Dear Cynthia:
With this letter I am appealing the conditions of the above-referenced
Development Order regarding my commercial property at 24 North Fort Harrison
Avenue.
First, I wanted to recap the sequence of events relating to my appeal of the
conditions of this order.
1. Last November, 2003, I called the City Permit Department to inquire whether I needed
a permit to paint my building and was told no, I didn't. I proceeded to hire painters and
painted my building at a cost of approximately $12,000.
2. Then, I began the process of applying for a fa~ade improvement grant. Ann F ogarti
and Reg Owen told me I would need to go through Planning and Zoning so I called you.
During this phone conversation, you expressed disapproval of the color of the bUlldmg.
3. I then met with the Planning Committee to further discuss the building fa~ade and the
wmdows I planned to order At this meeting I was told I needed to have a facade
rendering before I could get approval
4. I proceeded to hire an architect, who charged me $1,000 for renderings, which I
submitted along with the required application fee I was told it would take a month to get
approval, which would have been the end of January, 2004.
5. I called Mark Parry on February 2 and was told I had a verbal approval and it would
take about a week to get it to me in writmg. Three weeks later I received the above-
referenced Development Order, which contains conditions that I simply am unwilling to
comply with.

Next, I wanted to address the criteria mentioned in Section 4-504 regarding
appeals:
I believe that the condition that requires I re-paint my building a neutral color,
such as beige stems from a subjectIve interpretation of the word "garish." I understand
that the code covering building color specifies that garish colors cannot be used but there
is no attempt to define what that means. I have had many, many compliments on the
color of my building and frequent comments about how It livens up the street, brightens
up the area, etc.
The general intent and purpose of the development code is to mamtain property
values and ensure compatible uses of property. In my opinion the building color makes
the building much more aesthetic and thus raises Its value.
The colors I've chosen for my building are not detrimental to the public health,
safety and general welfare and in fact, are beneficial and people have told me how
cheerful the building appears
I would like the Planning Department to reconsider the conditions of approval that
have been stipulated in the above-reference development order. If you have any

This letter constItutes a Development Order pursuant to SectIOn 4-202.E of the Commuruty
Development Code. On January 29,2004, the Development RevIew Conuruttee (DRC) revIewed your
appltcatIon for FlexIble Standard Development approval to mamtam the color on a bmldIng that was
recently repainted Byzantme Purple 243-7 (tnm, and a portIon of the base) and Shimmer (ltght purple)
215-2 (maIn body) WIthIn the Downtown DIstnct under the proVISIons of SectIon 2-902. The proposal
also Includes the InstallatIon of new WIndows (paInted ByzantIne Purple 243-7), new awnIngs over
second-story WIndows and new doors. The DRC recommended approval of the applicatIon WIth the
follOWIng bases and condItIons:

2. The proposal compltes WIth reqmrements of the Clearwater Downtown Redevelopment Plan;

I concur WIth the findmgs of the Development ReVIew Comrmttee and, through thIS letter, approve
your applIcatIon for FleXIble Standard Development WIth above SIX condttIOns. The approval IS based
on and must adhere to the elevatIons, color samples and applIcatIon dated receIved December 23,2003
and as amended by Staff through thIS Development Order.
Pursuant to SectIOn 4-303, an applIcatIon for a buddtng penrut shall be made wIthm one year of
FleXIble Standard Development approval (January 30, 2005). All reqUIred certIficates of occupancy
shall be obtamed wIthm one year of the date of Issuance of the bUIldmg penrut. TIme frames do not
change WIth succeSSIve owners. An extenSIon of tIme may be granted by the Commumty Development
Coordinator for a penod not to exceed one year and only wIthm the ongmal penod of ValIdtty. The
Commumty Development Coordmator may approve an addttIonal extenSIOn of tIme not to exceed one
year for good cause shown and documented m wntmg. The coordmator must receIve the request for
thIS extenSIOn wIthm the one-year penod of validtty after the ongmal tIme extenSIon.
The Issuance of tills Development Order does not relIeve you of the neceSSIty to obtain any budding
penruts or pay any Impact fees that may be reqUIred. In order to faCIlItate the Issuance of any penmt or
lIcense affected by thIS approval, please bnng a copy of thIS letter WIth you when applying for any
penruts or lIcenses that reqUIre thIS pnor development approval.
Pursuant to Section 4-502.A, an appeal may be mItIated WIthin seven days of the date the Development
Order IS Issued by an applIcant or property owners wIthtn the reqUIred notIce area and who presented

