(City application-Sain) Request: From: CT~ (Commercial-Tourist) To: RS-50 (Single Family) Above ~roperty consists of three (3) lots located opposite Mandalay Shores Apartments. Rezoning request is made to eliminate a "spot zone" and to bring the zoning into com- pliance with the surrounding u~age. In addition to showing maps of said property. Mr. Renondo also showed slides which revealed the fact that thc area had developed primarily as single family and the character of the neighborhood has been established for a long period of time as residential. Background and history of this property were also given, and Mr. Renando stated that the land was formerly occupied by the Mandalay Towers Apartments which burned and were subsequently demolished. (ordered by the City Commission July, 1975) Mr. Charles Barber, representing the owner, added that Mrs. Sain, having sold the property in 1973, later had to take it back as vacant property and only recently were the legal rights settled. DiSCussion ensued. Mr. Tice stated that the flood plain dictated construction on the property and suggested RM-20 or RM-28 zoning district. Mr. Hall stated that the Board should take properties to the current uoage aud didn't find this an I'enigma" or out of character with the neighborhood. He stated that in order to build a one-story house, an exception would be required and it would serve no use to rezone the property at the present time. At one poi.nt in the dlscusGion, Mr. Barber suggested 8 units per acre; i. e., townhouses or cluster, as a possibility. Motion was made by Mr. Tice, seconded by Mr. Dimmitt, t~ recommend denial of the above request.and that it remain CTF. Mr. Hall then moved that the item be tabled until the next regular meeting of April 18, 1978. Motion was seconded by Mr. Turner and carried unanimously. Slides were shown to the Board members depicting sur- rounding areas. Motion was made by Mr. Hall, seconded by Mrs. Parks, to recommend approval of above request. Motion carried unanimously. 4. Lots, 7, 8, Block Bt Suburb Beautiful Request: From: RM-l2 (Duplex-Apt.) To: CG (Business) (McCrillis) Above property consists of two (2) vacant lots, totaling some .4 acres in area. Planning Director showed the Board members an aerial and stated that the present zoning is not in accordance with the Comprehensive Land Use Plan. He stated that we are trying to protect property values and discourage business. '!here seems to be an adequate amount of business in the area to meet present needs. Letters of objection were received from Messrs. Burnworh, Oberman and Harris. Attorney William Johnson represented Mrs. McCrillis. He stated that the owner wishes to put the whole parcel together (she also owns Lots 1, 2, 5 & 6). Messrs. Burnworth and Fettig spoke in objection to the proposed rezoning, stating that there is adequate comme~cia1 at the preBent time, a traffic problem already exists, and that business keeps encroaching upon the residential area. Mr. A. C. Christoffersen also spoke in objection, stating that the proposed rezoning is not in keeping with the present zoning. He also cited too much traffic, with cars being parked across the properties, thus prohibiting ownero to exit from their driveways. Motion was made'by Mr. Hall, seconded by Mrs. Parks, to recommend denial of above request. Motion carried unani- mously. Mr. David P. Healey, Chief Planner. asked the Board members if they had any comments or suggestions concerning the Code changes prior to their being advertised. There were none.
