MINUTES
THE PLANNING &: ZONING BOARD
City of Clearwater, Florida
February 3, 1976 - 1:30 PM

Public hearing was held at 1:30 PM re application f~r annexation and zoning
followed by public hearing for the purpose of considering item. to be included in
an ordinance amending the City Zoning Laws, Appendix A, Clearwater City Code.
Tapes of public hearings are on file in the Planning Dept.
On motion by Mrs~ Evers, seconded by Mr. Hall, minutes of January 20, 1976 were
approved as written.
Planning and Zoning Board recommender! as follows:
Annexation & Zonin~:
1. Lots 3 and 4, Dol Ora Gardens (Krok)
Request: RS-50, Single Family
Motion w~s made by Mr. Kruse, seconded by Mrs. Crsmpton, to recommend approval of
above request. Motion carried unanimously. Request is in conformance with the
Comprehensive Plan and similar to abutting land use.
2. Lot 4, Block D, Oak Acres Addn. (Haddox, Hancock, City)
Request: RS-75, Single Family
Motion was made by Mr. Hall, seconded by Mrs. Crampton, 'to recommend approval of
above request, with the understanding that the surrounding property owners have
the obligation to enforce deed restrictions concerning the RS-50t Single Family.
Motion carried unanimously. Request is in confo~ance with the Comprehensive Plan
and similar to abutting land use.
3. Lot 10, Block F, Oak Lake Estates (Miller)
Request: RS-100, Si~e Family
Motion was made by Mrs. Evers, aeconded by Mr. Kuntz, to recommen1 approval of
above request. Motion carried unanimously. Request is in conformance with the
Comprehensive Plan and similar to abutting land use.

Request: From: RS-50 (Single Family)
To: CG (General nusiness)
Considerable discussion ensued re above rezoning request. Several persons ap-
peared against the rezoning and two petitions were presented. Motion was made
by Mrs. Parks, seconded by Mrs. Crampton, to recommend denial of above request.
Upon vote being taken, motion was lost in 4-2 vote. Following additional dis-
ct.1ssion, motion was made by Hr. Hall, seconded by Mrs. Parks, to recommend ap-
proval of above request for rezoning but to include certain deed restrictions
as fo llows :
(1) there be a mininulm setback on the cast snd west of 15 ft. and 5 ft.
setback on the rear (as agreed to by applicant's attorney Don MacFarland;
(2) that the property be a one-story property;
(3) that any parking areas be not open to the public but m.ly open to
employees;
(4) that any building be limited exclusively to warehouse -- no commercial
services or repair activities;
(5) that there be proper screening on the east, west and south side, pre-
ferably of some landscaping type of screening;
(6) that the warehouse hours of operation be limited to 7:00 AM to 7:00 PM,
not to be open on Sunday;
(7) and that there be an agreement that the owncrshiv must stay as the front
property will be -- that they become an ownership.

of commercial zoning into a residential zoned and used area, i. e., (1) City Com-
prehensive PIon indicates Medium Density Residential for this parcel; (2) property
to the west is Low Density. zoned and used; property to East is RMH zoned and used; (3)
usage of this area for business and warehouse would alte~ Residential character of
abutting properties; (4) applicant presently has BusinesD zoning (280 ft. in depth and
approximately 150 ft. beyond his present building.) Future change of use for Mobile
Home Park to the east, Mobile Home Park to the south (which is phasing out) and the
existing tract in question would suggest a general overall plan with built-in com-
patible design relationships. Any commercial deviation in zoning for this small tract
at this timp. would jeopardize this overall plan probability. CG rezoning to the
depth requested would establish a precedent for all narrow unused or partially used
tracts fronting on a major thoroughfare.

,At the request of the Planning and Zoning Bo~rd, several planning work sessions
1 1 are being scheduled. Mike Kenton. Environmental Planner, gave a presentation on
the Wetllinus Prot:ectinn Element of the "701" Program u its o~jectives, environ-
mentally sensitive areas and identif.ication. Another planuing work session is
scheduled for February 24, 19;6. .
