Ladles and Gentlemen.
The purpose of thIS letter IS to appeal the denYIng of the FleXIble Development ApplIcatIOn for the
reSIdentIal mfield project made by Mr. and Mrs. Enc Held
The baSIS of the appeal IS as follows'
1 The complalmng neIghbor no longer lIves on the adjacent lot to the applIcant.
2. The partIcular lot and lots along thIS lake m the sub dIVISIOn have tremendous erOSIOn
problems that need to be stabIlIzed and the reSIdentIal mfill project will help stabIlIze the
erOSIOn problem.
3 The two surveys attached mdlcate that from 1995 there was a wood deck m the back yard of
thIS home and the applIcant dId nothmg more then add to that deck and then put a lower deck
m for that stabIlIzatIon mentIoned above.
4 The lower deck, whIle havmg been erected wlthm the easement along the shore IS not blocked
on eIther end and smce It IS a non exclusIve easement any other reSIdents are free to use that
shore walk, whIch they probably could not otherwIse use because of the slope and erOSIOn.
5. We have attached to thIS appeal letters of consent from all of the affected property owners WIth
one possIble exceptIOn.
6. If one reVIews the propertIes along thIS lake, there are numerous VIOlatIOns and whIle we agree
that three wrongs do not make a nght, there IS a certam mdlcatIOn that there IS a major problem
that these people have tned to deal with usmg eIther balls of hay, dIrt, railroad tIes or nff raff
7 The lay of the land creates thIS problem and not the applIcant. The applIcant has attempted to
deal WIth tills erosion problem by constructmg a user fnendly, but aesthetIcally better method
then throwmg down concrete blocks and pIeces of wood to attempt to stop the eroSIOn

8. The apphcant wIll m fact apply for a permIt to secure the same if thIS appeal IS granted and the
only reason for not secunng a permIt pnor to constructIOn was that he beheved that he was Just
addmg to hIS eXIstmg deck.
We beheve the above reasons substantiate a basIs for the grantmg of thIS appeal. We would request that
you would review the same and grant the apphcatIOn made by Mr. and Mrs Held. We look forward to

ThIS letter constitutes a Development Order pursuant to Section 4-206 D 6 of the Commumty
Development Code On July 20, 2004, the Commumty Development Board (CDB) revIewed
your appeal apphcatIOn of the decIsIOn of a Level One (FleXIble Standard Development) that
demed an apphcatIon to permIt a reduction to the rear (east) accessory setback from 10 feet to
zero feet (to deckmg) for an eXlstmg wooden deck as a ReSIdentIal Infill Project under the
provISIOns of Section 2-203 C, (Case No FLS2003-l2070), under the appeal prOVISIOns of
SectIOn 4-501 of the Commumty Development Code The Commumty Development Board
demed the appeal apphcatIOn because the appellant dId not show complIance wIth all of the
followmg cntena
1) The declSlon appealed from mIsconstrued or mcorrectly mterpreted the
prOVIsIOns of the Commumty Development Code, and
2) That the decIsIOn wIll be m harmony wIth the general mtent and purpose of the
Commumty Development Code, and
3) WIll not be detrImental to the pubhc health, safety and general welfare
The decIsIon of the Commumty Development Coordmator to uphold the demal of Case No
FLS2003-l2070 was confirmed by all ofthe members of the CDB
The eXlstmg wooden deck extends 6 78 feet beyond the southeast property lme and 1 99 feet
beyond the northeast property lme The applIcant WIll be reqUIred to remove the eXlstmg woodeN
deck WIth proper sedIment and erOSIOn control features mstalled A turbIdIty curtam must be m t
place to ensure no further damage to the wetland ecosystemfNo portIOn of the wooden deck shallt
be permItted wlthm the five-foot easement found m the SpnngLake plat dedIcation along the r$ar
(east) property lme requmng all eXlstmg deckmg beyond thIS easement to be .removed' All
apphcable permIts must be obtamed for the removal of SaId structure by thIrty days (August 19,
2004) from the date of the Commumty Development Board deCISIOn on July 20, 2004 The

APPEAL PROCESS:
The appellants filed thIS appeal on May 19, 2004 SectIOn 4-501 A 3 of the Commumty
Development Code states that the Commumty Development Board has the authonty to hear
appeals from Level One declSlons SectIOn 4-502 A provIdes that an appeal of a Level One
approval (FleXIble Standard Development) may be mltIated by an applIcant or property owner
wlthm the requIred notIce area and who presented competent substantIal eVIdence m the Level
One reVIew wlthm seven days of the date the Development Order IS Issued The filIng of an
applIcatIOn/notIce of appeal shall stay the effect of the declSlon pendmg the final determmatIOn

The Law DIrector's office has opmed that, based on recent lItIgatIOn, the case shall be legally
notIced and placed on the next avaIlable Commumty Development Board (CDB) agenda The
CDB shall reVIew the applIcatIOn, the recommendatIon of the Commumty Development
Coordmator, conduct a quasI-JudICIal publIc heanng on the applIcatIOn and render a decIsIOn m
accordance wIth the provlSlons of SectIOn 4-206 D The Board may grant the appeal, grant the
appeal subject to speCIfied condItIons or deny the appeal (ThIS IS a modIficatIOn from Code
SectIOn 4-504 B that states that the appeal shall be placed on the consent agenda of the next
scheduled meetmg of the CDB and removed only by a vote of at least four members of the
Board)
In order to grant an appeal (overturnmg or modIfymg the decIsIon under appeal), the CDB shall
find that, based on substantIal competent eVIdence presented by the applIcant or other party, all
of the followmg cntena are met
1) The declSlon appealed from, mIsconstrued or mcorrectly mterpreted the
provISIOns of the Commumty Development Code, and
2) The decIsIOn WIll be m harmony wIth the general mtent and purpose of the
Commumty Development Code, and
3) The declSlon wIll not be detnmental to the publIc health, safety and general
welfare

Board)

Dear Mr Held:
Tills letter constItutes a Development Order pursuant to Section 4-206.D.6 of the Commumty
Development Code. On January 29, 2004, the Development RevIew Committee reviewed your
FleXIble Standard Development applIcation to permIt a reduction to the rear (east) accessory
setback from 10 feet to zero feet (to deckmg) for an existing wooden deck as a ResIdential Infill
Project under the provIsIons of SectIon 2-203.C. The Development Review CommIttee (DRC)
gave a tIme extensIOn of 90 days from the date of the DRC hearing. As of April 28, 2004 the 90
day extension has smce expIred and the Development Review Committee DENIED the
applIcatIOn on the fOllowmg bases:
Bases for Denial:
1. The proposal is not in compliance WIth the ResIdentIal Infill Project cnteria, per Section 2-
203.C;
2. The proposal does not comply with the General ApplicabilIty criteria, under SectIon 3-913;
and
3. The existing decking was not permItted and IS m violation of the five-foot easement
dedIcatIon recorded on the Spnng Lake subdIvision plat.
AdditIOnally, an appeal of a Level One denial (FlexIble Standard Development) may be inItIated
pursuant to SectIon 4-502.B by the applIcant or by any person granted party status WIthin 14 days
of the date of thIS Development Order. The filIng of an application/notIce of appeal shall stay the
effect ofthe deciSIOn pendmg the final determmatIon of the case. The appeal penod for your case
expires on May 19, 2004 (14 days from the date ofthis Development Order).
