.
A RESOLUTION OF THE CITY OF CLEARWATER, FLORIDA,
RELATING TO THE CONSTRUCTION OF KEENE ROAD FROM
DRUID ROAD TO SUNSET POINT ROAD, PINELLAS COUNTY,
FLORIDA; DEDICATING CERTAIN LAND AS PUBLIC RIGHT OF
WAY; DECLARING CERTAIN LANDS AS SURPLUS; FINDING
PUBLIC PURPOSE; GRANTING RIGHT OF WAY INTEREST IN
CERTAIN CITY OWNED LANDS TO PINELLAS COUNTY;
CONVEYING THE CITY'S CULTURAL ARTS WORKSHOP
BUILDING TO PINELLAS COUNTY; GRANTING EASEMENT
INTEREST IN CERTAIN CITY OWNED LAND TO PINELLAS
COUNTY; GRANTING INGRESS AND EGRESS RIGHTS OVER
CERTAIN CITY OWNED LAND TO PINELLAS COUNTY;
AUTHORIZING THE CITY MANAGER TO EXECUTE CERTAIN
DOCUMENTS; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Pinellas County proposes to construct or reconstruct Keene
Road, Pinellas County Road 1, between Druid Road and Sunset Point Road
("Project") in Pinellas County, Florida; and,
WHEREAS, the City of Clearwater, Florida ("Clearwater") and Pinellas
County, Florida ("County") did enter into an Interlocal Agreement ("Agreement")
on December 28,1999 establishing the obligations of each party with respect to
the Project; including the transfer of certain real property interests from the City
to the County; and,
WHEREAS, 92.01 (d)(5), City of Clearwater Charter authorizes the City
Commission to dedicate certain city lands for right of way purposes without prior
approval by referendum; and,
WHEREAS, said 92.01(d)(5) provides that if the City Commission
determines lands dedicated for right of way purposes are no longer needed by
the City for a municipal public use, the City Commission may declare the
interests surplus and transfer them to another governmental entity after an
advertised public hearing has been held and the City Commission finds a valid
public purpose for the transfer; and,

WHEREAS, the Project contemplates the transfer of certain lands from the
City to the County; now, therefore,
BE IT RESOLVED BY THE CITY COMMISION OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. That the portion of Tract "A" of Unit 4 of SKYCREST
SUBDIVISION as legally described and depicted on Exhibit A attached hereto
and incorporated by reference herein is dedicated as public right of way.
Section 2. That lands legally described and depicted in Exhibits A, B, C,
D, E, F, G, H, J, K, L, M and N attached hereto and incorporated by reference
herein, are not needed for a municipal public purpose by the City of Clearwater
and are hereby declared as surplus.
Section 3. That the Project serves a valid public purpose.
Section 4. That the City's right of way interest in the lands described in
Exhibits A through H and depicted in Exhibit I are hereby transferred to the
County, subject only to easements and restrictions of record.
Section 5. That in consideration of payment by the County to the City of
$250,000, the receipt thereof being anticipated herein, the City hereby conveys
to the County that certain structure, commonly referred to as the City's Cultural
Arts Workshop Building located on the parcel described in Exhibit B.
Section 6. The City hereby grants to the County easement interest in
land legally described and depicted in Exhibits J, K, L, M and N attached hereto
and incorporated by reference herein, for the limited purpose of constructing,
installing, and maintaining storm water lines and facilities from time to time.
Section 7. The City hereby grants to the County, from Project
commencement through Project completion, the rights of ingress and egress
over land 10 feet in depth upon the City's lands as legally described in Exhibit 0
that run adjacent to parcels herein conveyed.
Section 8. The City Manager is granted the authority to sign such
documents that are necessary to effectuate the transfer of those rights set forth
herein.
Section 9. This resolution shall take effect immediately upon adoption.
