MINUTES
THE PLANNING & ZONING BOARD
City of Clearwater, Florida
May 17, 1977 - 1:30 PH
Members present: Chairman Morris, Mrs. Crampton, Messrs. Groth, Hall, Kruse, Kuntz,
Tice and Turner; Alice Bush, Engineering Dept.; W. D. Renando,'

Absent: Mrs. Parke (unexcused)
Public hearing was held at 1:30 PM for the purpose of considering items to be in-
cluded in an Ordinance amending the City Zoning Laws, Appendix A, Clearwater City
Code.
Tapes of public hearings are on file in the Flanning Department.
Motion was made by Mr. Kuntz, seconded by Mr. Grath, that the section of the May 3,
1977 minutes be amended to pick up comments in favor of the rezoning; i. e., that
the Board was acting to square off property already zoned CG, General Business,
into an existing line already surrounded:by rezoned properties. Motion carried
unanimously. Motion was made by Mr. Groth, seconded by Mr. Kuntz, that the words
"into the community" replace the words "on Barry Street" to reflect Mr. Morse's
letter of objection. Motion carried unanimously. Motion was made by Mr. Groth,
seconded by Mr. Tice, to recommend approval of the minutes of May 3, 1977, as amended.
Motion carried unanimously.
Planning and Zoning Board recommended as follows:
Rezonin :
1. nrningside Estates Unit 6A - All Lots 467, 468, 469 and portion of
Lots 443 and 466; and
Morningside Estates Unit 6B - All Lots 470 through 477 inclusive, 515,
516, 537 and portion of Lots 514, 517, 536 and 478 (City)
Request: From: RM-12 (Duplex-Apt.)
To: RS-50 (Single Family)
Planning Director W. D. Renando, representing the City of Clearwater, stated that
Planning staff is pursuing the policy directive from the City Commission to rezone
property commensurate with the land usage and bring it into conformance with the
Comprehensive Land Use Plan. Said property has developed as part of a Single Family
subdivision, and rezoning would reflect the current usage. Four persons spoke in
favor of the rezoning. Motion was made by Mr. Hall, seconded by Mr. Groth, to recom-
mend approval of above. Motion carried unanimously.

Planning Director reviewed background of above properties which were annexed on
Octobpr 50 1970 per Ordinance No. 1284 (present zoning on property). On October 1,
1973, application for rezoning to RPD (8 units to the acre) was denied. The
i
property is largely undeveloped, with total acreage of 5.9. There has been no
significantt.Multi-family development in the'vicinity and neighborhood portrays low
density character. Rezoning would bring property into conformance with the Compre-
hensive Land Use Plan. Motion was made by Mr. Hall, seconded by Mr. Tice, to recom-
mend approval of #2 and #3 above, Motion carried unanimously.
4. Lots 33 and 34, South Haven Sub. (Amburgey-City)
Request: From: RM-24 (High Density Multi-family)
To RS-75 (Single Family)
Mr, Renando stated that there is a conflict in the laud use, zoning and the Compre-
hensive Land Use Plan. He said the property is the only one not Single Family in
the area and is located adjacent to two churches. The City would like to see it
developed in conformance with the Plan and established usage in the area.
Mrs. Herman spoke in favor of the rezoning, The owner, Mrs. Amburgey, spoke against
the application and stated that she had planned to utilize her property by building
apartments. Her feelings expressed were that this would not downgrade property and
cited the noise on Nursery Road and a mobile home park. Her plan was to build no
more than 10 units. Planning Director stated that there is no practical way the
property can be developed as 24 units to the acre. Motion was made by Mr. Groth,
seconded by Mrs. Crampton, to recommend approval of above. Motion carried unani-
mously. Rezoning would bring property into conformance with the Comprehensive Land
Use Plan.
Report of City Commission action of May 5, 1977 follows.
1. Preliminary Plat approval for Chief Charley's, Inc. was withdrawn by
the City Manager.
2. Preliminary Downtown Plan was approved re proceeding with the final
phase and monies pair for the amount of work done to date.
Chairman Morris read a letter (dated May 12, 1977) from the Mayor. Said letter was
addressed to all Chairpersons of City Advisory Boards and Committees and related to
terms of members and attendance records.
