Corp./C1ty) LUP 85-25, Z-85-10. RECOMMENDATION: City Commission continue this item and d1rect the City Clerk to readvertise the public hearing as required by law. [] And that the appropriate officials be authorized to execute same. BACKGROUND: The property is located on the east side of Gulf Boulevard immediately north of Sand Key Condo, Bayside Gardens IV. The site is vacant and contains 8.64 acres M.O.L. The Land Use Plan classification is Medium Density over the southern 6.34 acres. The northern 2.3 acres is classified Commercial/Tourist Facilities and proposed to be amended to Medium Density Residential. The zoning over the entire parcel is B (Business), on older zoning designation which remains on the property as a result of a Court Order issued for Case No. 78-4765-7, United States Steel Corporation vs. City of Clearwater. The order found City Ordinance No. 1749 to be invalid for the purpose of rezoning those properties on Sand Key owned by the U.S. Steel Corporation. ~ Legal counsel and staff felt that sufficient opportunity and time had passed to allow development to occur on the property under the B (Business) zon1ng category. It is recommended that the City Commission continue this item since staff and legal counsel are now actively pursuing with the owners a mutually agreeable development plan for the vacant parcelS on Sand Key. The Planning and Zoning Board is scheduled to review this item on October 15, 1985. Staff will request the Planning and Zoning Board to continue this item. Commission Disposition: 1.
