Upon learning that annexation and zoning were not dependent upon the CIS, the foregoing motion was withdrawn. It was moved by Mr. Groth and seconded by Mr. Hall that the annexation be ap- proved and that RSR60 zoning be established. The vote was unanimous. 2. Property located at 1212 S. Green- wood Ave. (Eisele) Request: From: RM-28 (High Density Multi-Family and RM-l2 (Duplex-Apt.) To: PS (Professional Services) The Acting Planning Director stated that this is in conformance with the City Commission's directive to examine spot zoning. In response to the Chairman's invitation to citizens opposed to to the rezoning to give their views, Mrs. Myron Mesler stated that the parking lot serving the doctors' office was on property that originally was intended for shrubs and grass. Inasmuch as it is adjacent to the Mesler property, the trash that litters the area has become a problem. Mrs. Mesler was iuformed that this is a police matter. The owner of the property, Mr. Bill Eisele, said that the two doctors presently occupying the building are moving, and that the quarters arc being advertised as suitable for a doctor's office. Mr. Hall moved that approval be given for rezoning from RM-28 and RM-12 to PS (Professional Services). The motion was se- conded by Mr. Kruse, and passed with a unanimous vote. 2. Property located between railroad right-of-way and Navajo Park Sub. and south of Stevenson's Creek at east end of Mohawk St. (Ten Hoeve & Beard) Request: From: RS-SO (Single Family) To: ISP (Ins ti tutional Semi-Public) Mr. Robert Zens, attorney, represented the owners of the property as well as the proposed purchasers. He stated that the Bethany Christian Episcopal Church wishes to erect a church building and possibly a parsonage. The,plans call for a seating capacity of 370. The present church is located at Pierce and Madison Streets. Several citizens spoke in opposition of the rezoning citing as their reasons traffic congestion, destruction of community esthetics, sewage overload, increased difficulty in getting out onto Ft. Harrison Avenue, and destruction of vegetation. With regard to the traffic and sewage problems, Mr. Zens declared that if the area were developed as zoned (single family) the situation would be worse than with a church which would be used only two or three times per week. Mr. Groth asked Mr. Shepard to describe any engineering problems. He replied that the Marshall Plant is being enlarged; therefore, in another year the problem will be solved. Kenton, responded to the concern voiced regarding vegetation destruction by stating that there is extensive mangrovc growt.h ~oing into the propc'rty from Stevenson' s Creck. There is also C01\Cern with the narrow strip of land between Stevenson's Creek an~ the major portion of the property to the south. Mr. Kenton stat~d that the runoff could be designed to increase soi 1 i~lfil trati,n and reduce runoff pollution into Stevenson's Creck. The motion was seconded by Mr. Groth, and received a majority vote. Mr. Kruse abstained. Renando stated that twelve letters and a petition containing names have been received protesting the rezoning. The staff looked at the property twice and found it to be suitable for present zoning; therefore, it doos not recommend rezoning. Property located on east side of Virginia Lane about 400 ft.
