99-43 RESOLUTION NO. 99-43 A RESOLUTION 01' THE CITY 01' CLEARWATER, FLORIDA, AUTHORIZING THE ESTABLISHMENT OF A REGIONAL STORMWATER 'l'REA'l'MENT FACILITY AND SERVICE DISTRICT WITHIN DOWNTOWN CLEARWATER, FOR THE TREA'I'MENT AND AT'l'ENOATION OF STORMWATER AND t;OMPLIANCE WITH STATE AND LOCAL ENVIRONMENTAL REGULATIONS TO BE MANAGED BY THE ENGINEERING DEPAR'l'MENT; PROVIDING AN EFFECTIVE DATE. WHEREAS, the existing ~tor~water system within portions of downtown Clearwater does not meet level of service criteria per the City's comprehensive plan, and WHEREAS, areas surrounding the existing Pierce Street pond experience regular flooding, and WHEREAS, the Land Development Code January 21, 1999(Section 3-914-8) allows for the regional retention districts for the purpose ,;)f and state stornLillater management regulations, and as adopted on establishment of satisfying local WHEREAS, the establishment of a district will help solve existing stormwater ~.L:eatment and flooding problems and provide an economic incentive to redevelopment; now, therefore, BE IT RESOLVED BY THE CITY CO~SSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City Commission hereby approves the establishment of the Town Pond Regional Retention District (District)as defined by the followino boundaries: beginning at the intersection of North Fort Harrison Avenue and Drew Street, extending south along the east side of the centerline of Ft. Harrison Avenue to Court Street; then extending to the east along the north side of the centerline of Court Street to Missouri Avenue; then extending to the north along the west side of the centerline of Missouri Avenue to Drew Street; then extending west along the sout:h side of the centerline of Drew Street to North Fort Harri.:,;'-,.l Avenue (see attached map) . S~ction 2. The Town Pond retention faci.lity will require a subject project to be fully within the boundaries of the District. Project owners may make payment to the City for water quality treatment purposes on the following basis: $18,595.00/acre, prorated to the project square footage up to a maximum of 1.5 acres (65,340 sq. ft.). Projects larger than 1.5 acres will pay $75,000.00 PLUS $25,000.OO/acre (prorated to the project square footage). For projects larger thdn 1.5 acres said fees represent the maximum payment. Participation is optional; proj~cts choosing not to participate will be responsible for complying with all existing local and state stormwater regulations. Section 3. For projects larg~r than 1.5 acres, the City Commission may reduce payment on a case by case basis d~pending upon project variables such as total capital investment, nu~er of jobs, density of impervious area (green space), ami the reduction of surface area used for parking/roadways. Seotion 4. Estaclishm2nt of this District will be added as an appendix to the City's Storrnwater Design Criteria Manual. Project eligibility will be determined during the permitting process.
