Management DIStnCt Our Board has been called to an official and specIal meetmg on the
mornmg of December 20th. That meetmg IS expected to last untIl noon or 1 pm. So, I wIll not be
able to be at the begmrung ofthe CIty'S CDB meetmg I am requestmg a deferral of thIS non-
notIced Item untIl I can be at the CDB meetmg I appreciate your, and the CDB's consIderatIon

ThIS IS the statement that staff used m theIr staff report on thIS case, and then verbally backed up
thIS statement as a premIse and cntIca1 pomt m the reVIew of thIS case. Further, It was presented at
the heanng, m my opImon, m the realm as a type of "development code" backed defimtIOn Staff
used the neIghborhood commercIal term throughout staff reports. ThIs was presented as a mam
cntenon for allowable uses m the over lay dIstnct
My follow-up research, and m meetmg WIth the staff, has determmed, to my best understandmg,
that there IS no defimtIon nor any dIrectIOn m the code as to what a "neIghborhood use supportmg
reSIdentIal" IS
It was clear m my mmd that thIS begmnmg dIscussIOn had a huge and Important beanng on the
Board's perspectIve on the case

I am not sure the board misunderstood I thought you stated your position clearly, and when questioned about
your reading of the code definitions, the record reflects we concurred
Our position remains that the request IS at odds with the Downtown Plan Whether or not all of the Board
would agree, they didn't find that an error sufficient to overturn had been made

I am very concerned In that I believe that the Board was unintentionally misdirected on this Issue There
were a wide variety and number of Issues raised dUring the hearing, and one of the most Important, If not
the most Important, Juncture was the characterization of "neighborhood commercial supporting
residential"
I believe that the Board had the direction from staff that "neighborhood commercial supporting
residential" was a defined category, or concrete zoning and or land use definition upon which
Animal Boarding IS specifically not permitted
In my follow-up research In the last few days on thiS Issue, It has become apparent to me that there IS no
category nor concept nor definition that describes thiS "support use" and certainly none that specifically
calls out permissible uses or, on the other hand, defines prohibited uses That definition, and associated
uses, It appears, IS defined and derived completely by the staff Please correct me If I am wrong
I am firmly of the opinion that the Board terribly understood thiS concept The very first portion of
diSCUSSion from Mr Plisco centered on thiS concept of neighborhood commercial supporting residential
He was firmly Informed of the above staff direction, I believe, and the Issue was primarily lost at that pOint
The purpose of thiS communication to request a reconsideration of thiS Issue before the Board at their
next meeting May I also please ask the date of that hearing

RELATIONSIDP OF DOWNTOWN PLAN TO COMMUNITY DEVELOPMENT
CODE
In addition to the Clearwater Comprehensive Plan, the Downtown Plan is the official
statement of policy regarding the Downtown and in particular with regard to the use of
land and public policies. All development of land, both public and private, undertaken
within the Downtown shall be consistent with and further the goals of the Plan. All new
or amended development regulations for Downtown shall be consistent with and further
the goals of this Plan.
The Plan establishes categories of permitted uses' and prohibited uses; based on this Plan,
the Community Development Code will enumerate the specific types of permitted and
prohibited uses and their related development standards consistent with this Plan. The
Plan establishes development potential and height for each character district that will
govern all redevelopment activity. The tools identified in this Plan to consider additional
development potential (Transfer' of Development Rights and the Public Amenities
Incentive Pool) may be used to increase the development potential in excess of that
specified in the Character'District upon a determination that the increase is consistent
with and furthers the goals of this Plan. The Public Amenities Incentive Pool is the only
tool identified to consider building height in excess of that set by the character districts.
Other than those two tools specified above, the Plan's statements regarding development
potential, allowable and prohibited uses and, maximum heIght shall not be varied except
through an amendment to this P Ian. Although the m axrmum height established by the
Plan cannot be varied, except as described above, the process to reach maximum
permitted heights within the allowable range is governed by the Community
Development Code.
Any development regulation not specifically addressed in the Plan objectives, policies,
character ,districts and design guidelines shall be governed by the Community
Development Code. However, should there be any discrepancy between this Plan and the
Community Development Code, the goals and policies of this Plan shall govern.
PUBLIC AMENITIES INCENTIVE POOL
Purpose
To overcome the numerous constraints affecting redevelopment, the Downtown Plan
establishes the Public Amenities Incentive Pool to provide an opportunity for the private
sector to gain additional development potential while assisting the public to achieve its
redevelopment goals for Downtown Clearwater.

