Open Space Use,
The City Manager reported a question had been raised at the December
16, 1982, meeting as to the ownership of certain submerged lands in Seotion
16-29-15. By memo of December 17, 1982, addressed to the City Commission
he advised a preliminary review indicates ownership of certain submerged
lands is with the City of Clearwater and can be incorporated as an
amendment to Ordinance 82905-82.
Commissioner Calderbank moved to amend Ordinance 82905-82 to read
as follows: "That portion of Memorial Causeway, State Road 60, a 1200-foot
wide right-of-way, lying between the east abuttment of the west bridge
and east line of Clearwater Harbor and the submerged portions of Board
of Trustees of the Internal Improvement Trust Fund, Deed numbers 17500
and 17502." Motion was duly seconded.
Andy Nioholson reported for the reoord, there is a small area between
the Causeway and the land owned by the City which is probably state-owned.
Charles Finton questioned whether or not a dock on submerged land
is considered open space development. The City Attorney responded the
language "open space usage" is consistent with the aquatic land zoning.
Commissioner Berfield expressed oonoerns on the wording of "open
space."
Upon the vote being taken, Commissioners Garvey, Hatchett,
and the Mayor, voted "Ayet1; Commissioner Berfield voted "Nay."

to read in its entirety. The ordinanoe was read by title only.
Commissioner Calderbank moved to pass and adopt Ordinanoe '2905-82, as
amended, on seoond and final reading and to authorize the appropriate
offioials to exeoute same. Motion was duly seoonded. Upon roll oall the

Revooation of Oooupational Lioenses: Issued to R.W. and D.B. Enterprises
D/B/A Classio Dinner Theatre, 2086 Gulf-to-Bay Boulevard, and The Pumping
Station, 2070 Gulf-to-Bay Boulevard, pursuant to Seotions 82.05 and
71.12(a)2(ij) Code of Ordinanoes.
The City Manager read into the reoord a letter dated Deoember 16,
1982, addressed to the Commissioners at their usual plaoes of residenoe,
re revocation of oooupational lioenses held by R.W. and D. B. Enterprises,
Ino.
The City Attorney presented to the City Commission the Findings of
Faot, Conolusion and Order, whioh is attaohed for the reoord. The purpose
of the meeting was to make a deoision on this administrative matter.
Attorney Donald E. Lawhorne received a copy of the letter
(hand-delivered), but was not present at the meeting, nor were any of the
principals of the two establishments. The City Attorney presented the
dooument to the Commission and the Commission recessed from 5:40 to 5:~7
p.m. to read the document.
Commission questioned the defense attorney's referenoe to prior
restraint and violation of First Amendment rights. The City Attorney
responded the parties involved in this hearing may be called to acoount
for abusing the occupational lioenses that they hold without violating
the First Amendment. Prior Restraint refers to oonduot proteoted by the
First Amendment.
Commissioner Calderbank moved revocation of City-issued lioenses
issued to R. W. and D. B. Enterprises (Classio Dinner Theatre, 2086 Gulf
-to-Bay Boulevard, and The Pumping Station, 2070 Gulf-to-Bay Boulevard)
for violation of City Code Sections 82.05 and 11.12(a)2(ij) as speoified
in the Findings of Faot with an effeotive date of December 17, 1982, and
that the appropriate offioials be authorized to exeoute same. Motion
was duly seconded and carried unanimously.
Commissioner Garvey moved to cancel the speCial meeting set for
Deoember 23, 1982, at 5 p.m. relating to the above issue. Motion was
duly seconded and carried unanimously.
The City Manager commended the Police Chief, Lt. Richard White, and
other members of the Police Department who had taken part in this
investigation.

CONCLUSION AND ORDER
Pursuant to notice the Clearwater City Commission on December 9,
1982,
conducted an administrative hearing required by the provisions of
Section 71. 12 (a) of the Clearwater Code of Ordinances.
The purpose of
such hearing was to consider revocati on of the occupational licenses held
by R.
w.
& D.
B.
Enterprises,
lnc.
During the course of the hearing the City,
through its Chief of Police,
presented a series of Exhibits,
numbered one (1) through eight (8) and
testimony from Detective Cavaliere and Sgt.
Garrett and Sgt.
Velong.
While R.
W.
& D.
B.
Enterprises,
Inc. were represented by counsel,
no
evidence of any type was submitted on its behalf and counsel did not cross-
examine any of the witnesses submitted by the City.
The evidentiary portion of such hearing was concluded on December
9,
1982.

