A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA
DETERMINING NECESSITY OF GRANTING PINELLAS COUNTY, A
POLITICAL SUBDIVISION OF THE STATE OF FLORIDA, PERPETUAL
EASEMENT OVER, ACROSS AND UPON CERTAIN LANDS OWNED BY
THE CITY IN THE NORTHEAST % OF SECTION 7, TOWNSHIP 29
SOUTH, RANGE 16 EAST FOR THE PURPOSES OF INGRESS,
EGRESS, CONSTRUCTION, INSTALLATION AND MAINTENANCE OF
A 42-INCH WATER MAIN; FINDING VALID PUBLIC PURPOSE;
DECLARING SAID EASEMENT AS SURPLUS TO CITY NEEDS FOR
THE PURPOSE OF CONVEYING THE AFORESAID RIGHTS;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Pinellas County (herein "County") is required to relocate an
existing 42-inch water main from its present alignment within existing U. S.
Highway 19 right-of-way to facilitate roadway improvements by the Florida
Department of Transportation (herein "FDOT"); and,
WHEREAS, the City is the owner of lands adjacent on the west to the existing
U. S. Highway 19 right-of-way; and,
WHEREAS, the County has applied to the City for perpetual easement over,
across and upon a 0.25 acre portion, more or less, of City-owned lands adjacent to
the existing west right-of-way line of U. S. Highway 19 for the purpose of relocating
a 42-inch water main, together with rights of ingress, egress, construction,
installation and maintenance thereof; and,
WHEREAS, the City has advised the County that it has previously granted to
the FDOT perpetual easement as recorded in O. R. Book 11397, Page 2680 of the
Public Records of Pinellas County, Florida over, across and upon a portion of the
easement premises for which the County has made application; and,
WHEREAS, the County has advised the City that easement rights for which
the County has applied shall not conflict or interfere with the rights vested in the
FOOT by virtue of the aforementioned perpetual easement; and,
WHEREAS, said application has been duly considered by the City
Commission; and,

WHEREAS, Section 2.01 (d)(5)(iii) of the City Charter authorizes the transfer
of surplus real property to another governmental entity for less than appraised
value after an advertised public hearing has been held, and a finding by the
commission of a valid public purpose for the transfer; now, therefore,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. That the application of the County for a perpetual easement over,
across and upon certain City-owned lands lying and being situate in the Northeast
1,4 of Section 7, Township 29 South, Range 15 East, containing 0.25 acres, more or
less, and being more specifically described and depicted in EXHIBIT "A" appended
hereto, is found and declared to be for a valid public purpose, and is hereby
declared surplus within the meaning of the City Charter for the purpose of
conveying perpetual easement therein to Pinellas County for ingress, egress,
construction, installation and maintenance of a 42-inch water main; subject to
those rights vesting in FDOT by virtue of that certain perpetual easement recorded
in O. R. Book 11397, Page 2680, Public Records of Pinellas County, Florida.
Section 2. That a certified copy of this Resolution be forwarded forthwith to
Pinellas County.
Section 3. This resolution shall take effect immediately upon adoption.
