points were noted:
1. Host of fer-J'1\-lood Ave. is zoned R_I~, Multiple Family.
2. All of east side is vacant except one sinele family residence
located on lot of request.
3,. Approximately half of the \-lest side) south end of street., is
apartment usage (one structure with 35, un~ta).
~. Public hearing ~evealed one objector, owner of residence'Hest
of lot 29. His concern involved the loss of priva~y and
valuation.
The Board deferred action un'til July 30 for further discussion.
.'Item #4A(Hobart, Inc.)
Discussion noted:
1. .The need for seHers brought the request which abuts Ambleside
Subdivision, now under construction.
2. Request is surrounded by single family usage.
3. Ridge Ave'. is in poor condition and would require immediate
repair, but street abutting these lots would only be a short
segment; therefore, there would be question of the advisability
,'of the city to .accept the street' for maintenance..
. Motion'was passed unanimously'that the Board recommend approval of

Item #5 (Me1:z and White) -
Upon discussion, the follo\-1ing points wer.e noted:
1., Property is County C-2 zoned.
2. To the east is estate-type development.
To the south it is vacant or sparcely developed residential.
To the north is professional center \-dth apartment complex.
To the west is a county commercial strip (owned by applicant).
3. ,Applicant is presently developing front of tract for apartment
usage, with the intention of continuing this type of, de-
velopment northward.
4. Public hearing revealed no control over "8<< usage by deed
'restrictions.

The Board was reluctant to haye this tract zoned "B" based only
upon its present C-2, Commcrcial~ county zoning. Although presently
und~r one ownerGhip, it was felt that total development 'may change,
or have multiple ownership~ and zoning should not pe~mit the mixture
of usages. The Board voted unanimously to r~cornmend R-4 zoning as
more desirable than that of the "BIl requested, thus ,recognizing the
presen"t and future. usage and the needed buffer to the estate develop-
ment on the east. Also it was noted that Nursery Road should have

Island Estates - Two other items ~lere heard involving a request
for zoning unzoned portions of Island Estates. Reference is made to
advertised'notice referred to and included as a part of tnis record.
'In that there was no Objection to the single .family zone requested,
. the "Board voted unanimously to recommend R-l C zoning for that defined
property under the'request~ Mr. Morris abstained because of business
interest~ I~ was ~greed to defer until July 30 further discussion in-
volving the ~ portion of the -request.
The Planner announced that Mrs. Hall, office secretary, would be