Dear Cynthia:
With this letter I am appealing th~ conditions of the above-referenced
Development Order regarding my comm~rcial property at 24 North Fort Harrison
Avenue.
First, I wanted to recap the sequence of events relating to my appeal of the
conditions of this order:
I. Last November, 2003, I called the City Permit Department to inquire whether I needed
a permit to paint my building and was told no, I didn't. I proceeded to hire painters and
painted my building at a cost of approximately $12,000.
2. Then, I began the process of applying for a fa~ade improvement grant. Ann Fogarti
and Reg Owen told me I would need to go through Planning and Zoning so I called you.
During this phone conversation, you expressed disapproval of the color of the building.
3. I then met with the Planning Committee to further discuss the building fa~ade and the
windows I planned to order. At this meeting I was told I needed to have a facade
rendering before I could get approval.
4. I proceeded to hire an architect, who charged me $1,000 for renderings, which I
submitted along with the required application fee. I was told it would take a month to get
approval, which would have been the end of January, 2004.
5. I called Mark Parry on February 2 and was told I had a verbal approval and it would
take about a week to get it to me in writing. Three weeks later I received the above-
referenced Development Order, which contains conditions that I simply am unwilling to
comply with.
Next, I wanted to address the criteria mentioned in Section 4-504 regarding
appeals:
I believe that the condition that requires I re-paint my building a neutral color,
such as beige stems from a subjective interpretation of the word "garish." I understand
that the code covering building color specifies that garish colors cannot be used but there
is no attempt to define what that means. I have had many, many compliments on the
color of my building and frequent comments about how it livens up the street, brightens
up the area, etc.
The general intent and purpose of the development code is to maintain property
values and ensure compatible uses of property. In my opinion the building color makes
the building much more aesthetic and thus raises its value.
The colors I've chosen for my building are not detrimental to the public health,
safety and general welfare and in fact, are beneficial and people have told me how
cheerful the building appears.
I would like the Planning Department to reconsider the conditions of approval that
have been stipulated in the above-reference development order. If you have any

REQUEST:
Appeal of the Level One apphcatIOn (FlexIble Standard
Development case FLS2003-l2066) that reqUires the bUIldmg be
repamted a neutral color, under the provlSlons of SectIOn 4-501
BACKGROUND:
The sIte IS 0.10 acres located on the southwest comer of Laura Street and North Fort Hamson
Avenue. The SIte IS zoned D, Downtown DIStnCt and IS located WIthIn the Downtown Core
Character DIStnCt of the Clearwater Downtown Redevelopment Plan. ThIs area IS recogmzed as
the economIC and geographIc heart of Downtown Clearwater The Clearwater Downtown
Redevelopment Plan recommends that tills area be fully redeveloped m terms of streetscapmg,
parkIng and, most Importantly, a mIX of reSIdential and non-resIdential uses SpecIfically, It
recommends the redevelopment of the Downtown Core as a farmly-onented entertaInment
destmatIOn recogmzmg that a key component reqUired to dIversIfy the Downtown Core IS to
attract reSIdential uses WIth a vanety of housmg types and pnces. PermItted uses m the area
mclude a vanety of nonresIdential estabhshments such as office, retaIl sales and servIce,
restaurant, governmental uses, etc. ThIS strategy has been IdentIfied as a way to stimulate the
redevelopment of property m the area and to repOSItion the Downtown as a VIable economIC
entity m the regIOn.
The SIte has been developed WIth a 7,942 square foot, two-story bUIldmg that dates back to 1924.
There IS a mghtclub to the south (willte and dark grey pamted stucco), offices/retail across North
Fort Hamson Avenue to the east (hght sand pamted stucco) and offices/retaIl to the north across
Laura Street (natural bnck) The subject bUIldmg has been pamted hght purple (mam portIOn of
the extenor of a bUIldmg) and dark purple (base of the bUIldmg and tnm). The apphcant would
hke to mamtam these colors and add new wmdows WIth purple alummum frames. The Planmng
Department reVIewed the apphcatIon and approved It WIth speCIfic condItions relative to the
color The overall concept of makmg extenor Improvements IS encouraged and deSIrable (e g
new pamt, wmdows, tnm, awmngs, etc.). The colors selected, however, are not m keepmg WIth
the mtended character or VISIOn for Downtown
The Code regulates deSIgn wlthm the downtown under SectIOn 3-50~hICh references the
Downtown Deslgn GUldelmes (adopted May, 1996) The GUIdehnes state t~at m general, hght,

