As a follow up to our meeting of 7 July 2004, the owners wish to expand the
convenience store portion only of the above referenced site.
We understand that the existmg IS a non-conforming use and that we are
requesting to expand the convenience store/retail portion only. Should you
determine that all the eXisting uses are non-conforming, we can appeal this
decision to the Community Development Board.
Please keep in mind that we are requesting an expansion to the
convenience/retail sales operation of the existing business only.
Please find attached a check for $50.00, as requested and thank you for your

pumps) and the owner wants to add gas pumps, the use of the parcel would change from "retail sales and
services" to "automobile service statIOn," requmng compliance With all Code provIsions for tIns
changed use of the parcel ThelefOle, sll1ce the Downtown Plan now prohibits the use, makmg the

Avenue ThIS comer lot presently contams a 312 square-foot, smgle-story commercIal bUIldmg, a
fuelmg Island wIth two pumps and a canopy over the pumps Access IS presently prOVIded from
two dnveways off of Cleveland Street and one dnveway from Fredenca Avenue The property IS
zoned Commercial (C) DIstnct
ThIS case IS an appeal of an admmIstratIve determmatIOn denymg the expanSIOn of the retaIl sales
portIon (convemence store) of a nonconformmg automobIle servIce statIOn The SIte had been
developed as an automobile servIce statIon m the past and was vacant for two to three years On
May 7, 2002, a Development Order was Issued approvmg FleXIble Standard Development Case
No FLS 02-01-02 to establIsh an automobIle servIce statIOn wIth two pump Islands The
automobIle servIce statIon was reopened m August 2002 On March 18, 2003, the Commumty
Development Board approved a FleXIble Development applIcatIOn (FLD2003-01003) WIth five
condItIOns to permIt the addItIon of a canopy over eXIstmg gas pumps and sIgnage for an eXlstmg
automobIle servIce statIon WIth a reductIon m the front (south) setback from 25 feet to five feet
(to canopy) and a reductIon m the front (south) setback from five feet to zero feet (to SIgn), as
part of a ComprehensIve Infill Redevelopment Project ThIS SIte IS located m the East Gateway
Dlstnct of the newly adopted Downtown Plan (effectIve upon adoptIOn by the CountYWIde
Planmng Authonty on February 3, 2004) AutomobIle servIce statIOns are now lIsted as a
prohIbIted use wIthm the East Gateway DIstnct As such, the eXIstmg automobIle servIce statIOn
IS now deemed a nonconformmg use

The applIcant filed on May 26, 2004, on behalf of the property owner a request to expand the
automobile service station (FLD2004-05038) to permIt the addItIOn of a second gas pump
Island, expand the canopy and relocate and expand the retaIl sales bUIldmg to the northeast
comer of the property Contamed m the "mcomplete" letter for thIS new request IS the
prohIbItion by SectIOn 6-103 B of the Commumty Development Code (Code) of the expanSIOn of
nonconformmg uses AddItionally, PolIcy 11 of the new Downtown Plan states that the use of
the Code tool known as "TermmatIon of Status as a NonconformIty" IS not permItted wIthm the
Downtown Plan area
By letter dated September 17, 2004, the Commumty Development Coordmator Issued a letter
determmmg that the use of the property IS an automoblle servIce statIOn, and that the expanSIOn
of any portIOn of the use constItutes the expanSIOn of the use It IS thIS determmatIOn that the
appellant IS appealmg
APPEAL PROCESS:
The appellants filed thIS appeal on September 24, 2004 SectIOn 4-501 A 2 of the Commumty
Development Code states that the Commumty Development Board has the authonty to hear
appeals from orders, reqUIrements, deCISIOns or determmatIOns made by an admmIstratIve
offiCIal m the admmIstratIOn of the Commumty Development Code Section 4-502 A proVIdes
that an appeal of an orders, reqUIrements, deCISIOns or determmatIOns made by an admmIstratIve
offiCIal m the admmIstratIOn of the Commumty Development Code may be ImtIated wIthm seven
days of the date of the order, reqUIrement, declSlon or determmatIon made by an admmIstratIve
offiCIal Notice of the date of such meetmg shall be prOVIded the applIcant and the appellants by
mall and by telephone Pursuant to SectIOn 4-504 B, the CDB shall reVIew the applIcatIOn, the
recommendatIOn of the Commumty Development Coordmator, conduct a quaSI-JudIcIal publIc
heanng on the applIcatIOn m accord WIth SectIOn 4-206 (notice and publIc heanngs) and render
a deCISion m accordance WIth the proVISIons of SectIOn 4-206 D 5 grantmg the appeal, grantmg
the appeal subject to speCified condItIOns or denymg the appeal
Pursuant to Section 4-504 C of the Commumty Development Code, m order to grant an appeal,
(overturnmg or modIfyIng the deCISIOn under appeal), the CDB shall find that, based on
substantial competent eVIdence presented by the applIcant or other party, all of the followmg
cntena are met
1) The deCISIOn appealed from mIsconstrued or mcorrectly mterpreted the proVISIOns
of the Commumty Development Code, and
2) That the deCISIOn WIll be m harmony WIth the general mtent and purpose of the
Commumty Development Code, and

