BACKGROUND:
ThIS 0383 acres sIte IS located on the north sIde of the Spnng Court nght-of-way west of N
Osceola Ave and termmatmg at Clearwater Harbor. There IS an actIve bUIldmg permIt for the
constructIOn of a smgle-farmly reSIdence on the SIte
On July 18, 2006, James Deckard of Berksrure Homes, actmg as an agent for the property owner
filed a PermIt ApplIcatIOn for "ConstructIon of DecoratIve Wall at 304 Spnng Ct (ExhIbIt A)
The heIght of the fence was not speCIfied m the ImtIal applIcatIon As a result of ImtIal reVIew
comments on November 13, 2006 the agent submItted an applIcatIOn for fence/wall permIt
specIfymg 6' as the fence heIght (ExhIbIt B) On December 7,2006 plan reVIew comments were
entered m the case file that the maXImum fence heIght wIthm the front setback IS three feet
Commumty Development Code DIVIsIOn 8 Fences and Walls SectIon 3-804 Setback and heIght
reqUirements states
A. Front setback Walls and fences located m front of a pnncIpal structure shall be
permItted to a maXImum heIght of 36 mches

would not be approved
FINDINGS OF FACT
1 The sIte m question 1S located on the north SIde of the dedIcated nght-of-way for
Spnng Court, a C1ty 1mproved and mamtamed vehIcle and pedestnan access, and
2. There bemg no other nghts-of-way assocIated WIth the subject sIte, property hne
along the Spnng Court nght-of-way IS the property front; and
3 The apphcant/agent requested a permIt to construct a 6' tall decorative masonry wall
m front of the pnncIpal structure on the Spnng Court property hne
CONCLUSION OF LAW
Fences or Walls greater than 36 mches shall not be permltted m front of a pnncIpal
structure. A permIt cannot be Issued
APPEAL PROCESS:
The appellants filed thIS appeal on August 27, 2007. Section 4-501 A 2 of the Commumty
Development Code states that the Commumty Development Board has the authonty to hear
appeals from orders, reqUirements, declSlons or determmations made by an admmIstrative
offiCIal m the admmIstration of the Commumty Development Code SectIOn 4-502 A proVIdes
that an appeal of an orders, reqUirements, declSlons or determmations made by an admmIstrative
offiCIal m the admmIstratIOn of the Commumty Development Code may be mItiated w1thm seven
days of the date of the order, reqUirement, deCISIOn or determmation made by an admmIstrative
offiCial. Notice of the date of such meetmg shall be prOVIded the apphcant and the appellants by
mall and by telephone Pursuant to SectIOn 4-504 B, the CDB shall reV1ew the apphcation, the
recommendation of the Commumty Development Coordmator, conduct a quasI-JudICIal pubhc
heanng on the apphcatIOn m accord WIth Section 4-206 (notice and pubhc heanngs) and render
a deCISIOn m accordance WIth the prOVlSlons of Section 4-206.D 5 grantmg the appeal, grantmg
the appeal subject to speCIfied condItions or denYIng the appeal
Pursuant to Section 4-504 C of the Commumty Development Code, m order to grant an appeal,
(overturmng or modIfymg the deCISIOn under appeal), the CDB shall find that, based on
substantial competent eVIdence presented by the apphcant or other party, all of the followmg
cntena are met.
I) The declSlon appealed from mIsconstrued or mcorrectly mterpreted the prOV1SIOns
of the Commun~('Uxvelopment Code, and ~L'

SectIOn 3-804 a SIX foot hIgh wall IS not perm1tted between the
pnnclpal structure and the nght-of-way at the subject property m
the Low MedIUm DenSIty ReSIdentIal (LMDR) d1stnct.
BACKGROUND:
ThIS 0383 acres sIte IS located on the north SIde of the Spnng Court nght-of-way west of N
Osceola Ave and termmatmg at Clearwater Harbor. There IS an actIve bUIldmg permIt for the
constructIon of a smgle-farmly reSIdence on the SIte.
On July 18, 2006, James Deckard of BerkshIre Homes, actmg as an agent for the property owner
filed a PermIt ApplIcatIon for "ConstructIon of DecoratIve Wall at 304 Spnng Ct (ExhIbIt A)
The heIght of the fence was not specIfied m the mltIal applIcatIon. As a result of ImtIal reVIew
comments on November 13, 2006 the agent submItted an apphcatIon for fence/wall permIt
speclfymg 6' as the fence heIght (ExhIbIt B) On December 7,2006 plan reVIew comments were
entered m the case file that the maXImum fence heIght wlthm the front setback IS three feet
Commumty Development Code DIVISIOn 8 Fences and Walls SectIon 3-804 Setback and heIght
reqUIrements. states
A Front setback Walls and fences located m front of a pnnclpal structure shall be
permItted to a maxImum heIght of 36 mches
ArtIcle 8 DefimtIOns and Rules of ConstructIOn SectIon 8-102 DefimtIons states.
Property line, front means a property lme wh1ch runs generally parallel to and along a
road nght-of-way or street exclusIve of alley ways
Setback, front means the setback between the front property lme and a structure.

FINDINGS OF FACT

Spnng Court, a CIty Improved and mamtamed vehIcle and pedestnan access, and
2. There bemg no other nghts-of-way assocIated w1th the subject sIte, property lme
along the Spnng Court nght-of-way IS the property front, and
3 The applIcant/agent requested a permIt to construct a 6' tall decoratIve masonry wall
m front of the pnnclpal structure on the Spnng Court property lme
CONCLUSION OF LAW
Fences or Walls greater than 36 mches shall not be permItted m front of a pnnc1pal
structure A permIt cannot be Issued
APPEAL PROCESS:
The appellants filed thIS appeal on August 27, 2007. SectIon 4-501 A.2 of the Commumty
Development Code states that the Commumty Development Board has the authonty to hear
appeals from orders, reqUIrements, decIsIons or determmatIOns made by an admlmstratIve
officIal m the admImstratIOn of the Commumty Development Code SectIOn 4-502 A provIdes
that an appeal of an orders, reqUIrements, declSlons or determmatIons made by an admmlstratIve
officIal m the admmlstratIon of the Commumty Development Code may be ImtIated wlthm seven
days of the date of the order, reqUIrement, declSlon or determmatIOn made by an admmistratIve
officIal. NotIce of the date of such meetmg shall be provIded the applIcant and the appellants by
maIl and by telephone Pursuant to SectIon 4-504.B, the CDB shall reVIew the applIcatIOn, the
recommendatIOn of the Commumty Development Coordmator, conduct a quasI-JudIcIal publIc
heanng on the applIcatIon m accord wIth SectIon 4-206 (notIce and publIc heanngs) and render
a decIsIOn m accordance wIth the provISIOns of SectIon 4-206 D 5 grantmg the appeal, grantmg
the appeal subject to speCIfied condItIons or denymg the appeal
Pursuant to SectIOn 4-504 C of the Commumty Development Code, In order to grant an appeal,
(overturnIng or modIfYIng the declSlon under appeal), the CDB shall find that, based on
substantIal competent eVIdence presented by the applIcant or other party, all of the followmg
cntena are met
1) The decIsIOn appealed from mIsconstrued or mcorrectly mterpreted the provISIons
of the Commumty Development Code, and
2) That the declSlon w1l1 be m harmony wIth the general mtent and purpose of the
Commumty Development Code, and
