Public hearing was held at 1:30 PM for the purpose of considering items to be
included in an Ordinance amending the City Zoning Laws, Appendix A, Clearwater
Ci 1:'7 Code.
Tapes of public hearings are on file in the Planning Department.
On motion by Mr. Kuntz, seconded by Mr. Dimmitt, minutes of August 1, 1978 were
approved as written.
Planning and Zoning Board recommended as follows:

Planning Director located and identified sites of concern, stating that these, and
the areas to follow, are the conclusion of the action in the N. Greenwood area.
City Commission directed said action to rezone land commensurate with its usage in
accordance with the COlnprehensive Land Use Plan. Ms. Ann Capshaw spoke in objection
to the proposed rezoning stating that business zoning would not serve the best in-
terests and there is already too much vandalism in the area. Motion was made by :\~: ::u
Mr. Kuntz, seconded by Mr. Dimmitt, to recommend approval of above request. Motion
carried unanimously.

Attorney Carleton Ward represented the applicant. Mr. Ward stated that the ap-
plicant plans to apply for a special exception under the CTF-24 zoning category
to allow the property to continue use of tennis and racquet ball facility and also
expand the court facilities. (Contiguous property, presently zoned RCPD, has been
forwarded to the City Commission for receipt and referral re rezoning.) Motion
was made by Mrs. Parks, seconded by Mr. Kelly, to recommend approval of above request.
Motion carried unanimously. Request would require an amendment to the City's Com-
prehensive Land Use Plan to reflect current usage and the addition as requested.
Change would require the expansion of the existing commercial designation to cover
the complete parcel. County Comprehensive Land Use Plan already reflects the
current use and the addition would fall under the 5-acre requirement for PPC
approval.

Above property is undeveloped. contains 4.4 acreS and is located behind the
service &tation on the northwest corner of Hercules Avenue and Sunset Point
Road. Mr, Sandy Lloveras (Lloveras. Bauor & Stevens). representing the
applicant. stated that plans are to apply for a special exception to permit
the development of a convalescent home. (Request will require an amendment to
the City Comprehensive Land Uae Plan to change the designation of said area from
low density residential to high ,density.), Mr.: 'Lloverss stated,.there is a"nce"d\ in
the area for this facUity and that Ii certificate of need. has been granted by
the State of Florida to Shive Nursing Centers, Inc. Discussion ensued re rezoning
said property to ISP in lieu of RM-28. Mr. Groth felt that RM-28 'is not the
proper zoning category for a nursing home. Mrs. Parks stated that if the property
were rezoned RM-28, technically speaking. anything could be built on that property
which would conform to RK~28 zoning category. Mr. John Rankin appeared in favor
of the proposed project. He expressed concern re too much commercial and the
desire for the remainder to stay residential. His preference would be for the
ISP zoning category. Six (6) persons appeared in opposition. citing an already
overtaxed traffic situation and prefnrence for retention of residential zoning
(RM~12). Mr. ,Healey stated that a petition of objection to RM-28 had been re-
ceived from the residents of Willow Ridge Subdivision. Mr. Lloveras explained
that the proposed structure would be one story and that. due to its nature,
traffic would be limited. Mrs. Parks stated her preference for ISP or PS zoning.
Mr. Kelly felt that a nursing home would not create more density and ISP would re-
lieve the minds of the property owners inasmuch as several objecting were more con-
cerned with the density rather than the proposed project. Motion was made by
Mr. Kelly. seconded by Mrs. Parks, to recommend denial of above request. Motion
carried unanimously. Motion was then made by Mr. Kelly, seconded by Mrs. Parks.
to recommend rezoning to ISP. Institutional Semi-public. Motion carried 5-1,
wi th Mr. Kuntz voting "nay."
4. Lot 60, Lloyd-White-Skinner Sub. (Rohn)

Above property is generally located at 309 Gulfview Blvd. and developed as a
residence. Attorney George J. Schriefer. representing the',applicant, stated that

by the Resource Development Committee and approval recommended. The project will
consist of single family homes surrounding the golf course. Motion was made by

~Ir. Thornton reiterated that the CIS had been prepa~ed for the entire area and
that the Resource Development Committee had approved oame. This single family
residential development will consist of 164 lots partially abutting the golf
,course and,Landmark Drive. Motion was made by Mr. Kuntz, seconded by Mr. Kelly,
to recommend approval of the preliminary subdivision plat for Tract 5S, 'Countryside.
Motion carried unanimously.
3. Northwood Villas Townhouse, Tract li, Northwood Estates
Mr. Douglas Roach, representing the applicant, stated that the proposed project
is a townhouse development plan, consisting of 92 oneMstory units. A waiver of
the CIS is requested due to the lower density planned for the project. (The
Resource Development Committee approved both the plan and waiver of the CIS.)
Mr. Healey gave ,the background of the property and the original agreement was
discussed. Rezoning of property would require a release of restrictions agreed
to at the time of the Northwood annexation. Inweighing the impact of 28 units/acre
upon which the restrictions are based, it was felt that the lower density of ap-
proximately 6,units/acre will be mare protection for the fresh water marsh than the
higaer density and larger setbacks. (The setback requirements have been lessened
due to significant decrease 1.n density and building he1.ght~)'iStreetjaCCe9S" to/link
NbrthvoodnVillaa with the community to the east was discussed. However, Mr. ,Roach
stated that the communities should be separated, in his opinion, inasmuch as these
are private homes and not condominiums. Motion was made by Mr. Dimmitt, seconded
by Mr. Turner, to recommend approval of the preliminary subdivision plat for North-
wood Villas Townhouse, Tract H, Northwood Estates. Motion carried unanimously.
