MEMORANDUM OF UNDERSTANDING FOR THE REIMBURSEMENT OF JOINT OPERATIONS EXPENSES RELATED TO DEPARTMENT OF JUSTICE GRANTMEMORANDUM OF UNDERSTANDING (MOU) BETWEEN THE CLEARWATER POLICE DEPARTMENT AND THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT FOR THE REIMBURSEMENT 16 OF JOINT OPERATIONS EXPENSES RELATED TO DEPARTMENT OF JUSTICE GRANT #2006-VT-BX-0007 This Agreement is entered into between the Clearwater Police Department (CPD) and the Florida Department of Law Enforcement (FDLE) for the purpose of the reimbursement of costs incurred by the FDLE in providing resources to joint. operations/task forces. Payments may be made to the extent they are included in the grant budget to satisfy the request(s) for the reimbursement of overtime expenses and other law enforcement expenses related to joint operations. I. LIFE OF THIS AGREEMENT This Agreement becomes effective on the date it is signed by both parties. It remains in force unless explicitly terminated, in writing by either party. II. AUTHORITY This Agreement is established pursuant to the provisions of the Department of Justice Grant #2006-VT-BX-0007 as amended, which provides for the reimbursement of certain expenses incurred by the FDLE as a participant of the Clearwater Area Task Force on Human Trafficking • (CATFHT). III. PURPOSE OF THIS AGREEMENT This Agreement establishes the responsibilities of both parties and the procedures for the reimbursement of certain overtime expenses and other law enforcement expense as incurred in the course of human trafficking investigations. IV. APPLICABILITY OF THIS AGREEMENT This Agreement is valid for all joint investigations of the CATFHT with the participation of the FDLE and until terminated in writing by either party. V TERMS, CONDITIONS, AND PROCEDURES A. Assignment of Agent The FDLE shall assign one (1) agent on a full time basis to assist with any investigation or joint operation related to human trafficking in the Clearwater/Tampa Bay area. The assigned agent will be physically located at the Clearwater Police Department. Included as part of this Agreement, the FDLE shall provide CPD with the name, title, four last digits of SSN, badge or ID number, and hourly overtime wage of the agent assigned to the joint operation. Submission of Requests for Reimbursement (Invoices) and i Supporting Documentation The FDLE may request the reimbursement of overtime salary expenses directly related to work on a joint operation with CATFHT performed by its agent assigned to this joint operation. In addition, the FDLE may request reimbursement of other investigative expenses, such as travel, fuel, training, equipment and other similar costs, incurred by the agent assigned as a member of the designated joint operation with the CATFHT. 2. The FDLE will submit all requests for the reimbursement of joint operations' expenses with backup documentation to CPD at the following address: Chris Keenan, Controller Clearwater Police Department 645 Pierce Street Clearwater, FL 33756 Ph. The FDLE remains fully responsible as the employer of the agent • assigned to the investigation, for the payment of overtime salaries and related benefits such as tax withholdings, insurance coverage, and all other requirements under the law, regulation, ordinance or contract, regardless of the reimbursable overtime charges incurred. Benefits are not reimbursable. C. HOLD HARMLESS The FDLE will hold harmless the City of Clearwater from any claim, loss, damage, cost, or expense, including attorney's fees and any costs incurred in enforcing this MOU, arising out of any act, error, omission, or negligent act by the FDLE or its agents or employees, in fulfilling its responsibilities under this Agreement. Nothing herein shall be construed to waive or modify the provisions of Section 768.28, Florida Statutes or the doctrine of sovereign immunity. VI PROGRAM AUDIT This Agreement and its provisions are subject to audit by the City of Clearwater, the Department of Justice and the FDLE, and other government designated auditors. The FDLE agrees to permit such audits 2 Memorandum of Understanding - FDLE and Clearwater Police Department Page 3 of 3 and agrees to maintain all records relating to these transactions for a period not less than three years, and in the event of an ongoing audit, until the audit is completed. These audits may include review of any and all records, documents, reports, accounts, invoices, receipts of expenditures related to this Agreement, as well as interviews of any and all personnel involved in these transactions. VII. REVISIONS The terms of this Agreement may be amended upon the written approval by both parties. The revision becomes effective on the date of approval. VIII.
