Minutes of the Meeting, Tuesday, llp4ril 9, 1968.
The meeting was called to order at 3;00, P. M. by the Chairman,
Mr. Kruse. Present were Members Butler, Harries, Reade, Il.ey, Myl.ander,
Morris and Galloway, Mr. Rettig of the Engineering Department, and Mr.
Wolle.
The minutes of the meeting of March 19, 1968, were approved as
submitted in written summation to each member.

The application was reviewed with consideration being given to
surrounding zoning and land use. Mr. Wolle reported that he had re-
ceived word from the City Clerk's office that this request may be with-
drawn and that if he found that it was officially withdrawn, he.would
not forward a Board recommendation.
Mr. Butler reported for the Zoning Committee recommendatic: For
-" aflproval of the Sniewak avpli.cation. Mr. Wolfe further comment d that
PRS zoning would provide eligibility for the establishment of a rea.I
estate office; also that he did receive one call concerning the request
and that the caller had hoard a rumor that the intended use might be
for a real estate office. After some discussion, the Board voted to
aporove the recommendation of the Zoning. Committee . Recommendation' was
based on the considerations that:'
Professional usage within this area would provide for usage
of existing. residential structures along a major artery and
abutting business and office usage half block strip.
Such future usage of lots west of San }?emo would be accepted
with favor, such that initial spot use t•roul.d be repeated to the
west and continue a pattern of limited office usage.
R-4 zoning in area presently is eligible for specific
profession.l usage as a special. exception through the
Board of Adjustment and AD' oeal. on Zone ng.

The Planner distributed map-drawing, showing location of parcel and
land use and zoning of surrounding properties which was studied and dis-
cussed. Mr. Wolle presented information that--
This tract of about ll acres (with a small portion above Sherwood
Street) extends over to Keene Road extension.
He was assuming that the Board would want an alignment of Long
Street through the tract, or that at least one half of a right--of-
way for a subdivision street would be on the cast side for.reserva-
tion of Keene Road. In discussion with the project engineer he
had asked.for a 30 ft. reservation for Keene Road.
He'had suggested.a zoning request of PUD-R rather than R-4 to
the applicant.
There was some discussion of'a contemplated change in airpark run--
ways several years ago which did not materialize and of the possible

i future of the airpark. Mr. Kruse reported that the final draft of an
Upper County area study, prepared by the Pinellas Planning Council's
planning staff, would be available on the 17th of this month, and that
in this report an airport and industrial area was proposed southeast of
Lake Tarpon (he thought with the intent to replace the existing Clear-
water Airpark).
Mr. Butler reported for the Zoning Committee recommendation for
anvroval of the Hennesen anulication. The Board voted to approve the
recommendation of the Zoning Committee. Recommendation was based on
the considerations that:.
Zone requested would provide means of development that would
assure residential. usage and a transitional. development between
single family residential to the west and limited industrial
area to the east.

PUD ZONING CLASSIFICATION - MR. MYLAPJK.K - Mr. Mylander reported
on excerpts from transcript of a prer.entation ("Pillory of. Zoning,") by
Dr, Ernest R. Bartley, contained in the 1967 FIZA Annual. Conference
Proceedings, concerning; the legality of zoning; for Planned Unit Develop-
ments under Florida law. This he explained had been referred to him
by Mr. Wol.le for review. Mr. Mylander called to the Board's attention

in particular statements cautioning that in writing PUD ordinances one
must set out carefully standards by which those development plans will.
be'rated and considered. In discussion with the Planner, Mr. Woll.e con-
firmed his own opinion that the Clearwater ordinance standards were
adequate to meet stated objections. Mr. Wol.le did indicate that after
experience with several. PUD plans the Board might consider the inclusion
of additional standards.

Mr. Kruse noted that the hearing of the request of Carand, Inc. and
Paul Anderson before the Board of Adjustment and Appeal on Zoning was. to
be continued at 4:00 P. ?l. that afternoon. Mr. Kruse: reported that he
and the Planner had been in attendance at two meetings of the'Downto'-.7n
Association at which such request had been discussed----one an Association
meeting and one of a special committee of the Association held the night
of April, 8. He indicated that he had knowledge that the general tenor
of the report of the Realtors conimi.ttee concerning the proposed R-11
amending ordinance is against the bulk plane requiremr.nt. Mr. :ruse in-
formed the Board of compromise proposals tie had &ugg,.-?sted for a possible
reduction in the number of units to 36 or 3?. for the haven Street project,

hearing, in support of the position of the applicants. Mr. Kruse invited
any Board members who could to be present at this open hearing, along
with hinsel.f and Mr. Wolle, to show Board interest in the matter.
In some inconclusive: side discussion of the proposed R--11 amending
ordinance, Mr. Kruse offered the opinion that unless the Board made
recommendation to the. Commission to pass the ordinance with deletion of
the bulk Dlane. requirement, he thought it would be tabled indefinitely.
Upon inquiry made by the.Chairrnan, Mr. Morris said that he did sit in
with'the architects in discussion of the proposed amendments and that
they primarily don't like the severity of the bulk plane and the limited
height proposals. Mr. Wol_le advised that if the ordinance were to be
referred back to the board he had some compromises that might be con-
sidered and that he would like to have the opinion of the reviewing com-
mittees as to recommrtnded changes before a Board decision was made to
