This is a civil rights case alleging unlawful deadly force and other claims ,in the aftermath 'of a shooting during an incident involving the SWAT team.,' We have already retained Paul Meissner, who will continue to defend Police Chief sid Klein, Lt., Frank Daly, and the city. The retention of private counsel'is authorized by section 2.035 of the new city code in cases where you determine that representation by the'city attorney would be inappropriate or that a conflict of ,interest exists requiring, private counsel. My recommendation is based 'upon the potential 'for a conflict of interest on Officer Whitacre's part which could result in the disqualification of any attorney who undertakes" to represent all of the defendants. However, I do not wish to make this sound like we are "cutting the officer loose," beCause a confliq,t of interest has not been established. The components to be demolished and rempved are as follows: A. A one story wood frame structure known as , approximately square foot. B. LEGAL DESCRIPTION: sub blk lot c. All buildings to be qemolished or removed no later than twenty (20) days after Notice of Award. 2. SCOPE OF WORK: The contractor agrees to demolish and ,remove the above-noted improvements, including any slabs or footings, all trash, building materials, ' debris and litter from the premises. Upon completic;m of demolition work, the 'contractor shall work the surface to a uniform grade, seed and mulch the entire project ,site with St. Augustine seed at least 80% and a Rye or other' quick growing seed 20% max. .3. STANDARDS: Demolition work, having commenced, shall be pursued diligently and without unreasonable interruption, with due regard to safety to limit the existence of an unsafe' condition or nuisance on the premises durin~ the period of demolition.
