Dear Dennis:
In response to your letter of this date regarding the application to construct
a carport at South Beach m, I am writing this letter to confirm the agreement
we reached today by telephone.
It 18 not the City's intention to interpret Judge Drivel". decision as limited to
the property at 1480 Gulf Boulevard. Thel"efore, any application for a building
permit on U. S. Steel property on Sand Key would be considered in light of the
business zoning as it existed at the time of allDexation. Accordingly, I have
notified Roy Ayres of this interpretation and he will direct that the permit for
the carport be issued immediately.
In d18cussing this matter with Mr. Ayres he mentioned that he told Mr. Frank
Felix of U. S. Steel that the City would be prepared to act on the application
for a building permit on South Beach IV before this week is over. Mr. Felix
notified Mr. Ayres that U. S. Steel intends to amend its application for South
Beach IV. Mr. Ayres responded that the City would be pleased to allow an
amendment, and consequently no permit will be issued on the application
pending U. S. Steel'l amendment. Any future applications will be reviewed
for their compliance with health and safety cocJel pursuant to the normal City
procedures. Mr. Felix concurred that this wal as U. S. Steel intended.
Again, let me apologize for any misunderstanding that might have arisen
regarding this application.
I look forward to receiving a written order from the court.

Dear Don:
This letter is in response to your request to construct carports on the property
located at 1500 Gulf Boulevard, referred to as South Beach III.
In accord with our conversation,. this is to advise that I have no objection to
the issuance of a permit for the row of carports located immediately north of and
closest to the building, with the exception of the four westerb'-most spaces and
wall. With this exception, this row of carports is, for the most part, within
the envelope within which structural location would be permitted based on water-
front setback provisions. It should also be noted that the emergency generator,
ifovver thirty (30) inches in height, would appear to need to be relocated or a
variance sought. The portion of the four easternmost carports which project beyond
the setback dimension is inconsequential and, in my view, does not require that a
variance be obtained in order to locate this installation.
The second row of carports proposed to be situated north of the first tier above
described rests entirely within the required waterfront setback area and cannot
be permitted without authorization of a variance by the Board of Adjustment and
Appeal on Zoning. If it is your desire to locate such additional carports, 1
recommend you make application for such variance. In fairness to you, 1 should
also point out that my position would be to oppose such variance as a major departure
from the waterfront setback requirements that would appear to be without sufficient
justification to warrant variance.
For your further information, in reviewing the file as to the issuance of a permit
for the South Beach III building at 1500 Gulf Boulevard, I find nothing that would
exempt this site from the waterfront setback section of the Zoning Ordindnce.
Since the waterfront provision has been in effect since June, 1974, 1 am unable to
determine why the site plan, which is the basis on which you are proceeding, was
approved if, indeed, it was, in contradiction to the waterfront setback requirements.
Specifically, such setback requirements require that one sideyard be maintained
open and unobstructed without parking unless such parking is depressed three feet
or more below the grade level of the adjoining street. The site plan you left with
me clearly contemplates parking at grade OD both the north and south areas.

In response to the discussions in our meeting with you on July l3
relative to the above captioned subject, we offer the following com-
ments and information (please refer to your list of items numbered
1 through l8):
1. We will modify circuit in dining room so each apartment has
two (2) 1500 watt appliance branch circuits serving receptables only
in the kitchen and dining room.
2. We are not using PVC inside structure.
3. We will provide available short circuit current at transformer
bushings as provided by Florida Power Corp. We point out that in the
past the Owner has worked directly with Florida Power Corp. to provide
secondary service (conduit and cables) between transformer and busway
cable tap box.
4. The design will be changed to meet the Federal Flood Control
Law requirements.
5. It is our understanding that the design already complies with
N.E.C.
6. This information is already shown on panel schedule.
7. We will add grounding details in addition to provision currently
included in specifications.
8. This item wil1 be included in our design during the rework of
the documents.
9. We will conform with Article 336-3.

trical Inspection Department. We prefer these on our standard engineering
calculation forms and not on the drawings.

13. Service is via 4000 ampere busway (with reduced size where
permitted by N.E.C.). In the past, Florida Power Corp. has provided
service from transformer to busway cable tap box (refer to No.3, above).

15. It is our interpretation that the fixtures in the parking area
meet the code requirements.
16. All emergency systems are separately enclosed from normal sys-
tems and, in our judgment, conform to Article 700 of the N.E.C.
17. Refer to HVAC and Plumbing equipment schedules.
18. We will be happy to review documents with appropriate officials
prior to final release for construction.
With reference to the City Fire Marshal's comments, we offer the following:
A. We will add a fire alarm pull box.
B. It is our opinion that the exit signage is adequate. We, there-
fore, would like to discuss this further with Mr. Buhmeyer at his convenience.
C. Wooden storage lockers in the garage area shall be constructed of
pressure treated noncombustible material.
D. A heat detector will be installed in the maintenance office at the
parking level (see Sheet E-8).
E. Door #19 on Sheet A-I shall be a 3Q door.
F. The 2-1/2" valve in the stair towers will be installed 4' above
floor level.
G. Reference detail Alp-I, Sheet P-l. A gate valve will be added
as required.

