Dear Mr Gregg
On July 19,2005, the Commumty Development Board (CDB) approved WIth mne condItIons the above
referenced case, whIch was a FlexIble Development applIcatIOn to permIt retaIl sales and servIces WIth a
reductIon to the front (west along US HIghway 19 N) setback from 25 feet to 15 feet (to pavement),
reductIons to the sIde (north) setback from 10 feet to five feet (to bUIldmg) and from 10 feet to mne feet
(to pavement), a reductIOn to the sIde (south) setback from 10 feet to five feet (to pavement), a reductIOn
to the rear (east) setback from 20 feet to zero feet (to pavement), an mcrease to bUIldmg heIght of an
addItIonal SIX feet for penmeter parapets (from roof deck - roof deck at 18 67-foot heIght), a reductIOn to
reqUIred parkIng from 36 to 33 spaces and a deVIatIOn to allow dIrect access to a major artenal street (US
HIghway 19 N), as a ComprehensIve Infill Redevelopment ProJect, under the prOVIsIons of SectIon 2-
704 C, and a reductIOn to the mtenor landscapmg reqUIrement from 10 percent to 6 8 percent, as a
ComprehensIve Landscape Program, under the provlSlons of SectIOn 3-1202 G
A proposal has been submItted to reVIse the approved SIte and bUIldmg plans as a Mmor ReVISIOn under
the proVIsIOns of SectIOn 4-406 WIth the followmg
The nature of the proposed development IS now for a two-umt bUIldmg of 5,850 square feet,
whICh mcludes a bank (office use) of 4,507 square feet and a restaurant of 1,343 square feet (229
percent of the gross floor area [GF AJ) PrevIOusly, the CDB approved a multI-tenant (SIX umts)
shoppmg center of 7,217 square feet, whIch mcluded a restaurant of 1,400 square feet m one of
the umts (194 percent of the GFA)
2 The proposed bank mcludes two dnve-thru lanes on the east SIde ofthe buIldmg
3 The proposed parkmg layout IS SImIlar to that approved by the CDB, mcludmg proposed setbacks
to property lmes
4 The retentIon area has been relocated to the north SIde of the bUIldmg
5 The dumpster enclosure has been relocated from the east SIde of the bUIldmg to the southeast
comer of the SIte
6 The bUIldmg deSIgn has been changed to reflect the two tenant umts, mcludmg the proVIsIOn of
the dnve-thru lanes
In accordance WIth SectIOn 4-406 A of the Code, the reVISIons proposed are not deemed to be a Mmor
ReVISIOn and are, therefore, DENIED for the followmg reasons

1 SectIOn 4-406 A 2 provIdes that a Mmor ReVISIOn IS one that "Does not change the use unless
such change IS of a SImIlar or less mtensIty, as detenmned by the commumty development
coordmator" AddItIonally, SectIon 4-406 A 3 states "Does not mcrease the densIty or mtensIty
of the development" and SectIOn 4-406 A 9 states "Any other mmor reVISIon that does not
substantIally alter the character and deSIgn of the project" WhIle the square footage of the
proposed bUIldmg has been reduced and the number of tenant umts has been reduced, It IS that the
proposed uses are now an office (bank) and a restaurant that represents an mcrease of mtensIty for
thIS SIte for the followmg reasons
a Incorporatmg a bank mto the SIte SIgnIficantly changes the projected traffic Impact and
trIggers the reqUIrement for a Traffic Impact Assessment due to an mcrease of over 100
vehICle trIps per hour m the PM peak hour
b The applIcatIOn approved by the CDB mcluded a reductIOn of reqUIred parkmg from 36 to 33
parkmg spaces Under thIS new proposal, the reqUIred parkIng IS 38 parkIng spaces, whereas
only 29 spaces are provIded (1,343 square-foot restaurant @ 15 spaces per 1,000 square feet,
4,507 square-foot office (bank) @ four spaces per 1,000 square feet) WhIle the number of
reqUIred parkIng spaces has mcreased, the number of proVIded parkmg spaces has also
decreased ThIS new proposal IS not the same as what was reVIewed and approved by the
CDB
2 The bUIldmg approved by the CDB was deSIgned WIth a bUIldmg heIght less than 25 feet,
mcludmg archItectural features that projected above the roof deck ThIS new proposal mcludes a
parapet of three feet above the roof deck (whIch meets current Code) Two archItectural features
projectmg above the roof deck are now greater than 25 feet (one at 27+ feet and the other at 29
feet to the peak of each) SectIOn 4-406 A 8 states "Does not mcrease the heIght of the bUIldmgs
m a manner that wIll change the overall heIght of the project, wIll not alter the scale of the
project, does not exceed the maXImum heIght permItted m by the applIcable special area plan and
zonmg dIStrICt" These heIght of these portIOns of the bUIldmg were not mcluded m that
approved by the CDB
3 The dumpster locatIon has changed and the setback to the comer of the dumpster enclosure
closest to the south property lme IS less than the five-foot SIde setback approved by the CDB
SectIon 4-406 A 4 states "Does not result m a reductIOn of setback or preVIOusly reqUIred
landscape area "
WhIle thIS letter formalIzes the Staff reVIew of thIS new proposal, the findmgs of thIS reVIew were
verbally commumcated to you approxImately two weeks ago It has come to our attentIon that thIS
applIcatIOn IS now VOID, as there has been no applIcatIOn for a bUIldmg permIt for the project as
approved by the CDB, as reqUIred by SectIOn 4-407 There was no request for a tIme extenSIOn pnor to
the expIratIon date for thIS case (July 19,2006)

Lateral lines are to be installed a minimum of 12" below finish grade.
All lateral lines not sized shall be 3/4" PVC CL 160. e.g. end runs,

I, shallow wells, open surface water bodies. or reclaimed water must be used as a source of
irrigation water, The distribution system for irrigation must not be connected to county or