should be aVOIded. AddItIonally, the Code regulates color under SectIOn 3-910. It states that no
bUIldIng shall be paInted or otherwIse fimshed wIth a predomInant color whIch IS gansh, gaudy,
loud, exceSSIve, ostentatIous or otherwIse constItutes a glanng and unattractIve contrast to
surroundIng bUIldIngs.
Staff was guIded by both the Deszgn Guzdelznes and the Code WIth respect to the request for
extenor color for thIs applIcatIOn The applIcatIOn was approved WIth condItIons requmng a
neutral color for the maIn portIOn of the bUIldIng and WIndows. The (exIstIng) tnm color was
approved to be maIntaIned as the "bnghter" accent color on the tnm and watercourse. thIS IS
conSIstent WIth the regulatIOns contaIned WIthIn the GUIdelInes and Code. The colors as
proposed and paInted on the bUIldIng are not conSIstent WIth surroundIng bUIldIngs that are
neutral
thIS case IS an appeal of a Level One deCISIon that apvroved a FleXIble Standard Development
applIcatIOn WIth condItIons The condItIons Included the reqUIrement that the bUIldIng be repaInted
a neutral color (sand, beIge, cream, etc.), the WIndow frames be a neutral color (whIte, sand,
beIge, cream, etc.), the tnm along the rooflIne, edge of canopy and WIndow SIlls may remaIn a
bnghter color (eXIstIng ByzantIne Purple 243-7) IncludIng a three-foot hIgh (maxImum)
watercourse around the base of the bUIldIng and that the awmng matenal conSIst of a
complImentary color.
A Development Order (ExhIbIt "A") was Issued on February 20,2004. Attached IS the FleXIble
Standard Development applIcatIOn (FLS2003-12066 - ExhIbIt "B")
APPEAL PROCESS:
The appellant filed thIS appeal on December 23, 2003 SectIOn 4-501.A.3 of the Comrnumty
Development Code states that the Comrnumty Development Board has the authonty to hear
appeals from Level One approval deCISIOns. SectIon 4-502.A proVIdes that an appeal of a Level
One approval (FleXIble Standard Development) may be InItIated by an applIcant or property
owner WIthIn the reqUIred notIce area and who presented competent substantIal eVIdence In the
Level One reVIew WIthIn seven days of the date the Development Order IS Issued. The filIng of
an applIcatIOn/notIce of appeal shall stay the effect of the deCISIOn pendIng the final
determInation of the case
The Law DIrector's office has opIned that, based on recent lItIgatIOn, the case shall be legally
notIced and placed on the next aVaIlable Comrnumty Development Board (CDB) agenda The

CDB shall reVIew the apphcatIon, the recommendatIOn of the Commumty Development
Coordmator, conduct a quasI-JudIcIal pubhc heanng on the apphcatIOn and render a decIsIOn m
accordance wIth the provlSlons of SectIOn 4-206.D The Board may grant the appeal, grant the
appeal subject to speCIfied condItIons or deny the appeal (ThIs IS a modIficatIon from Code
SectIOn 4-504.B that states that the appeal shall be placed on the consent agenda of the next
scheduled meetmg of the CDB and removed only by a vote of at least four members of the
Board. )
In order to grant an appeal (overturnmg or modIfymg the declSlon under appeal), the CDB shall
find that, based on substantIal competent eVIdence presented by the apphcant or other party, all
of the followmg cntena are met
1) The declSlon appealed from, mIsconstrued or mcorrectly mterpreted the
provISIOns of the Commumty Development Code, and
2) The decIsIon WIll be m harmony wIth the general mtent and purpose of the
Commumty Development Code; and
3) The decIsIOn WIll not be detnmental to the public health, safety and general
welfare

