RESOLUTION 01-12 A RESOLVTlON OF THE CITY OF CLEARWATER, FLORIDA, DETERMINING NECESSITY OF GRANTING THE FLORIDA DEPARTMENT OF TRANSPORTATION PERPETUAL EASEMENT ACROSS CERTAIN LANDS OWNED BY THE CITY TITLED AS PARCELS 804.01 AND 806.01, S. R. 55, SECTION 15150-2580, FOR THE PURPOSE OF CONSTRUCTING OR IMPROVING SAID SECTION OF S. R. 55, FINDING VALID PUBLIC PURPOSE, DECLARING SAID PARCELS AS SURPLUS TO CITY NEEDS FOR THE PURPOSE OF GRANTING AND CONVEYING PERPETUAL EASEMENT THEREIN; PROVIDING AN EFFECTIVE DATE. WHEREAS, the State of Florida, Department of Transportation (herein "FDOT"), proposes to construct or improve State Road 55 between the CSX Railroad and S. R. 590 (herein "Project''); and, WHEREAS, the Project contemplates the transfer of property rights in certain City- owned lands to the FDOT; and, WHEREAS, FDOT has applied to the City for perpetual easement over City-owned lands titled as parcel 804.01 containing 169.8 square meters (1828 square feet), more or less, and parcel 806.01 containing 397.8 square meters (4282 square feet), more or less, S. R. 55, Section 15150-2580, for the purpose of Project construction, ingress, egress and maintenance, and the application has been duly considered by the City Commission; and, WHEREAS, Section 2.01(d)(5)(viii) of the City Charter authorizes the transfer of surplus real property to another governmental entity for less than appraised value after an advertised public hearing has been held, and a finding by the commission of a valid public purpose for the transfer; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. That the application of the DOT for the grant of perpetual easement over City-owned lands titled as parcel 804.01 containing 169.8 square meters (1828 square feet), more or less, and parcel 806.01 containing 397.8 square meters (4282 square feet), more or less, Section 15150-2580, State Road 55, is found and declared to be for a valid public purpose, and is hereby declared surplus within the meaning of the City Charter for the purpose of conveying perpetual easement therein to the FDOT for Project construction, ingress, egress and maintenance.
