02-37 3 RESOLUTION NO. 02-37 A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA, FINDING THAT THE PUBLlX SUPER MARKETS, INC. STORE #867 PROJECT BE APPROVED AS A QUALIFIED APPLICANT PURSUANT TO SECTION 288.107 FLORIDA STATUTES; AND IDENTIFYING SOURCES OF CITY OF CLEARWATER FINANCIAL SUPPORT FOR THE PROJECT WITH EQUAL PINELLAS COUNTY SUPPORT AS LOCAL PARTICIPATION IN THE BROWNFIELD REDEVELOPMENT BONUS REFUND FOR FISCAL YEAR 2002-2006; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Legislature of the State of Florida has amended 288.107, Florida Statues, Brownfield redevelopment bonus refunds effective July 1, 2002; and WHEREAS a qualified target industry business as defined in 288.106, Florida Statues, or a business that can demonstrate a completion of a fixed capital investment of at least $2 million in mixed-use business activities, including multi- unit housing, commercial, retail, and industrial in brownfield areas and which provides benefits to its employees; and WHEREAS Section 288.107, Florida Statues, states a bonus refund of up to $2,500 shall be allowed for any eligible business for each new job created in a brownfield, the amount of the refund shall be equal to 20% of the average annual wage for the jobs created; and WHEREAS, Section 288.106, Florida Statues, local 20% financial participation is optional, any applicant that exercises this option shall not be eligible for more than 80% of the total tax refunds allowed such applicant; and WHEREAS, these eighty new jobs the project will create is located in the City of Clearwater State Brownfield Designated area; and WHEREAS, the City of Clearwater finds that providing tax refunds and other tax incentives to this project is vital to the City of Clearwater citizens and ensuring the City's economic vitality; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The City of Clearwater hereby recommends Publix Super Markets, Inc. Store #867 be approved as a Brownfield Redevelopment Bonus Refund Business pursuant to Section 288.107, Florida Statutes. This recommendation is based upon the creation of the specified jobs and contingent upon the City's review of this projects final application and confirmation of the information herein. Resolution No. 02-37 Section 2. The necessary commitment of local financial support for Publix Super Markets, Inc. #867 for the Brownfield Redevelopment Bonus Refund has been identified in the amount of $40,000, consisting of 50% of the local contribution coming from Pinellas County and 50% coming from the City of Clearwater subject to annual appropriations, which will be paid to the Florida Economic Development Trust Fund as tax refunds become due with the stipulation that these funds are intended to represent the local financial support option in Section 288.106, Florida Statues and are conditional upon the applicant meeting all statutory requirements of the program. Nothing herein will prevent other jurisdictions or the private section from increasing their contributions. However, in no event will the total contribution of the City of Clearwater for this project exceed $20,000. Section 3. This resolution shall take effect immediately upon adoption.
