03-01 RESOLUTION 03-01 A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, DECLARING AS SURPLUS AND DEDICATING AS RIGHT OF WAY AN 800 SQUARE FOOT, MORE OR LESS, PORTION OF CITY-OWNED PROPERTY IDENTIFIED AS LOT 1, A RESUB OF BASKIN'S REPLAT; PROVIDING AN EFFECTIVE DATE. WHEREAS, Clearwater Mall, LLC has made application and submitted site and construction plans for the Clearwater Mall Redevelopment at the southeast intersection of U. S. Highway 19 North and Gulf to Bay Boulevard; and, WHEREAS, appropriate City staff have reviewed the site and construction plans submitted for Clearwater Mall Redevelopment; and, WHEREAS, City staff find it is necessary that certain lands now owned by the City of Clearwater, Florida, identified as a portion of City-owned Fire Station #49 property located at the southwest corner of Gulf to Bay Boulevard and Harbor Drive be dedicated as public right-of-way to facilitate Clearwater Mall Redevelopment plans as submitted; and, WHEREAS, 92.01 (d)(5) of the Clearwater City Charter provides that the commission may declare as surplus and dedicate public right-of-way from City- owned properties without prior approval of voters at referendum: and WHEREAS, the application for additional public right-of-way by Clearwater Mall, LLC to facilitate the Clearwater Mall Redevelopment having been duly considered: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. A triangular portion of City-owned property identified as Lot 1, A RESUB OF BASKIN'S REPLAT, as recorded in Plat Book 24, Page 42, Public Records of Pinellas County, Florida, containing 800 square feet, more or less, being more particularly described and depicted in EXHIBIT "A" attached hereto, is not needed for a municipal public purpose. Section 2. Said lands are hereby declared as surplus and dedicated as public right-of-way to facilitate the Clearwater Mall Redevelopment. Resolution No, 03-01 Section 3.
