Public hearing was held at 1:35 PM for the purpose of considering items to be included
in an Ordinance amending the City Zouing Laws. Appendix AI Clearwater City Code.

Above properties are located on Clearwater Bp.ach, bounded by Third Stree't on the north,
Harnden Drive on the east and Gulfview,Boulevard on the south and west. The area includes
residential and motel uses as well as several vacant parcels. The area proposed to be re-
zoned is in accordance with the direction of the Commission at its meeting of August 17,
1978. Attorney McFarland appeared before the Board and requested 'a continuance of Item #6.
He expressed concern for the lots owned by his client, Mrs. Boldog, and the effect the pro-
posed rezoning to CTF-24 might have on her property. It was his impression the ordinance
was going to be rewritten and was in a state of flux. Mr. Healey objected t.o the con-
tinuance and stated: (1) it would break the continuity of the proposed rezonings; (2) suf-
ficient notice had been given to the property owners; and (3) the requirements of CTF-24
were not in a state of flux. Motion was made by Mr. Hall, aeconded by Mr. Kuntz, to recommend
continuance of Item #6 until the Planning and Zoning Board meeting of December 19, 1978.
Motion carried 6-1.
Further discussion ensued. Motion was made by Mr. Hall, seconded by Mr. Kuntz, to recommend
continuance of all of the items on the agenda. Upon vote being taken, motion was defeated
4-3.
Mr. Healey presented an overview of the proposed rezonings of the south portion of Clear-
water Beach. He described the purpose of the recommendation in that it is in accordance
with the Comprehensive Land Use Plan and an attempt to recognize the existing land use
pattern and development characteristics. He also showed a map with overlay of the proposed
outline of the zoning districts, explaining that vehicular access and storage is limited
and that some ancillary needs are not adequate. He noted the CTF-24 district is designed

to provide for tourist-oriented development and to accommodnte renoonable expansion.
Eight (8) persons appeared before the Board in favor of the proposed rezoning. It was
their consensus that the majority of property already conforms to CTF-24 district; sewer
facilities are not adequate; water pressure lowers drastically at the height of the tourist
soason;' fire and police protection arc impaired: traffic situation is a problem and it is
difficult for emergency' vehicles to reach their destination without delays. Citizens ex-
preysed ~\e desire to keep density as low as possible until the problems are resolved. A
letter, addressed to the Commission and City Manager (dated August 17, 1978) from Spencer
C. Scheideman, Harvey J. Alexander and Jeanne R. Miller, was submitted to the Board. Said
letter, together with a map, depicted the use of tba present property and taxes paid. Ac-
cording to their calculations, almost one-half of the taxes at the south end of the beach
are collected from residential uses (44.57.). Mr. Harvey Alexander appeared before the
Board with a petition of over 250 names cf pe~~ons 1n favor of the proposed rezonings, stating
CTF-24 should be the maximum density allowed.
Six (6) persons appeared in objection. TIley questioned CTF-24 terminology; the reason for
the concern in limiting density; and, in the event of a catastrophic fire, what recourse
the owner of a hotel/motel would have.
Attorney McFarland spoke in objection to the proposed rezonings, stating he saw no legiti-
mate reason for rezoning an area that was rezoned two years ago and that tourist accommo-
dations make little or no contribution to the traffic situation. Others who spoke in ob-
jection suggested the traffic situation is caused by visiting residents of surrounding
cities. They objected to generally down~oning additional property on the beach, and in-
dicated they shouldn't be penalized for past development mistakes. A letter was read into
the record (dated December 5, 1978) from James R. Gray, Holiday House Motel Apartments, in
which he voiced objection to proposed rezoning and his suggestion that if density is a
problem, perhaps the Board could take some action concerning transporting people to and
from the beach.

Above properties are located south of Gulfview Boulevard and west of Clearwater Pass
Avenue. Mr. Healey showed slides of above property. No one spoke either in favor or in
objection to the above item. Motion was made by Mr. Hall, seconded by Mr. Kuntz, to
recommend approval of above rezoning request. Motion carried unanimously.
At this point in the meeting, the Board agreed to combine Items #2 through #5.

Mr. Healey stated the proposed rezoning would better reflect what is actually on the
property and that while all the problems will not be resolved by changing the zoning
district, the change is part of the total formula.
Motion was made by Mr. Hall, seconded by Mr. Turner, to defer action on the rezoning re-
quests and urge that Planning staff come upwith overall recommendation to resolve traffic
and related probl.ems. Motion carded 4-3.
