Public hearing was held at 1:45 PM at the City Hall Anncx for the purpose of con-
aidering item to be included in an Ordinance amending the City Zoning LawD, Appendix A3
ClearwAter City Code.
Tapes of putlic hearing are on file in the Planning Dept.
On motion by Mr. Hall, seconded by Mrs" Parks, minutes of January 6, 1976 were ap-
proved as written.
Planning and Zoning Board recommended as follows.
Item to be Included in an Ordinance Amending the City Zoning Laws, Appendix A,
Clearwater City Code
The bodies ot water lying in th~ following d~Gcribed areas of Clearwater,
Pinellas County, FloridaJ to be zoned AL (Aquatic Lands) to preserve in a
natural ccndi~ion these bodies of water so that ecological and esthetic
values nmy endure for the enjoyment of future generations.
Area No.6:
Waters of Clearwater Harbor around uplands known as Island
Estates in Sections 4, 5, 8 and 9, Township 29 S, Range 15 E
and waters ot Clearwater Harbor adjacent to Memorial Cause-
way to the Intracoastal Waterway in Sections a and 9, Town-
ship 29 S, Range 15 E, Pinellas County, Florida
Planning Director gave an explanation of the meaning of At (Aquatic Land) zoning and
the fact that this z~ning would give the City of Clearwater some control over the
submerged land. Mike Kenton, Environmental Plarmer, supplied additional information
to the Board members and others who were present. Four (4) letters were received
favoring dle AL zoning category and names were read into the record.
This is the third phase of zoning all the waters and Bubmerged lands within the City
limits of the City of Clearwater to the AL classification. Upon completion of this
phase, only the Harbor north of the causeway along the maf.nland remains to be zoned
At. AL zoning provides the City comprehensive control of recreational usage, con~
servation, pollution, etc. over tho waters and submerged lands in the defined area.
Application of AL zone classification is in accordance with similar action taken by
the Federal, State, County and nronicipal governments acting for the public health,
safety and general welfare. Motion was made by Mr. Hall, seconded by Mrs. Crampton,
to recommend approval of the above. Motion carried unanimously./
Change in Mayfair Condominium Recreational Plan was presented to the Board and the
RPD was reviewed. In November, 1975, the City Commission passed on second reading
an ordinance rezoning the second phase of the Mayfair Condominium Apartment Complex

to a maximum.of 8 dwelling units por acre. The property is ~oned RPD. Per this
action, the property owne~B expect to present a new plan for the second phase by
April, 1976 in compliance with city codes~ In the interim they desire to construct
two tennis courts near the recreation center (in the middle area of the second
phase) to offer more amenities to their clientele. The tennis courts will be in-
corporated into the final plan when submitted in April. Motion was made by Mr. HaU,
seconded by Mrv McCants, to recommend approval of above request. Motion carried
unanimous ly .
Jack Wolle reported on 8 FPZA project whereby students are working toward writing
papers to be submitted for compet~tion for school and then to the Region.l Chapter.
Ite asked if the Planning and Zoning Board members were interested in sponsoring Duch
students. .General consensus was that such a project would be of benefit and that
they would participate. '
Mr. Hall made a suggestion concerning the Comprehensiva Plan and the fact that it
was his feeling that all properties be reviewed and rezoned every ten (10) years
inasmuch as we are unable to ar.curately project a specific area. Mr. Hall suggested
a meeting to discuss the Co~rehensive Plan, use and whether to modify it.
The Comprehensive Planning Act declares land use planning a legal document.