The only reference I can find in the above documents which
corresponded in time to any action by the City is Mr. Paroby's
letter of June 13, 1975, in which he said, among other things,
about the meeting of June 11, 1975:
liThe Building Permit Review Committee decided, subject
to the C~ty Attorney's review and concurrence, that a
building permit be issued. . . . Your building plans
are now being reviewed by appropriate City Departments."
All other and subsequent correspondence, I am sure you agree, are
only recollections and explanations of past act~ons; they in no
way attempt to make any official determinations. ' On the other
hand, while you may disagree, we cannot believe that the letter
of June 13, 1975, quoted above, constitutes advice that a building
permit has been ~ssued or that the letter ~tself constitutes the
issuance of a building permit. That letter, as indicated, states
that there are two conditions precedent to the issuance of a
building perm~t, namely, the City Attorney's review and concur-
rence and review by appropriate City Departments. My client has
not been advised that either of the conditions had occurred. At
one meeting, attended by Messrs. Felix, Blanton, and Bustin, among
others, I understand that Mr. Bustin indicated that he d~d not
know whether or not his office had ever reviewed the matter and
Mr. Blanton indicated that his department had not approved the
building plans.
Our client requests that the building permit captioned above
immediately be issued. Please advise the undersigned when it
can be picked up. In the absence of such issuance, we request
the opportunity to meet with you at an early date and discuss this
matter further in an attempt to avoid litigat~on. In addition, we
request that we be provided immedlately Wlth the followlng docu-
ments:
1. Certif~ed minutes of the Building Permit Review
Committee meeting of June 11, 1975.
2. Copy of building permit issued by the City of
Clearwater as a result of the captioned applica-
tion.

was previously granted a permit, and, USS Realty allowed that permit
to expire. USS Realty then appeared before the Building Permit Review
Committee to discuss the possibility of issuing another permit under
the original application. You were told at that time that another application
would have to be filed. That decision was confirmed in a letter from
Ed Blanton to you dated February 17, 1'976. No new application has
been received to date.
In the light of these facts, your position that another permit
should be issued is untenable.

May 17, 1977.
Upon reviewing the history as it is shown in our files, Mr. Paroby ad-
vised us by phone on June 13, 1975, that the City was going to review
our application for building permit since Federal funding had been
received and that the Marshall Street Sanitary Treatment Plant expansion
was then underway.
On June 13, we were notified by letter from Mr. Paroby that a building
permit could be issued pending: (1) City Attorney's review of permit
and concurrence with same and (2) review of our building plans by the
various appropriate city departments.
As time t~anspired pending the above, we then received the City's letter
of Janu~ry 15. As of that date, the City's Building Department and
Attorney had not reviewed our application nor concurred with the Building
Permit Review Committee's recommendation to issue a permit.
There then was further discussion and correspondence between us leading
up to the last meeting we had with the City Attorney, the Head of the
Building Department, the Planning Department and other City representa-
tives. The date of this meeting was May 14, 1976 at which we specifically
,asked if the City Attorney or the Building Department had ever reviewed
our request for application as was indicated and required in Mr. Paroby's
letter of June 13, 1975. Upon receiving an answer in the negative, we
then requested that the City inform us once this administrative process
had been fulfilled by the City. To date your offices have not responded
to our above request.

regarding the above captioned building permit application. Our
records reflect the following history with referBDce to this application.
On June 13, 1975, your project manager, Frank Felix, was Dl)tified
that the requested building permit had been granted. On January 15, 1976,
the Building Director notified Robert C. Hill, a representative of USS Realty
Development, that the aformnentioned building permit had expired inasmuch
as no one had attempted to pick it up for seven months.
,On February 11, 1976, Frank Felix appeared before the City's
Building Permit Review Committee regarding the construction of the proposed
144-unit building at 1500 Gulf Blvd. The Committee notified Mr. Felix at
that tim.e of the ComIl"'...ittee's position that the plans submitted in May, 1974,
were invalid since the building permit had been allowed to expire. In addition,
by letter dated February 17, 1976, Ed Blanton reiterated the basic issues covered
in that meeting, to Mr. Felix.
Inasmuch as our files reflect the above-described series of events
relative to the application of USS Realty, it is clear that USS Realty is not
entitled to another building permit until new plans are submitted. Iii is also
clear that the long-awaited building pennit of which you speak was granted
to USS Realty in June, 1975, and was allowed to expire by your firm seven
months later in January, 1976.

