Dimmitt, Hall, Kuntz, Tice, Tomicki and Turner; Bill Shepard) Engineering Dept.; W. D. Renando, Planning Director; and David P. Healey, Chief Planner Absent: Mr. Kelly Public hearing was held at 1:30 PM for the purpose of considering an item to be :I,ncluded in an Ordimnce amending the City Zoning Laws) Appendix A, Clearwater City Code. Tape8 of hearings are on file in the Planning Deparbnent. On motion by Mr. Kuntz, seconded by Mr. Tomicki, minutes of April 4, 1978 were apN proved as written. Planning and Zoning Board recommended as follows. RezonlnR, (Cont'd. from Planning & Zoning Board meeting of April 4, 1978): 1. Lots 1, 2) 3, Block 19, Mandalay Sub. (City application-Sain) Request: From: CTF (CommercialNTourist) To: RS-50 (Single Family) Above item was continued from the PlAnning and Zoning Board meeting of April 4, 1978 to allow for discussion between the ownerls representative and the Planning Department. Planning Director stated that Attorney Charles Barber had met with him on April 14 but that no significant progress had been made. Mr. Renando stated that the general character of the neighborhood is residential and the property should be brought into the use which has'been established; otherwise, the architecture will be out of character. Also, present zoning is not in compliance with the Comprehensive Plan. Mr. Don P. Simpson of Clearwater Beach spoke in favor of rezoning and stated that he had a petition signed by 427 persona opposing high density. He further stated that~ according to police reports, there is a higher rate of major crimes in the south area of the beach compared to others. Mr. Barber re-affirmed that the positions were unchanged following the April 4th meeting.. He said that the above property consists of less than one-half acre and, if rezoned to Single Family, only three or four homes could be built; further, that he saw no way to utilize RM-28 zoning due to parking, setback and other requirements of the Code. He estimated that no more than ten (10) units could be built, stating that the property is not immediately contiguous to single family residential home~, being bounded on all sides by streets. Considerable discussion ensued. Mr. Tice re-iterated that he would not like to see a penalty for the owner and that RM-20 or RM-28 zoning district should be applied. The structure would not be of the same continuity anyway due to flood plain require- ments. Mr. Hall expressed concern with the fact that this is a "unique" situation and is not zoning to usage because it has no usage at the present time, having pre- viously been an apartment which was subsequently destroyed. Motion was made by ;'l Mr. Tice, seconded by Mr. Hall, to recommend denial of above request and, in lieu thereof, reconmend RM-20, High Density Multi-family. " Minutes of the Planning & Zoning Board - Ap~il 18, 1978 PagB 12 Planning Director presented the preliminary plat for Northwood Estates, Tract G, nnd stated that he had received comments from the departments involved. Property consists of 32 acres and is located south of C. R. 102 ~nd west of Landmark Drive. It 1s zoned RM~100, Single Family, and consists of 52 lots. Community Impact Statement was approved by the Resource Development Committee on Msrch 29, 1978 and by the City Coamission on April 6J 1978. Discussion ensued re erection of a lana- scape barrier on double frontage lots. It was requested that 'the developer install an open, wooden fence, 6 ft. maximum, with suitable gRtes'and appropriate landscape barrier to be approved,by the City on each double frontage lot, fence and landscape barrier to be located at or inside the property lines' or any interior easement in a uniform manner along C. R. 102 as shown on the subdivision plat. Sandy Lloveras, engineer for the project, stated 'that water and sewer facilities had been revised. Also,. access will be from the interior road system. Motion was made by Mr. Hall, seconded by Mr. Tice, to recommend approval of the preliminary plat for Northwood Estates, Tract G. Motion carried unanimously. (7-0) (Developer will dedicate the right-of-way for the w~ of C. R. 224 and the entire right-of-way for C. R. 102 ohown on the subdivision plat.) Planning Director showed the Board members a park plan for the bayfront. This plan was approved by the' City Conmission and we have been directed to "cost it out.1I The Engineering Department is working on this cost estimate. Several unique aspects were pointed out by Mr. Renando, among them, an,amphitheatre seating approximately 600 persons, expansion of the size of the lake, addition of playground equipment, historical exhibits, expansion of visual aesthetics, including the planting of trees, water walk~way, additional handball cou~taf., viewing deck, gazebo, etc. Meeting adjourned at 2:25 PM. t!daA~ W.
