ITEM '6 - Citizens to be Heard re Items Not on the Agenda.
Irving Hyman, representing Village on the Green Residents, requested
traffio lights at the intersections of Belcher and Laurelwood Roads. Keith
Crawford, Traffic Engineer, responded that evaluation of the area did not
reveal a need for traffio lights.
Marion Stone, speaking for the majority of the residents at
Gardens, stated that they are opposed to the RM-20 zoning on the
of the Stowell property that borders on Tampa Bay.

Frank Morrow complimented the City on the recruits and the swearing-in
ceremony for police officers.
Ray Shilling presented a petition with seventeen signatures opposing
sidewalks on Casler Avenue.

ITEM 17 - Other Commission Action.
Commissioner Barfield questioned the status of the Pier 60 lease.
The City Manager responded that the fifteen-year lease is due to expire
in 1985, but negotiations have been underway and the lessee will terminate
in January of 1983. The City will operate. the pier and make necessary
repairs after that time.
Commissioner Berfield requested the status of the lot at
Avenue. The City Manager responded that some of the work had
and that an administrative search warrant is being requested.

Commissioner Berfield reported several calls on the sewer problem
the Kings Highway area and he questioned the mowing of the parkland in
Valencia Park. The City Manager will prOVide a report.

Commissioner Berfield questioned a need for an ordinance requiring
a birdcage or fence around swimming pools.
Commissioner Calderbank questioned a speed trap on Drew Street and
reported the north end of Mandalay Avenue is in need of paving repairs.
He noted that a citizen had requested a referendum issue on the
February election ballot to allow the citizens of Clearwater to vote on
a nuclear weapons freeze or reduction.
The Mayor questioned the status of the Classic Theatre and the
Pumping Station establishments on Gulf-to-Bay Boulevard. The Police Chief
responded that there will be a public hearing on December 9, 1982, to
consider revocation of the occupational licenses. There has been an
investigation and arrests resulting in convictions have occurred.
The Mayor questioned whether the mullet fishing/netting law is valid.
The City Attorney reported that the bill was declared unconstitutional
by the County and is under appeal. No opinion has been rendered. The
mullet fishing/netting law was a special act of the Florida Legislature.
The Mayor questioned flooding in an area north of Sunset Point Road
in the area of Yale Drive and Top-of-the-World. The Public Works
representative reported that the County and City are working together with
the County making major improvements in the area to alleviate the
situation.
Commissioner Hatohett noted the water problem reported by Lee Jones'
letter of November 11, 1982, has been resolved.
Commissioner Garvey reported that the issue to support a nuclear
freeze had been voted down by the Commission on a three-two vote. She
reported that there is more support now for a nuolear freeze and requested
that a question be placed on the ballot to allow citizens to vote. The
proposed wording for the referendum question is as follows: "Should the
President of the United States propose to the Soviet Union and to other
nations which possess nuclear weapons, a mutual and verifiable nuolear
weapons freeze, including an immediate halt in the testing. production,

Dr. James Watsonf Political Action Committee Chairman of the Upper
Pinellas Nuolear Freeze Coalitionf spoke in support of the proposed
referendum.
Frank Morrow spoke in opposition to a freeze. He supports the
premise, but does not feel it would work. It would be an impossible
situation to monitor.
Consensus of the Commission was to consider the question at a public
hearing and first ordinance reading on December 9, 1982.
Polioe Chief Klein left the meeting at 7 p.m. and was replaoed by Polloe
Officer Slack.
ITEM DB - Adjournment.
Commission adjourned at 9:58 p.m. to meet as the Community
Redevelopment Agency.
ITEM - Seleotion of Downtown Office BUilding Developer.
Three proposals have been received and and reviewed by a staff
committee. Each proposal adequately responds to the Request for Proposals.
All of the developers have the apparent present ability to carry out the
project, inclUding its financing, construction, leasing, and operation.
The proposal of J. K. Financial Corporation, the recommended developer,
would produce the largest tax increment with the lowest level of public
investment.
Sam Casella, Downtown Development Board Directorf and David Healey,
Planning Director, responded to Commission questions and supported the
reoommendation.
Commissioner Hatchett moved to authorize and direct the City Manager
to negotiatef within the next 90 daysf a development agreement with J. K.
Financial Corporation for the development of an office and retail building
and a parking garage, subject to further approval of the Community
Redevelopment Agency. MOtion was duly seconded and carried
unanimously.
The meeting adjourned at 10:33 p.m. and the City Commission reconvened.

ITEM 19 - Harn Boulevard Traffic Control.
During the past several years,the residents of Morningside,
individually and through the Morningside/Meadows Association, have
requested several changes in the traffic control along Harn Boulevard in
order to disoourage traffic whioh is not neoessary to the subdivision.
They have prOVided a variety of requests to alleviate the situation.
The City Manager reported the City is not recommending any ohanges.
Keith CraWford, Traffio Engineerf reviewed the various suggestions and
justified the City'S position.
Citizens spoke in support of reducing traffic.
Commissioner Hatchett moved to instruct the Traffic Engineer and the
City Manager to proceed to install up to four stop signs at locations
agreeable to the neighborhood representatives. MOtion was duly seconded
and carried unanimously.

The site contains 13.095 acres MOL. The developer proposes to
construct 77,515 square feet of offices within area to be zoned PS
(Professional Services) and 83,~72 square feet of commercial spaces is
proposed on the southern portion of the site which is zoned CG (General
Business).
David Healey, Planning Director, reported a modified plan has been
submitted. His concerns relate to the percentage of building coverage
and insufficient parking. The applicant responded he would work with the
Planning Director to comply with requirements.
Commissioner Calderbank moved to authorize staff to review and prooess
the final site plan. MOtion was duly seconded and carried
unanimously.

