Zon1ng Atlas Amendment from B (Business) to RY-28 (Multiple Family
Residential) for M&B 43.02, Sec. 19-29S-15E (American Design and Devel.
Corp./City) Z-85-11.
RECOMMENDATION:
City Commission continue this item and direct the City Clerk to
readvertise the public hearing as required by law.
[] And that the appropriate officials be authorized to execute same.
BACKGROUND:
The property is located on the west side of Gulf Boulevard adjacent to and
north of the Cabana Club Condominium. The site is vacant and contains 7.57
acres M.O.L.
The Land Use Plan classification is High Density Residential with a zoning
des1gnation of B (Business), an older zoning designation which remains on
the property as a result of a Court Order issued for Case No. 78-4765-7,
United States Steel Corporation vs. City of Clearwater. The order found
City Ordinance No. 1749 to be invalid for the purpose of rezoning those
properties on Sand Key owned by the U.S. Steel Corporation.
Legal counsel and staff felt that sufficient opportunity a~d time had
passed to allow development to occur on the subject proper~y under the B
(Business) zoning category. It is recommended that the City Commission
continue this item since staff and legal counsel are now actively pursuing
with the owners a mutually agreeable development plan for the vacant
parcels on Sand Key.
The Planning and Zoning Board is scheduled to review this item an October
15, 1985. Staff will request the Planning and Zoning Board to continue
this item.