4. That Miriam Ruth Thigpen and Robert Freeman have been
convicted of violating the provisions of Chapter 82 of the Clearwater Code
of Ordinances. (Exhibit 5)
5. That the convictions identified in Finding of Fact Numbet:,4
involved conduct which took place at the Classic Theater and Supper Club.
6. That both the Classic Theater and Supper Club and the Pumping
Station are open to the public.
7. That Robert Freeman identified himself to Sgt. Garrett and
Sgt. Velong as the manager of both business establishments.
8. That alcoholic beverages are offered for sale at the Classic
Theater and Supper Club.
9. That both Sgt. Velong and Sgt. Garrett identified the picture
presented as Exhibit 8 as being Robert Freeman, the person who identified
himself as manager of the business establishments involved.
10. That undercover Officer Cavaliere observed performers at the
Pumping Station perform totally nude and in addition would sit on patrons1
laps for a charge of $10.00 and permit the patron to fondle their breasts
and have direct contact with their genital area.
11. That Officer Cavaliere testified and we find as a fact that the
direct contact between performer and patron described in Finding of Fact
Number 9 occurred on more than one occasion.
CONCL USION
The City Commission has jurisdiction of the parties and the
cause pursuant to Section 71. 12 (a) of the Clearwater Code of Ordinances
and Section 82.05 of the Clearwater Code of Ordinances.
Section 82.05 of the Code of Ordinances applicable to the hearing
provides:
"If the owner, operator, lessor, lessee, manager, employee or
other person participating in the operation of a commercial
cstablismnent located within the city at which food, alcoholic
beverage or food and alcoholic beverage are offered for consumption
on the premises shall be convicted of any of the offenses designated
in sections 82.02 or 82.03, then, the city shall have just cause to
revoke the city occupational license for such establishment. Revocation
shall be by the city commission which shall follow the procedure set
forth in section 71. 12. II

Section 71. l2 (a) of the Code of Ordinances also applicable to this
situation provides in pertinent part as .follows:
Subject to the notice and hearing procedure seL out in this
s cction, the city commission may revoke or suspend any
license granted pursuant to this chapter for cause, including
but not limited to the following:
II (a)
(I) The licensee maintains or allows a nuisance to be main-
tained at the licensed premises; as used in this paragraph,
the term 'nuisance' shall mean engaging in any activity or
permitting any activity or nois~ on the licensed premises
including the real properLy associated with the licensed premises.
such as repeatedly or intermittently annoys, disturbs, injures,
or tends to annoy. disturb, injure or endanger the confort,
repose, peace or safety of any person;

(Z) The licensee engages in or permits disorderly or immoral
conduct on the licensed premises;
(3) The licensee causes or permits the playing of any form of
music either by mechanical device or live p~r{ormance in
such a manner that the sound is audible beyond the property
line of the licensed premises where the music is being played
or perf armed;
(4) The licensee repeatedly violates the Code;
(5) The licensee has violated any county ordinance, state or
federal statute or rule or regulation pertaining to the activity
which has been licensed pursuant to this chapter; ***** II
Chapter 82 of the Clearwater Code of Ordinances has been declared
to be constitutional. See R. W. &: D. .B. Enterprises, Inc. v. Sid Klein,
Chief of Police, Circuit Civil No. 82-12363~7.
The facts of this administrative hearing demonstrate that the manager
and an employee or person working at the Classic Theater and Supper Club
have been convicted of violating Chapter 82 of the Code of Ordinances. Those
convictions grew out of activity which occurred at the Classic Theater and
Supper Club. (See Exhibit 5)
Section 82.'05 quoted above establishes as cause for revocation of
the occupational license. the fact that persons such as the manager and
entertainers have been convicted of violating either Section 82.02. or 82.03
of the Code of Ordinances. While the licenseholder was present at the hearing
through its attorney, no evidence to the contrary was offered. Therefore,
based on the material contained in Exhibit 5 demonstrating the conviction of

Miriam Thigpen and Robert Lee Freeman, 'it is the conclusion of this
Commission that cause has been cstablished for the revocation of the
occupational licenses held by the Classic Theater and Suppcr Club.

Exhibit 1).
With respect to the Pumping Station, the testimony of Officer
Cavaliere demonstrated quite graphically that apart from the entertainers
being totally nude, conduct on the premises occurs between the entertainers
and the patrons for a price which is immoral in character.

Officer
Cavaliere testified that he had observed such conduct on more than one
occasion and also that such conduct had continued to get worse or more
blatant.
Conduct, where patrons for a price are permitted, on the premises
of a place open to the public, to fondle the breasts of the entertainer and
have direct contact with the entertainer's genital area can be classed as
immoral and an abuse of the occupational license under which the place
of business was opened.
No testimony to the contrary was presented.
It is, therefore, the conclusion of this Commission that the licensee
of the Pumping Station does permit immoral conduct on the licensed premises.
Licensee raises only one question and that relates to prior restraint
saying that its licenses could not be revoked because to do so would violate
the First Amendment because it would act as a prior restraint on conduct
protected by that amendment.
This question has been answered by the Second District Court of
Appeals in Bay Area News, Inc. v. William Poe. 364 So. 2d 830, 83Z-833
(2nd DCA 1978) in a case which more obviously involved the First Amendment
