Public hearing was held at 1:35~PM re application for annexation and zoning followed
by. public heating for the purpose of considering items to be included in an Ordiriance
amending the City Zoning Laws, Appendix A, Clearwater City Code.
Tapes of public hearings are on file in the Planning Department.
On motion by Mr. Tice, . seconded by Mr. Groth, minutes of December 20, 1977 were ap-
proved as written.

Attorney Emil Marquardt, Jr.~ representing the applicant, stated that the facility
is in the process of being completed. Motion was made by Mr. Tice, seconded by
Mr. Hall, to recommend approval of above request. Motion carried unanimously.
Mr. Renando stated that although there is no commercial usage on Sunset Point Rd.,
the structure has already been built in the County. It will require a change in
the Clearwater Comprehensive Land Use. Plan which presently shows single family usage.

Planning Director gave history and background on subject property, dating back to
the early 1960's. In summary, property was annexed in 1964 with R-4 (multi-family)
zoning. In 1966 plans were developed, and in 1968 rcvised plans were approved by
the Planning and Zoning Board and the City Commission, with stipulated deed restric-
tions. In 1971 zoning was changed to RM-54. In 1973 City Commission approved a
rezoning to RPD and recorded various subdivlpion restrictions. In this year a building
permit was issued and work progressed to a ccrtain pointj i. e., exterior walls and
second floor, and then halted. No visible signs of work were observed from that
period of time to the present. The area is in a flood hazard zone and some flooding
hus already occurred. On three or four occasions, building permits were taken out,

Developers have recently contacted the Building Director and stated that they were
going to reactivate the project again. (Planning Department is:required toi.initiate
the rezoning.) A permit to clear the property and clean it up had been issued., t
Planning Board members qUGstioned the additional traffic which wcu1d be generated
with only 1 entrance/l exit on Highland Avenue. Plans call for approximately 70
units to be built. Mr~: Rena'ndo s~ated he has not been contacted by the developers.
Approximately one dozen persons spoke in favor of the rezoning. They strenuously
objected to the following: insufficient area for a project as p1anned~ too mUoh
traffic already generatedt severe drainage problems presently existing. Concerned
~ltizens expressed a desire f.or said property to become a park. Board stated t~e City

General Contractor Ed Foster stated that the subject property was acquired through
foreclosure and they have made preparations to complete the project. 'He.said;plans
being modified and stated that the building permit was resurrected during the past
week~ (They foreclosed approximately 2-2~ years ago.) He believes all requirements are
met. .
Planning Director read into the record a letter dated August 17~ 1977 from Mr. Ed
Blanton~ Building Director, to Mr. Weldon R. Humphries, Vice President of Investments.

Planning Director Harren Renando stated that, according to Stcte Law, . bYI thellyear 1979
all property in the City of Clearwater must be zoned in accordance with the Land
Use Plan. Therefore, it is necessary to do massive area-wide rezonings in order to
comply. Mr. Renando explained the proposed ordinance as it would affect future parcels
to be posted. Board members discussed the ordinance and the posting of property.
Modifications were suggested to further clarify same'l.: .Mot:~on was made by Mr. Hall,
seconded by Mr. Tice,to reconullend that the ordinance be modified to read Uthat above
10 parcels the posting be limited to a minimum of 4 + 1 sign per acre. II Motion carried

Mr. Hall expressed concern that each property owner be notified by registered
mail that his property is up for rezoning. Considerable discussion ensued. It
waD the consensus of the Board that each individual owner does have the right
to be notified. Motion was made by Mr. Hall, seconded by Mr. Tice, to recommend
continuance of the proposed ordinance until the Planning and Zoning Board meeting,
of January 17,l978. Hotion carried unanimously.