BACKGROUND:
ThIS 0 48 acres sIte IS located at the northwest comer of the mtersectIon of Cleveland Street and
Lmcoln Avenue It IS a comer lot wIth frontage along Cleveland Street and Lmcoln Avenue
(south and east, respectively) and has been developed wIth a 3,200 square foot, one-story
bUIldmg constructed m 1948 and a IS-space parkmg lot.
On August 11,2005, Ms. Jaycee Roth, filed a wntten request for an mterpretatIon (ExlubIt A) of
the abIlIty to apply for an Arumal Boardmg FaCIlIty use m the Downtown East Gateway
Character DIStnCt as a ComprehensIve Infill Project
By letter dated September 28, 2005, the followmg mterpretatIOn (ExhIbIt B) was Issued by the
Commumty Development Coordmator (Plannmg DIrector) In addItion to the Clearwater
ComprehensIve Plan, the Downtown Plan IS the officIal statement of polIcy regardmg the
Downtown and m partIcular wIth regard to the use of land and publIc pohcIes governmg
declSlons All development of land, both publIc and pnvate, undertaken wIthm the Downtown
shall be conSIstent WIth and further the goals of the Plan The Plan establIshes categones of
permItted and prohIbIted uses The Commumty Development Code then enumerates the specIfic
types of permItted and prohIbIted uses and theIr related development standards conSIstent WIth
the Plan
The East Gateway DIstnct VlSlon for Uses supports the contmued development of the DIStnCt as
a low and medmm denSIty reSIdential neIghborhood supported wIth neIghborhood commercial
and professIOnal offices concentrated along the major comdors of Cleveland Street, Gulf to Bay
Boulevard, Court Street and MIssoun A venue

APPEAL PROCESS:
The appellants filed thIS appeal on October 17, 2005 SectIon 4-501.A 2 of the Commumty
Development Code states that the CommunIty Development Board has the authonty to hear
appeals from orders, reqUIrements, deCISIons or determmatIons made by an arummstratIve
offiCial m the arummstratIOn of the Commumty Development Code SectIOn 4-502 A provIdes
that an appeal of an orders, reqUIrements, deCISIons or determmatIons made by an adnumstratIve
offiCIal m the achmmstratIon ofthe CommunIty Development Code may be mItIated wIthm seven
days of the date of the order, reqUIrement, deCISIOn or determmatIon made by an arummstratIve
offiCial NotIce of the date of such meetmg shall be provIded the apphcant and the appellants by
mall and by telephone. Pursuant to SectIOn 4-504 B, the CDB shall reVIew the apphcatIOn, the
recommendatIOn of the Commumty Development Coordmator, conduct a quasI-JudIcIal pubhc
heanng on the apphcatIon m accord WIth SectIOn 4-206 (notIce and pubhc heanngs) and render
a deCISIon m accordance WIth the provIsIons of SectIOn 4-206 D 5 grantmg the appeal, grantmg
the appeal subject to specIfied condItIons or denymg the appeal
Pursuant to SectIon 4-504 C of the Commumty Development Code, m order to grant an appeal,
(overturnmg or modIfymg the deCISIon under appeal), the CDB shall find that, based on
substantIal competent eVIdence presented by the apphcant or other party, all of the followmg
cntena are met.
1) The declSlon appealed from mIsconstrued or mcorrectly mterpreted the provlSlons
of the Commumty Development Code, and
2) That the declSlon WIll be m harmony WIth the general mtent and purpose of the
Commumty Development Code, and
3) WIll not be detnmental to the pubhc health, safety and general welfare

E. Area to the north is a vacant lot that IS approxunately 100 ft from the 6 ft
fence in the back of A VlP center. TIns has very httle Impact on tlus area
due to the chstance from the commercial area of the center with a
commerCIal vacant lot between I feel this has less 1lllpact on the area than
a restaurant that is open much later in the evenings Noise WIth trash bInS
in the back and cars connng and going. ThIS area is fenced and dogs Will
be in by 7.30
F This center will support the needs of the commumty In many ways There
are over 58,000 dogs In Clearwater. Just 10 years ago there was only
about 38,000 dogs m Clearwater. It is growing and people are becommg
more and more attached to theIr canine compamons Weare short on
evacuation centers according to the SPCA This wIll give the local
resIdents a secunty I have been told It is not m a flood zone Most of the
boardIng faCIlitIes m Clearwater are cages and lock up the dog until the
O'WIler comes back 1:0 pIck them up I am offenng a much more fnendly
and healthy atmosphere All dogs will get basIC traunng and attentlon
Tills IS exactly what the CIty of Clearwater needs for so many resIdents
commg to the area that will be bnngmg even more camnes. I have the
talent and the passion to work with these dogs My goal IS to have an
establishment that the CIty of Clearwater can count on In cases of
emergencIes A VIP wIll pIck up the dog and take It to the center so It IS not
unart
G nded or left alone m tunes of desperatIon. WIth the 6' fencesurroundmg
the outsIde area should create low impact on the area and enhance It's
charm. The majority of the customers wIll be plCkmg up or droppmg off
which again IS much lower Impact than a restaurant. I want to work Wlth
the CIty of Clearwater m every way to bnng good thtngs to the area and
make us all proud,
4 This business will not hinder busmesses In the area. It wIll be a trammg facIlity
for resIdents and theIr dogs. It WIll be educatIonal center that w111 bnng more
balanced famIly pets. I will have employment opportunItIes for the area. The
distance of the homes WIth another commercIal property between would not
create any nnpact on any homes In the area. It IS mostly a commerctal area.