Attached is a letter from D. E. Sirnpson,~_ProJect Engineer, U. S. Steel
Realty Development, dated April 22, 1977 in which he requests a building per-
mit for a 144 unit condominium at 1500 South Gulfyiew Boulevard on Sand Key.
Also attached is a memorandum dated June 13, 1975 to Guy Kennedy, then
Acting City Attorney, regarding this matter. Attached also is a letter dated
June 13, 1975 to U. S. S. Realty, informing them that the Building Permit
Review Committee had made a partial sewer allocation for this property in
accordance with a policy approved by the City Commission.
Because U. S. S. Realty did not respond to this letter (June 13, 1975) nor did it
take any action to obtain a Building Permit based on this limited allocationll the
Building Director informed U. S. S. Realty by letter dated January 2,0, 1976 (attached)
that the allocation by the Building Permit Review Committee had expired and their
plans would be discarded if not picked up in 30 days.
At the request of U. S. S. Realty, the Building Permit Review Committee had a
discussion with Frank Felix, U. S. S. Realty, on February 11, 19760 The results
of this meeting were summarized in a letter to Mr. Felix dated February 17, 1976
(copy attached). This letter cOIJ,cluded that the sewer allocation to U. S. S.
Realty and their application and plans had become invalid because of inaction by
U. S. S. Realty.
Please advise as to how we should respond to the April 22, 1977 letter from
u. S. S. Realty.

1500 Gulf Blvd. South, was reached at the June 1975 Building Rev~ew
meet~ng. Approval fer build~ng perm~t was recommended with a Certificate
of Occup~ncy l~m~ted to 25% of the total units unt~l the 25% has been
7570 occup~ed.
As you know, the City of Clearwater ~s under a partlal building moratorlUID
and each month a reVlew board approves a Ilmlted number of appllcatlons.
It is a POllCY of the reVlew board that a conditlon of such approval is,
that obtainlng permits be pursued dillgently, and that failure to take
out the permlt wlthin thirty (30) days of notificatlon will be cause for
rescinding such approval. Slnce no actlon was taken by the applicant to
obtain the allocated buildlng permlts, the allocation of the Buildlng
Permit Review Board has explred.
Your documents will be held in the Buildlng Department for thlrty (30;
days from the date of thlS letter and then dlscarded lf you do not wlsh
to retrleve them.

On June 11, 1975 the Building Permit Revlew Committee considered a request
from the U. S. Steel (U. S. S.) Realty for building permlts for a hlgh-ris e build-
ing on Sand Key consisting of 144 units. This request was received by the
Building Department about thirteen months ago. The Committee had deferred
the request since then because of the uncertainty regarding the status of the
City's proposed expansion of the Marshall Street Sewer Treatment Plant. This
pr oj ect is now under way.
The Corrunittee was uncertain as to whether it should treat the request under
grandfathering rules, or to consider the project under current restnctions
pertaining to the 80-foot building height limitation and the current 28-unit
density restriction. The proposed building exceeds both of these criteria
which were not in effect when the plans were submitted.
The Conunittee decided that, subject to your concurrence, certificates of
occupancy would be issued for 250/0 of the units, and that additional certificates
of occupancy could be requested when those 250/0 of the units were 750/0
occupied. The Committee could not issue 144 Certuicates of Occupancy as
there are not that many units available at the treatment plant. The action
taken by the Committee is consistent with City Commlssion policy, and similar
action has been taken in the past by the Corrunittee for sirmlar structures.

Dear Mr. Felix:
This letter is to confirm our telephone conversa1i.on of today, whereby
I informed you of the action taken by the Building Permit Review Com-
mittee at its meeting of Wednesday, June 11, 1975 pertaining to your
company's request for a building permit for a planned apartment build-
ing on Sand Key.
As you know, your building plans were submitted to the City Building
:pepartment over a year ago, The City took no action on the matter
because of the uncertainty r"lating to the status of federal funding for
the City1s planned expansion of the Marshall S.treet Sanitary Treatment
Plant. This facUity serves 5and Key and the plant does not presently
have the capacity to serve your proposed building.
Federal- funding has been received and the expansion is now under way.
The Building Permit Review Committee decided, subj ect to the City
Attorneyl s review and concurrence, that a building permit be issued
but that Certificates of Occupancy would be issued only for 25% of the
units. Further, when these units are 75"/0 occupied, then Certificates
of Occupancy for the remaining units could be requested. The granting
of the remaining Certificates of Occupancy would, of course, be contin-
gent upon the capacity to serve being available at the Marshall Street
Plant. Your building plans are now being reviewed by appropriate City V
Departments.
