Planning Director gave an overview of the entire portion of Sand Key. He ex-
plained the June 4. 1974 directive of the City Commission to assess and downzone
properties within 500 ft. of the water, said zoning to comply with the Comprehensive
Band Use Plan, County Plan and good practices for zoning land in accordance with ita
actual usage. (Sand Key was brought up over a year ago and was continued at that
time.) Mr. Renando then showed a drawing (by colors) depicting eKisting properties
and uses on Sand Key. He went into detail showing the present zoning on each pro~
perty and the recommended zoning changes. Mr. Bernard Powell, one of the original
owners of the property, stated that he bnd his associates had met with the Planning
staff and felt that the meeting had been mutually beneficiali i. e., proposal of the
north finger to be zoned RPD~5 at a future date., Mr. Richard Cope, developer, spoke
in favor of the application.

Motion was made by Mr. Tice, seconded by Mr. Groth, to reco~nend approval of
above :z.oning change with the exclusion of the suggested 25-ft. strip tbat is
recommended by the Board to remain CG (i. e., 25-ft. parcel lying east of and
adjacent to Gulf Boulevard from the Isle of Sand Key Condo Bouth to the City
limit line)j with the understsnding that the Legal Department approve this
method. Mr. Hall recommended that this motion include the understanding that
the section described in (1) (C) is going to be changed from RM~28 to RPD-S
and that the Board's recommendation to the City Commission is based on this
assumption. Messrs. Tice and Groth accepted the amendment to the motion. On
~te being taken, motion carried unanimously, as amended.

Planning and Zoning Board held the first public hearing on the above May 18) 1976.
At this time the property was zoned CG. The City Commission believed this. zoning
not to be in conformance with the plan.or the established use. A report from
Traffic Engineering Department showed th~t Gulf Boulevard was already at ~n over-

Bayside Gardens I, II, III and IV are developed as multi-family within the N}1-l6
zone density. The tracts directly south and north of Bayside Gardens II and Bay-
side Gardens IV are currently vacant. Mr. Dennis P. Thompson, attorney for U. S.
Steel, spoke in objection to the application and submitted a letter, dated
October 17, 1977. He further stated that the objections submitted in a letter,
dated June 17, 1976, still stand and asked that both letters become a part of
the minutes. (attached) Mr. F, E. Felix, Jr., a Project Manager for U. S. Steel,
also appeQred, stating that the zoning change requested is a completely unjusti-
fied economic intrusion. He further stated that not only had plans been submitted
with respect to conunercial development of all areas to the north of the bayaide,
but there was pending with the City a request for the issuance of a building permit,
said building to be known as South Beach Ill, adjacent to the southerly U. S. Steel
Condo.
Mr. Renando replied to the above statements, pointing out the fact that direction to
rezone these areas was not unique to Sand Key but was given by the City Commission
to rezone all properties within 500 ft. of the water and that this pr.ocess of
"downzoning" had been moving at a significant pace. He also stated tbat the actlons
which the gentlemen addressed preceded any of the filing for a site plan for com-
mercial use on that northern piece of property. Planning Director cited that in
1973 the Kunde Report issued a Vehicular Acccss Study on Clearwater Beach which
pointed out the heavy traffic load. Thus, according to Mr. Renando, if U. S. Stecl
were successful in buLlding the type of project they desire. the traffic problems
generated would be enormous. Planning Director stated that the plans submitted by

the aouth tract M & B 5-3, Sec. l7-29S-15E is presently undeveloped. Planning staff
recognizes the established and planned tourist facilities at the north end as they
relate to CTF-28 zoning and the public beach development. Mrs. Ann Garris spoke in
favor of the reduction of density and stated that there is now a severe problem con-
cerning traffic. Additional traffic would reflect an extreme hardship on Clearwater
and Belleair Beach residents. Motion was made by Mr. Groth, seconded by Mr. Hall, to
recommend approval of (3) (A) above. Motion carried unanimously. Planning staff
recolmlended withdrawaLo f(3) (n) above. Hotion was made by Mr. Hall, seconded by

Under City Commission direction. the Planning Deprtment is continuing to examine pro-
perties that are not zoned comnensurate with actual or probable usage. Saud Key Condo-
minium I and II, Harbour Light Towers, Sand Key Club and Landmark Towers are eXisting.
The remainder of the property is vacant. Application recognizes the existing high
density uses and future development as the established pattern on gulf frontage.
Planning Director gave the background on the Sand Key Club and showed the original site
plan explaining that, when submitted, it was a part of the Condo and Clubhouse building.
Revisions were made at a later date which still recognized Sand Key Condo and Clubhouse
for persons residing there. Later, Sand Key was "allowed" (through error) to convert
itself under different ownerahip 8S a public restaurant. The City was then sued by one
the members of the Association on Writ of Mandamus concerning insufficient parking for a
restaurant. Mr. McDermott, Attorney, spoke in objection and stated the letter dated
October 14, 1977 which is submitted as part of the minutes. (attached) Mr. McDermott
stated that the First Federal Savings end Loan Association of Largo (when it obtained
Sand Key Club) was instrumental in causing the law suit to be dropped against the City.
He then went into detail explaining that the bank took over the Club in lieu of fore-
closure at a substantial loss.(voluntary deed) It had been conveyed and split away from
the Condo and inunediately became a violation under zoning. Mr. McDermott 'then,'showed
