The Mayor called the meeting to order and stated the purpose of the
meeting was to discuss an issue raised by Eugene Hunt and other disability
pensioners relative to the pension plan of the City of Clearwater. Mr.
Hunt had questioned the wording on a notice that went out with the pension
oheoks that stated liThe Pension Advisory Committee's Board of Trustees
is ourrently working on reexamination physicals on an annual basis for
dlaabi11ty pensioners. You will be notified when this has been finalized
and you will be required to appear for this physical."
Ray Kaminskas, chairman of the Pension Advisory Committee, reported
the City Commission, sitting as the Board of Trustees on June 1, 1982,
authorized a disability retirement benefit study to be prepared by
Meidinger, Ino., at a cost of $8,750. The reason the notice was attached
to the form and mailed with the pension cheoks by certified mail was to
inform the retired employees of aotions being oonsidered by the Pension
Advisory Committee in response to the report prepared by the oonsultant.
It has been an annual City policy for some time to inolude a
Certification of Pension Entitlement form to be oompleted by the pensioners
and returned to the City'S Finanoe Department. This form gives muoh-needed
information as it relates to the penSioner, his dependents, and, in the
event of his death, the person to be notifi~d. The form sent this year
was altered slightly to that sent in prior years and oontains some minor
language changes in the basic questions. Inoluded for the first time were
questions pertaining to continued disability. If the reoommendation is
approved by the Board of Trustees, administrative rules would be
established for the implementation of annual physioal examinations for
individuals retired on a disability pension. after the rules are approved,
then the Pension Advisory Committee will advise the affected individuals
aooordingly, and, at that time, the affeoted individuals would be required
to take annual physical examinations. The note intended to say this and
nothing more, but inadvertently, in the first line, were the words "Board
of Trustees" who are the City Commission. The Commission at this time
had no knowledge of the aotions of the Pension Advisory Committee. To
oorreot any misunderstanding, the Pension Advisory Committee is drafting
a memo, to be sent out to all retirees with their pension oheok for the
month of February, whioh will deal with the issues and will solioit input
by the retirees.
The Pension Advisory Committee is oomposed of three City employees
who are oovered by the Pension Plan and eleoted by employees in the plan.

As a result of the study, the Pension Advisory Committee intends to
make reoommendations to the Trustees pertaining to refinements of the
language in the law as well as inclusion of language pertaining to
eligibility for pension benefits. These reoommendations would more clearly
define eligibility for benefits and the oontinued eligibility, the possible
ooordination of workmen's oompensation benefits and pension benefits, the
monitoring of payments to retirees to determine if they oontinue to be
eligible, and/or a possible ad hoo pension inorease.
Mr. Kaminskas stated it was not the intent of the Pension Advisory
Committee to reoommend to the Trustees any aotion that would take any
benefits from individuals who have retired and whose eligibility for
benefits oontinues to exist. It is however, the intent of the Pension
Advisory Committee to reoommend to the Trustees the disoontinuanoe of any
pension where any individual reoeiving the benefit is no longer entitled
to reoeive the benefit by reason that he is no longer disabled.
Disoussion then ensued on on/off-the-job disabilities and whether
both would be subject to reexamination. The Pension Advisory Committee
has not oompleted its study and at this time oannot, with all oertainty,
ennumerate all the ohanges they will reoommend. On several issues, they
have requested opinions from the City Attorney.
Bruoe Bokor, attorney, spoke for the group of disability pensioners
present and stated the letter had been sent out by certified'mail and was
a traumatio experienoe for those who reoeived it. He felt that if the
pension laws were ohanged to allow reduotions in approved pensions, the
City would find itself with un-qualified employees. He requested that
the pensioners be notified of all future Pension Advisory Committee
meetings.
Several pensioners spoke oiting a need to speed up the prooess and
questioning why, an on-the-job disability pensioner would have to be
reexamined. Mr. Kaminskas stated the report was started at the request
of other City employees who questioned why there was not a reexamination
done periodically. He reported that the Committee is also working on a
reoommendation for a oost-or-living increase for pensioners.
