Adjourn 3.. 9:06 a.m. .. fZI ' ,t AGENDA RESOLUTION NO. 92-45 A RESOLUTION OF THE CITY OF CLEARWATER,' FLORIDA, APPROVING THE PINELLAS COUNTY METROPOLITAN PLANNING ORGANIZATION MEMBERS111P REAPPORTIONMENT PLAN, AND AGREEING TO BE A MEMBER IN CONFORMANCE WITH THE PLAN AND STATUTORY REQUIREMENTS; PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 339.175, Florida Statutes, requires the Governor to review r' the ;omposition of metropolitan planning organization board membership at least every five years, and the Governor has requested that each existing metropolitan planning organization submit a membership apportionment plan by July 1, 1992; and WHEREAS, the Pinellas County Metropolitan Planning Organization has proposed a membership apportionment plan which provides for a rotating member to represent the cities of Tarpon Springs, Safety Harbor and Oldsmar, and for the appointment of a transit authority member to the board, bringing the voting membership to eleven; and WHEREAS, the proposed plan recognizes that significant growth is occurring in the areas in and around Tarpon Springs, Safety Harbor and Oldsmar, and would allow for the addition of a rotating member from those cities without requiring the addition of another county commissioner to the board; now, therefore, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The Clearwater City Commission hereby ap-??roves the Pinellas County Metropolitan Planning Organization Membership Reapportionment Plan and agrees to be a member in conformance with the plan. Boa 4748 Clearwater, Fii 34618-4748 Dear Commissioner Regulski; As you are aware, at its meeting of June 10, 199 Organization approved a Reapportionment Plan that prov.uco &VL YYYa...,.. _.._ members. This would include a rotating member who would jointly represent the cities of Tarpon Springs, Safety Harbor, and Oldsmar. The Plan also provides for the ;ppcintment of a representative from the Pinellas Suncoast Transit Authority. The MPO had previously endorsed a plan to retain the current, nine member Board. However, after public hearing on this item, during which testimony was received regarding the growth and related transportation concerns of the north County municipalities, the MPO agreed to expand the membership of the Board. Under previous State law, the addition of a municipal representative would have required the addition of another County Commissioner, as the law required that at least 33 1/3 percent of the MPO membership be County' Commissioners. Current State law allows a reduction in County Commission representation from 33 1/31. to. 25% when a transit representative is appointed to the MPO Board. ? Thus, the MP0 Plan provides for the appointment of a PSTA represdntative as a means of accommodating the north County appointment, without adding a County Commissioner. The rotating member from the north County cities, along with the PSTA representative will bring the total voting membership to eleven. Z realize your governing Board has approved a resolution endorsing the current nine member Board. However, that action is invalidated by the approval of the Plan to add the new members. A new resolution is attached for action by your governing body. We are required to submit the Plan to the Governor by July 1, 1992. Therefore, we request that you transmit the resolution to your governing body for action as soon as possible. A copy of the Reapportionment Plan containing all of the resolutions and other supporting documentation will be transmitted to you pending approval by the Governor. Michael Wright, Clearwater City Manager Pi..NHPO/35/pg. 143 PINELLAS AREA TRANSPORTATION STUDY RESOLUTION ff A RESOLUTION APPROVING A MEMBERSHIP REAPPORTIONMENT PLAN FOR THE PINELLAS COUNTY METROPOLITAN PLANNING ORGANIZATION WHEREAS, the Pinellas County Metropolitan Planning Organization was created and established by an Interlocal Agreement in August, 1977 to per- form transportation functions identified in Federal Laws Title 23 U.S.C. and 49 U.S.C.; and WHEREAS, the State Legislature enacted Florida Statutes 334.215 to define the Metropolitan Planning Organizations under State law; and WHEREAS, the referenced Interlocal Agreement was modified in 1979 pursuant to the provisions of Chapter 334.215, F.S.; and WHEREAS, Section 339.175(3)(a), Florida Statutes, requires the Governor to review the composition of the Metropolitan Planning Organization membership at least every five years; and WHEREAS, the Governor has requested that each existing MPO submit a member- ship reapportionment plan by July 1, 1992; and WHEREAS, the MPO is currently comprised of nine voting members, one each from the cities of Clearwater, Dunedin, Largo, and Pinellas Park; two from the city of St. Petersburg; and three County Commissioners; and WHEREAS, the city of Tarpon Springs is the next largest municipality eligible for membership and has proposed a rotational appointment of member- ship with Oldsmar and Safety Harbor; and WHEREAS, Chapter 339.175, F.S., was amended in 1991 to provide for a rotating member among municipal governments within the designated area that do have members on the MPO; and +, WHEREAS, Chapter 339.175, F.S., also provides that, in urbanized areas in which an authority has been created to perform public transit func- tions, said authority sball have one voting member on the MPO; and WHEREAS, the County Commission representation is reduced from 33 1/3 percent to 25 percent when a public transit representative is appointed to the KPO; and WHEREAS, the public transit representation has previously been through a County Commissioner who served in a dual capacity as the transit and County representative; and WHEREAS, the MPO recognizes that significant growth is occurring in the areas in and around Tarpon Springs, Safety Harbor, and Oldsmar; and WHEREAS, the appointment of a representative from the transit authority would allow for the addition of a rotating member from the municipalities referenced herein and would not require the addition of another County Commissioner; and WHEREAS, the XPO has approved a reapportionment plan which provides for a rotating member to represent the cities of Tarpon Springs, Safety Harbor, and Oldsmar and which provides for the appointment of a transit' authority member to the current nine member board, bringing the total voting membership to eleven. NOW, THEREFORE, BE IT RESOLVED by the Clearwater City Commission in regular session duly assembled this day of , 1992, does approve the MPO Membership Reapportionment Plan and agrees to be a member in conformance with the Plan and Statutory requirements.
