Minutes of the mcating, .TuesdayI January 16, 19fio.
The meeting was called to order at 3;00 P. M. by the Chairman,
Mr. Kruse. Present were Members Sutler, Mylander, Ilay, Morris and
Galloway, Mr. Rettig of the Engineering Department, and Mr. Wolle.
The minuter. of the meeting of December 20, 1967, were approved
as written.

not be allowed to encroach any further to the east into this residen-
tial neighborhood. Some members expressed agreement with this opinion
and indicated concern that under R-4 zoning this area proposed for
parking lot usage would not be limited under zoning regulations to
such use and that a 20 ft. strip of R-1 zoning would not provide ade-
quate buffer to noise and lights even though the parking lot might be
walled in as intended. The Planner recommended parking usage as the
most logical and best use. of these six lots.
The Chairman read to the Board letter dated Jan 10/68 from Member
Galloway submitting comment on matters brought out at the public hear-
ing. In consideration of points cited, it was felt that sonic matters
(such as proper drainage and traffic congestion) would be routinely
controlled upon annexation by authority of the City's Engineering De--
partment and Traffic Division. Upon Mr. Wolle's request, the arpli-
cants provided a schematic design of the parking lot abutting the
cul-de-sacs. Information from the. Planner was that such lot war; de-

street parking requirement of one space for every 100 sq. ft. of
gross floor area.
In the scope of its deliberations, the Board discussed points
considered in its prior land use and zoning study of the area and
evaluated the evidence presented at the Board's public hearing.
In final action the Board'approved the following report concerning its
findings'and recommendations to be submitted to the City Commission
(Reference is made to parcels so designated in Public Hearing Notices,,
legal advertisements of 12/29/67 and 1/4/68):
Parcel #1 - Recommendation to be PUD-R, Planned Unit Development
Basis for recommendation. PUD--R requires submittal of
plan-related to master plan of total area--and further
reaui.res public hearing before Commission on such plan
before land usage and/or building permits are issued.
Approval recommendation assumes condition of acceptance
that no access be permitted to said Parcel I from
Madera Ave.
Parcel R2 - Recommendation to be "B", Business
Basis for recommendation. Zoning conforms to natural
,extension of sine usage with proper depth along
id. Haines Road.

- Recommendation that parcel (6 lots) be zoned R--4,
Multiple Dwelling, except the easterlymost 50- feet to
be R--lD, Single Family.
The Board feels that 50 feet is 'Minimum distance re-
quired to mitigate adverse effects of noise, light, and
activity in 'a parking area.
Basis for recommendation.
71R--1D zone would prevent this strip from being used
for parking, yet permitting parking on westerly portion.
Usage of the R--ID strip should require a proper legal
instrument to be recorded as a covenant running with
the land to prevent any future access to the cul-de-sacs
at westerly end of San Pedro and San-Jose Streets.
*And further that use of-this buffer zone be restricted
so as there would be no obnoxious noise, distractive
light, or use.of the same adversely affecting the
abutting residential owners to the east.

Parcel #4 - Recommendation to be "B", Business
All parking lot usage within this parcel and
abutting any residential zone shall be adequately
screened (considers minimum of B ft.)
Basis for recommendation. Zoning conforms to County
zoning, present usage, and proposed natural extension
of business usage with proper death along North Haines Rd.
All "B", Business, zoned parcels recommended to be designated Fire
District No. 1, R-1D, R-4 and PUD-R zoned parcels or portions of
parcels recommended to be designated Fire District No. 2.
In Board approval of recommendation for R-11 and R-1D zoning for
above Parcel. 93 E (c) portion], Mr. Butler voted, "No"".

The Planner presented the application with information that it
was filed with seven co--applicants listed on an attached Schedule A as
Clark W. Mills, G. Gordon Bergeson, Leahnora Bradford, Milton B.
Peacock, Salle D. Trott, Mildred Yohe, and Mary F. Robers, owners
of properties on the north and south vide of Cedar. Street in the sur-
rounding area as depicted on map-drawing submitted with application.
The Board was oriented as to the location of these properties in re-
lation to other properties of request along N. Osceola. The Planner re-
lated history of the denial of past request for zoning change for
Mr. Waddel's individual property. Report of Members Butler and Galloway
of the Zoning Committee was, to approve change to R-4 zoning for above
Davis] E. Waddell and property owners listed on Schedule A as co--ap-
plicants. After review and discussion, upon motion by Mr. Mylander,
unanimously,
seconded by Mr. Morris, the Board voted/to accept the Zoning Committee's
reDOrt and pursuant thereto to recommend approval for change to R-E1
(Case 7.-27--1167). Recommendation was based on the considerations that:
The existing use of the Waddell- property is for a non--con-
forming apartment structure and properties of four of co-
applicants have non-conforming units.
Juxtaposition of lots of request to business use (marina to the
south) and to business on N. Ft. Harri=-on Ave.
Access by Osceola from the south and Cedar from the cast, atstd

CASE Z-29-1267 - ROBBINS - This zoning; case was deferred for
later report from the Zonin Committee. The Chairman suggested that
in committee study, the Zoning Committee give consideration to pro-
posals to refine the existing R-4 zone (to possibl.y_establ.i.sh sub-
divisionsr of the R-u classification) in addition to the height-setback
proposals under Board study. Mr. Butler proposed that the Planner
might submit some recommendations in accordance with the Chairman's
suggestion.

'The Planner presented application and read to the Board letter
of submittal dated Dec. 27/67 received from Chas, F. Barber, Attorney,
in which statement was made that several property owners who own prop-
erty adjacent to the subject property with a similar type zoning have
indicated a desire to the applicant to have their property rezoned to
Business. Reyort of the Zonin¢ Committee was to deny above request
for "B" zoning. Upon motion by Mr. ? y'lander,_seconded by-Mr. Morris,
then Board^ voted unanimously to approve the Zoni.np Committee's recom-
mendation to den Business zoning (Case Z-28-1267). Recommendation was
based on the considerations that:
Subject lots abut single family residential area on the north.
The Drew Street frontage of this Block 24-was rezoned to PRS
(as a compromise zoning) in 1964,' at which time there was
strong opposition to a change to Business zoning from nearby
residents.
Since rezoning, sotr:e PRS usage tins established in the strip
and it was felt this trend for Drofessional use would be
continued and wouldl be the best usage.

EDGEWATER DRIVE REPORT -- Mr. Kruse reported that the Board was
awaiting receipt of Engineering aerlal survey maps.
The Chairman arranged for Vice Chairman Mylander to meet with
the'Pl,anner at 1:15 the following day to assist in pre paration of
recommendation to be forwarded to the City Commission on the Kapok
Tree Inn properties.
KIRKLAND AND DEAM ANNEXATION - Mr. Woll.e advised of pending
annexation request (Kirkland and Dean) for two lots on the east side
,. of Lincoln Ave. behind the Sears Town Center.