GENERAL INFORMATION:
REQUEST:
Appeal of the Level One applIcatIon (FlexIble Standard
Development case FLS2003-12066) that reqUIres the bUIldmg be
repamted a neutral color, under the proVIsIons of SectIOn 4-501
BACKGROUND:
The sIte IS zoned D, Downtown Dlstnct and located wlthm the Downtown Core Character
DIStnCt of the Clearwater Downtown Redevelopment Plan thIS area IS recognIzed as the
economIC and geographIc heart of Downtown Clearwater.
The sIte has been developed WIth a 7,942 square foot, two-story bUIldmg that dates back to 1924.
There IS a nIghtclub to the south (whIte and dark grey pamted stucco), offices/retaIl across North
Fort Hamson Avenue to the east (lIght sand pamted stucco) and offices/retaIl to the north across
Laura Street (natural bnck). The subject bUIldmg has been pamted lIght purple (mam portIOn of
the extenor of a bUIldmg) and dark purple (base of the bUIldmg and tnm). The applIcant would
lIke to mamtam these colors and add new wmdows WIth purple alummum frames The P1annmg
Department revIewed the applIcatIon and approved It WIth speCIfic condItIons relatIve to the
color. The overall concept of makmg extenor Improvements IS encouraged and deSIrable (e.g.
new pamt, wmdows, tnm, aWnIngs, etc) The colors selected, however, are not m keepmg WIth
the mtended character or VISIOn for Downtown.
The Code regulates deSIgn wlthm the downtown under SectIOn 3-502 wluch references the
Downtown DeSIgn Guidelmes (adopted May, 1996). The GUIdelInes state that m general, lIght,
cool colors should be selected for the mam body of the bUIldmg WhIte, off-whIte and pastels are
appropnate. LIght colors reflect the heat and are the tradItIonal colors most frequently used m
Flonda If tnm IS deSIred to be hIghlIghted, a lIght pastel accent color should be used. Dark or
overtly contrastmg colors should be used very selectIvely. In general, the tnm may also be
pamted usmg a slIghtly lIghter or darker color tone of the mam color. In some SItuatIOns,
normally on smaller, or reSIdentIal and "Vlctonan" style bUIldmgs, darker base colors and accent
tnm colors may be conSIdered for approval Bnght colors may be used on aWnIngs, as an accent
to the lIght, cool colors of the bUIldmg Itself. However, gansh "electnc" or "day-glo" colors
should be aVOIded. AddItIonally, the Code regulates color under SectIon 3-910. It states that no
bUIldmg shall be pamted or otherwIse finIshed WIth a predommant color WhICh IS gansh, gaudy,
loud, exceSSIve, ostentatIOUS or otherwIse constItutes a glanng and unattractIve contrast to
surroundmg bUIldmgs.
Staff was guIded by both the DeSIgn GUldelmes and the Code WIth respect to the request for
extenor color for thIS applIcatIOn. The applIcatIOn was approved with condItIons requmng a
neutral color for the mam portIOn of the bUIldmg and wmdows The (exlstmg) tnm color was
approved to be mamtamed as the "bnghter" accent color on the tnm and watercourse. ThIS IS
conSIstent WIth the regulatIOns contamed wltlun the GUIdelInes and Code. The colors as
proposed and pamted on the bUIldmg are not conSIstent WIth surroundmg bUIldmgs that are
neutral

ThIS case IS an appeal of a Level One decIsIon that approved a FlexIble Standard Development
apphcatIOn WIth condItIons The condItIons mcluded the reqUIrement that the buIlding be repamted
a neutral color (sand, beIge, cream, etc.), the wmdow frames be a neutral color (whIte, sand,
beIge, cream, etc ), the tnm along the roofhne, edge of canopy and wmdow SIlls may remam a
bnghter color (exIstmg Byzantme Purple 243-7) mcludmg a three-foot htgh (maxImum)
watercourse around the base of the bUIldmg and that the awnmg matenal consIst of a
comphmentary color.
A Development Order (ExhtbIt "A") was Issued on February 20, 2004. Attached IS the FlexIble
Standard Development apphcatIOn (FLS2003-12066 - ExhIbIt "B").
In order to grant an appeal (overturmng or modIfymg the deCISIOn under appeal), the CDB shall
find that, based on substantIal competent eVIdence presented by the apphcant or other party, all
of the followmg cntena are met
1) The deCISIOn appealed from, mIsconstrued or mcorrectly mterpreted the
prOVISIOns of the Commumty Development Code; and
2) The deCISIOn WIll be m harmony WIth the general mtent and purpose of the
Commumty Development Code; and
3) The declSlon WIll not be detnmental to the pubhc health, safety and general
welfare.
