Public hearing was held at 1:35 PM for the purpose of considering items to be included
in on Ordinance amending the City Zoning LiWS, Appendix A, Clearwater City Code.
Tapes of public hearings are on file in the Planning Department.
On motion by Mr. Groth, scconded by Mrs. Crampton. minuten of December 6, 1977 were ap-
proved as written.

the record in favor of the proposed rezoning. Several persons spake in favor of it also.
1-1r. William Albrecht, Owner in Fee, Seville, Ltd., spoke in apposition to the proposed re-
zoning. He gave the background and history of Seville. stating that the contract has

existed sirtce April, 1969'whe[l~id property was annexed and zoned. He further stated
chat they have some long-range plans and othe~ things to do which will need the present
zonings; i. e., there are 5 VQcant acres abutting the trailer park which rosy requiro
erF zoning, and that tho recreational center abuts a shopping center zoned CG.
Considerable discussion ensued. Planning Director stated that this development was
built as a high-rise condominium develQpment and no plans have been submitted to this
date which would indicate that a CTF or CG %one would be needed. City Attorney re-
iterated that there was an agreement between the City of Clearwater and Blackburn
Brothers dated April, 1969. He stated that, for the purposes of the Planning & Zoning
B08r~ members, they would not have to be concerned with the contract, merely. whother
the land h, suitable., He further stated that'l'the agreement could not bind the
City GOmmission. Several;qucstions were posed. by the Planning an~ Zoning Board ."
members; i. e., location of the recreation building which Is used as 3 private club-
house of a multi-family association. Mr. Albrecht explained that the recreational
section is a leased situation which the members of the association arc endeavoring to
break and has resulted in litigation. Mr. Hdl asked if the recreatIonal building came
under the tlM-28 zoning and the Planning Director stated that most of them do~ as thoy
are part of the development. Mr. Renando further stated that, until today, he was not
aware that there was any litigation between the association and the developer.
Motion wasmade by Mr. Groth, seconded by Mrs. Parks, to recommend approval of above
request and that the Board would like the Planning Department to look into the small
triangular tract. Diacusslon ensued. Motion was made by Mr. Hall, seconded by
Mr. Turner, to divide the motion into two partsj that part of the property that is
zoned crF be voted on separately, and that the part that was zoned CG be voted on
separately. On vote being taken, there was a tie. Chairman Morris broke the tie
and the motion carried. Motion was tllen made by Mr. Hall, seconded by Mr. Turner, to
recommend that everything that is presently CTF be zoned RM-28. Motion carried unani-
mously. Motion was made by Mr. Tice, seconued by Mr. Turner, that the northe~ portton
remain CG. On vote being taken. motion was defeated. Motion waG made by Mr. Hall,
seconded by Mr. Kuntz, to recommend that the northern portion be ~oned ~~28. Motion
carried. Mr. Tice vott:!d "no."
preliminary:Plat for Sand Key Subdivision (Powell)
Sandy Lloveras presented the prelimina~ plae for Sand Key Subdivision, stating that
the lots will sell in the $60.000 - $90,000 price range, with houses from $100,000 -
$250,000. Lots will be approximately 80/85 x 123\ ft. Developer acknowle.dges that
requests for variance from maximum lot coverage requirements of the Zoning Ordinance
are highly probable. Houses will be built on pilings in accordance with the flood
requirements snd said lots will go all the way out into the water. In essence. a
property owner would be buying the upland lot plus the water lot (submerged land
zoned Aquatic), ,Motion was made by Mr. Groth, seconded by Mr. Hall, to recommend
approval of the preliminary plat for Sand Key Subdivision (Powell). Motion carried
unanimously.
