hereby amended by addmg thereto the folloWlng:
Regardless of the area or the width of a lot or parcel of
record pnor to December 1'7, 1961, a person shall be
permltted to erect a pnnclpal bUlldlng on such lot or
parcel in any use dlstnct provldeCi such bUlldmg shall
comply wlth the apphcable mlnImUm bUlldmg setback
requIrements and bUlldlng regulatIons.

Sectlon 14. All ordlnances or parts of ordinances In confhct hcre-

Sectlon 16. Any person or persons, fIrm or corporatlon or aSSOCl-
atlon of persons, who shall vlOlate or fall to comply Wlth any of the terms or
proVlSlons of thls orciinance shall, upon convlctlon In the MUnIcIpal Court,
be fmed not exceedmg the sum of Two Hundred ($200.00) Dollars, or Im-
prisonment m the Clty Jall for not exceedmg SlXty (60) days, or by both
such fme and lmprisonment In the dlscretlon of the MUnIclpal Judge. Each
day that a vlolation is permitted to eXlst shall constltute a separate offense.
Section 17. The provlslons of thIS ordmance shall take effect
from and after theu passage and theIr approval by a ma]onty of the
qualIfied voters of the Clty of Clearwater who are freeholders wlthm
sald Clty votlng on the proVlslOns Indlvldually, at a speclal munlclpal
electIon to be held In conJunctlon with the regular munIcIpal eh~ctlon on

A.1) The site plan shall be modified to reflect a maximum habitable structure height of 210 feet. Any structure
height in excess of 210 feet to accommodate equipment, etc. in confonnance with the settlement stipulation
shall be subject to review and approval by City staff prior to issuance of a building pennit.
2) The site plan shall be modified to indicate no active recreational uses, including swimming pools, in the view
corridor.
B. The Development ReView Comnnttee at Its meetmg of July 23, 1992 approved the above descnbed site plan subject to
the followmg conditions I
1) SignS and fencmg/walls are subject to separate review and pernuttmg processes
2) The reqUlslte bulldmg pernuts must be procured Wlthm one (1) year from the date of certification of the fmal site
plan and all requlSlte certificates occupancy must be obtamed WithIn three (3) years of the date of certification
of the site plan
3) Pnor to certificatIon of the fmal site plan, the tabulation table shall be adjusted to show the area of the
townhouses and multi-story bulldmg separately m order to compare with approved modifications
4) Pnor to certification, the apphcant shall provide additIonal mformatIon accordmg to the court stipulation for the
facllltles proposed above the roof lme beyond the 210 foot height hnnt.
5) Fire lane shall be designated to access the townhouses. The final deSign shall be subject to the approval of the
Fue Marshal.

Just a brief note to confirm our telephone conversation today in which
I conveyed to you that the City is not able to accept and process for
consideration the Community Impact Statement and site plan for the
proposed South Beach IV Condominium at 1480 Gulf Boulevard in Clearwater.
The Community Impact Statement and site plan have been prepared Based on
a zoning designation identified as "RM 54", as noted under Item E 1 of
the Community Impact Statement. We find this classification to be in
error and the proposed development to be ,inconsistent with the applicable
zoning standards. We are thus unable to process your application.
As we discussed, I will be in touch with you during the next day or
two to set up a meeting at which we can pursue the alternative available
courses of action.
