Board discussion ~evaaled a lack of unanimous opinion a9 to the p~oba-
bili ty of passa.ge and enfol'cement of such regulations. The question of
how a commercial vehicle would b~ defined war; brought up but not resolved.
One member' expressed doubt that you could te11 a man that he can't. keep
his own boat or truck on his own loty M~, Mylander thought that the
purpose of the ordinance would be protec'l.:iv13 and it would be permissive.
MY'.. Galloway felt that such parking mattm"'s g'hould be covered by deed
restrictions rather than by ordinance. It \.;as agreed tllat enforcement
would be difficult, although it was ~ecognized that there would be some
areas where 'there would be 110 obj action 1:0 it. The Planner explained that'
. ,
the reason that such legislation is lion the linell is that it can't be
tied to pUblic welfare and safety~ and if the City tried to enfo~ce it~
"
it might be declared invalid as an exercise of police powel~. Mr. Wolle
explained :t-hat interest in the subject Has prompted by an inquiry from
Ci ty Attorney Brown. I1rn l.folle had stated' in his memo to Mr. Brown
thai: these regulations could be passed as an addition to the City Code
and would not have to be within the Zoning Ordinance.. Mr~ Gates sug-
gested that parking of vehicles on narrow streets (Mariva given as an
example) should not be allowed within 100 to 150 fi:. of an arterial high-
'tolay. Hr. Reade felt that such stree-c parking restrictions 't>lOuld be
under the jurisdiction of the City Traffic Dept" After some further dis-
cussion" the Chairman ent~~;c>taim==d i1 rn(Jt~.on fol"' disposition of the