The property is used as a shopping center and contains 8.7 acres MOL.
Plans are to revitalize the existing center by renovating some of the
structures and demolishing and rebuilding other struotures on the site.
Commissioner Calderbank moved to approve the preliminary plat
subject to: 1) granting of all easements as required prior to the
reoording of the final plat; 2) the final plat be recorded within six
months from the date of City Commission approvalj 3) no separate acoess

The vacant property contains 55.95 aores MOL and is zoned RS-75
(Single-Family Residence) Distriot. The preliminary plat, approved by
the Commission on May 6, 1982, provided for 189 single family lots and
for aores to be dedicated as parkland.
Tim Johnson, attorney representing the developer, stated the
subdivision plat had been revised to decrease the number of single family
lots to 127 and to change the street system.
Commissioner Garvey moved to approve the revised preliminary
subdivision plat subject to the original oonditions of approval and the
follOWing additional conditions: 1) provision be made for the extension
of Brattle Lane along the south side of the park area and through the
subdivision to the western property line as recommended by the Resource
Development Committeej 2) the westerly end of Cloudview Drive be vacated,
suoh vaoation to be ooordinated with the City and all costs of the vacation
to be paid by U.S. Home; 3) all curbing necessitated by the closing of

Plans are to construot a 256-foot pier SO feet from the south property
line, and a 20,260-square foot, two-story multi-purpose building containing
storage areas, showers and Sleeping quarters, machine shop, office and
kitohen, on the 1.42-aores-MOL site.
Commissioner Hatchett moved to approve the community impaot statement
with addendum. MottDD was duly seoonded and carried unanimOUSly.
ITEM '11 - Revision of Truok Routes.
A truok route system for Pine lIas County was enacted into law by the
Pinellas County Commission on September 28, 1982, effeotive 60 days after
passage. The new ordinanoe reduoes the number of streets available for
truck use and changes the definition of a truck from lIover one ton
capaCity" to "a vehiole with three or more axles.1I

ITEM 112 - Applioation fo~ Retail Sales Conoession - 2119 Oulf-to-Bay
Boulevard (Marie's N. Y. Style Hot Dogs Pnnapolis).
The property is located in a General Business (CO) Zoning Distriot
which prohibits retail sales and displays in vaoant yards, temporary
parking lots, tents or struotures, exoept where speoial permit has been
prooured from the City Commission with the assuranoe that additional
parking requirements are met and aooess has been approved by the Traffio
Engineer. (Section 131.143 (11)).
By Ordinanoe '2879-82, the City Commission bogan the legal prooess
to declare a moratorium on granting any'approval for a use pursuant to
Seotion 131.143(11) of the Code o[ Ordinanoes. Required review of the
site by the Traffio Engineer is pending until direotion is reoeived
regarding this request.

ITEM '13 - Jolly Trolley.
The City Commission previously approved an agreement with the Pinellas
Suncoast Transit Authority and Clearwater Leasing Partnership for the
operation of a trolley on Clearwater Beach. The agreement expires Deoember
14, 1982. Rather than oontinuing to rent the trOlley, it is recommended
that it be purchased for $40,000. Unappropriated retained earnings of
the Parking Fund will be transferred to the General Fund for this project.
Charles Finton spoke in opposition to the purchase due to the cost
per rider.
Commissioner Garvey moved to approve purChase of the trolley and a
contract with PSTA to operate it for a period of one year. Motion was
dulY seconded and carried unanimously.
ITEM 014 - Bayfront Charter Amendment Referendum.
At the November 15, 1982, work session, a publio hearing date of
Deoember 9, 1982, was recommended to hear the Bayfront Charter Amendment
Referendum question, to be plaoed on the February ballot.
Suggestions were made to amend the draft ordinanoe to require a
referendum to be placed before the eleotorate before use of legally
desoribed public property could occur, and further, to delete the bandshell
area from the legal descriptions.
Charles Finton requested the wording be amended to allow the public,
to vote on any development of bayfront property.
Commissioner Calderbank moved to set a publio hearing date of December
9, 1982, to hear oitizen comments on the Bayfront Charter Amendment
question. ~t1OD was duly seconded and carried unanimously.
ITEM 115 - Verbal Reports.
a. Pier 60 Lease. The City Manager reported the lease will expire
in January 1983. The pier will be City-operated after that date.
b. Florida Gulf Coast Symphony - Funding Request. The City Manager
stated there are no excess funds in the budget and the extra sales tax is
coming 1n short.

ITEM 118 - A Public Hearing on Lot Clearing Violations, List 182-14.
Complaints of lots needing to be cleared have been investigated by the
Sanitation Division and owners were notified by certified mail to clear the
property within ten days or a public hearing would be held to authorize
olearance.
List '82-14 with four property owners who failed to clear their
property within the ten days was presented. City Inspeotor Albert
Brandenberger stated the lots remaining to be oleared oonstituted a menace
to public health, safety, and welfare. No oitizens spoke in objection.
Commissioner Garvey moved to authorize clearanoe of the properties
in violation of Ordinance '189~, and billing of the property owners for
costs and/or administrative charges and that the appropriate offioials be

The Zoning Code now reqUires an applicant for a zoning atlas amendment
or annexation of property other than for a single family dwelling or
property appraised in excess of $1,000,000 to submit information with the
application ooncerning the demands that will be placed on public faoilities
and services.
If determined that impact of the rezoning or annexation of an already
developed paroel or a parcel under a threshold of one aore or proposing
less than eight units does not warrant the preparation of such information,
