Public hearing was held at 1: 30 PM re application for annoxation and zoning followed
by public hearing for the purpose of con41dering item co be included in an Ordinance
amending the City Zoning Laws, Appendix At Cloarwator City Code.
Tapes of hearings are on file in tho Planning Department.
On motion by Mr. Hallt seconded by Mr. Tico, minutos of September 5, 1978 were ap-
proved as written.

Above property is an undeveloped lot but a single family residence is planned.
Dr.linage and utility easements will be required, per Enginoering Department. Applicant
was not present; there was no opposition. Motion was made by Mr. Tice, seconded by
Mr. Turner, to recommend approval of above request. Motion carried unanimously.
Zoning request is in accordance with the Comprehensive Land USP. Plan.
2. Lot 60, Clearwater Manor Sub. (Poulopoulos)
Request: RS-60, Single Family
Above property is located at 1720 Ragland, Avenue. ' A ,dwelling ,is under con- ' \, ,"1-
struction at the present time. Abutting street right of way should be annexed along
with the property. Applicant was not present; there was no opposition. Motion was
made by Mr. Kuntz, seconded by Mr. Tomicki, to recommend approval of above request.
Motion carried unanimously. Zoning request is in accordance with the Comprehensive
Land Use Plan.
3. Lot 70, Clearwater Manor Sub. (McClure)
Request: RS-60, Single Family
Above property is located at 1741 Ragland Avenue and is developed as a single family
residence. Ptevious owner of the property (Mergner) had signed an agreement to
annex property (October 7, 1975). The annexation on June 15J 1978 of Lot 69 to the
south of this property (Ordinance No. 1785) made this lot contiguous to the existing
City limits and eligible for annexation. Applicant was not presentj there was no
opposition. Motion was made by Mr. HallJ seconded by Mr. Tice, to recommend ap-
proval of above request. Motion carried unanimously. Zoning request is in ac-
cordance with the Comprehensive Land Use Plan,

Property consists of approximately .8 acres and is located on the east side of
Myrtle Avenue between Magnolia Drive and Lotus Path. Proper.ty 1s partially
developed with three residences. A change in the Comprehensive Land Use Plan would
be required. Mr. Lee Dorian represented the applicant. A letter dated September 19,
1978 in 'favor of the rezoning request was received from Ceraolo Realty. Mr. Dorian
plans to relocate his office and also to lease office space. Two persons appeared
in objection. citing that Myrtle Avenue and parking would be right up to their doors.
Mr. Dorian explained plans for his office and cited his reputation for high archi~' \, "
tectura1 standards; also, the fact that the area is now a difficult mix. Discussion
ensued. Motion was made by Mr. Tice, seconded by Mr. Kuntz, to recolmnend approval
of above request. Motion carried unanimously. The zoning request is not in ac~
cClrdsuc:e with the Comprehensive Plan.

At this point in the meeting, the Board considered Item #4 under Annexation & Zoning.
4. Part of Lots 5 and 6, Mosell Acres
Request: CGJ Business
(Yegee)
Above property is generally located at the northwest corner of Belcher Road and
Drew Street and was developed as a service station. At the present time, this
station is vacant and applicant plans further development and a change in the type
of commercial use, i. e'J carpet outlet. Waiver of parkland dedication/fee has
been requested. (Parcel consists of approximately .6 acres.) Mr. Healey stated
that staff requests additional 17 ft. right of way be given to Belcher Road rigllt
of way and that Belcher Road right of way be annexed ~~ Drew Street right of way
should not. This determination is a Traffic Engineering choice in so far as traffic
maintanance is concerned. Staff recommended that the Board consider, in the course
of acting on the annexation, whether or not it might be appropriate to attach as a
condition to the annexation that the subsequent improvement of the parking lot be
in accord with the City cf Clearwater's existing zoning ordinance with respect to
landscaping beautification. A letter dated September 13, 1978 was received by
George A. Hunt, Jr. in favor of this annexation. The applicant was not present;
~ere was no opposition. In light of the absence of the applicant, motion was made
by Mr. TOmicki, seconded by Mr. Turner, to recommend continuance of above request
to the Planning and Zoning Board meeting of October 3, 1978. Motion carried unani~
mously.

Above tract consists of 31 acres (112 lots) and is zoned RS-50, Single Family.
This tract was approved by the Resource Development Committoe on September 8, 1978.
Property is bounded on the east by individual property owners and Lendmark Drive;
on the west by Countryside Blvd.; on the south by Tracts 55 and 56; and on the north
by Tracts 64 and 61 (the latter a park site to be deeded to the City of Clearwater)

request. Motion carriod unanimously.
Discussion' ensued following question raised concerning building permits issued,-~d
in the County and then the individual(s) requesting annexation to the City. This
procedure requires duplication of efforts and, technically, the City is not reim-
bursed. Mr. Halt suggested that the Board should recommend to the City Commission
adoption of an ordinance indicating that:the~property be treated as a vacant lot
concerning fees, inspections, parking requirements, etc. Additional fees should
be chargedj i. e.~ all routine fees should be received in entirety and some ad-
ditional fees in order to compensate the ~tty fo~ extra effort expended. Mr. Healey
was requested to work out a local ordinance whereby a .higher;'&nnoxation fee will be
charged; also a change in the State annexation legislation, whereby a, stre~mlined"
methodtto cons1derlreqoasts of a single lot could be instituted.