East Gatewav District
The East Gateway DIstnct IS bounded by Drew Street on the north, HIghland A venue on
the east, MIssoun Avenue on the west and Court Street on the south and IS shown on
Map 8, page 57. ThIS DIStrict IS compnsed of 686 parcels totalmg 175.6 acres and
represents 32.5 percent of the Downtown area.
Existing Character
East Gateway IS generally charactenzed by a mixed land use pattern of resIdentIal
housmg mterspersed wIth pockets of poorly maintained rental propertIes and outdatei'
stnp commercIal. Tills DIstnct struggles wIth a negative Image of crime due to the
location of problematic uses such as day labor facIlItIes, old motels and SOCIal servIce
agenCIes that provide services to the homeless populatIon. The commercial sector is
burdened wIth a declInIng busmess base, an array of detenorating mfrastructure, a
1ll1smatch of uses, and an mcreasing number of vacant storefronts. RelatIvely well-
mamtamed small professIOnal offices and St. CeCIlIa's CatholIc School anchor the
southern edge of the East Gateway.
District Vision
Uses
It IS enVISIOned that the East Gateway WIll be a VIbrant, stable, dIverse neIghborhood
defined by ItS unIque cultural base and 1ll1xed land uses. It WIll contmue to be developed
as a low and medIUm denSIty reSIdentIal neIghborhood supported wIth neIghborhood
commercIal and profeSSIonal offices concentrated along the major corridors of Cleveland
Street, Gulf to Bay Boulevard, Court Street and MISSOUri A venue. The areas northeast of
Gulf to Bay Boulevard and north of Cleveland Street and east of HIllcrest Avenue should
be mamtamed as a pnmanly low denSIty, low-nse reSIdentIal neIghborhood. The areas
southwest of Gulf to Bay Boulevard, south of Cleveland Street, and north of Cleveland
Street west of HIllcrest Avenue are appropnate for medIUm- and mgh-density multI-
fa1ll1ly reSIdentIal. instItutIonal uses should remam pnmarIly south of Cleveland Street.
FunctIOn
Although the East Gateway DIstnct IS predominantly a reSIdentIal neIghborhood, It WIll
be the pnmary entrance to the Downtown Core once the new Memonal Causeway Bndge
opens Consequently, thIS presents an opportUnIty to define and Improve the functIon of
thIS DIStrICt wIth attractive streetscape and landscapmg elements along wIth appropnate
wayfindmg sIgnage.

should proVIde employment opportumtIes for the DIstnct's residents as well as serve the
dally commercIal and personal service needs of the neIghborhood Commercial and
office development should be redeveloped at a scale compatible with the neIghborhood;
consolidation of small obsolete development parcelslbUlldings is encouraged to create an
adequate lot SIze for modern development standards.

Automobile service stations, all types of vehtcle sales and service uses, fast food

A. A portIOn of the East Gateway has a future land use plan deSIgnation of Central
Busmess DIstnct (CDB) and IS zoned D, Downtown. This section IS generally
located between Mlssoun and Fredenca Avenues one block north and south of
Cleveland Street and IS depIcted on Map 9, page 77. Development shall be
perffiltted as follows WIthin thIS area.

assessed value, these structures may be repaired

except that a nonconforming owner-occupied smgle-
fa.mJl.y detached dwelling unit may be recon-
structed within the associated structure's original
setbacks througl1 a Levell (minimum standard)
approval process. Assessed value shall be deter-
