The City Commission of the City of Clearwater met in regular session
at the City Hall, Thursday, November 4, 1982, at 5:05 p.m., with the

The Mayor called the meeting to order. The Pledge of Allegiance was
led by Police Chief Klein. The invocation was given by the Mayor.
ITEM 03 - Introductions and Awards.

ITEM 04 - Swearing-in Ceremony - Firefighters.
The Oath of Office was administered to. four firefighters by the City
Clerk.
ITEM IS - Service Pin Awards.
Six service pins were presented to City employees including a 2S-Year
Service Pin presented to Charles Selby, Fire Department.
Employee of the Year, 1962 - Lucille Williams, City Clerk.
ITEM 16 - Minutes of the Regular Meeting of October 21, 1982, and the
SpeCial Meetings of October 18 and 25, 1982.
Commissioner Hatchett moved to approve the minutes of the regular
meeting of October 21, 1982, and the special meetings of October 18 and
25, 1982, as recorded and submitted in written summation by the Clerk to
each Commissioner. MOtion was duly seconded and carried unanimously.
ITEM 17 - Citizens to be Heard re Items Not on the Agenda.
David Healey, Planning Direotor, arrived at 5:25 p.m.
James Martin, attorney, representing the estate of Eugene Parker,
requested CG zoning be reinstated. A city-initated rezoning devalued the
property known as the Trees Motel on South Ft. Harrison Avenue. The City
Manager suggested that Attorney Martin submit an application and that the
city waive the fees.
The City Attorney recommended a staff report be prepared for the
Commission at the work session of November 15, 1982.
Officer Cindy Black replaced the Police Chief at 5:45 p.m.

Commissioner Hatohett moved to amend his motion to delete the words
"at a public hearing," and to insert "by the Commission and that
surrounding property owners who expressed oonoern be notified." Motion
was duly seoonded and carried unanimously.
Disoussion ensued on site plan review and enactment of ordinanoe
ooouring simultaneously at the December 16, 1982 meeting, providing the
site plan meets approval.
Commissioner Berfield requested ,status of drainage problem - Sunset
Point'are~t Valencia Park casement, and Bel Cheer Park area.
The City Manager reported the city and Pinellas County are working on
a solution which involves county acquisition of Bel Cheer Park and
downstream maintenance of the area.
Commissioner Berfield requested status of property looated at 1029
Iroquois Street which has constantly been 1n a state of neglect. (See

Commissioner Calderbank thanked the Publio Wo~ks Depa~tment for
removal of the dirt pile located at the Youth Maritime Center on Clearwater
Beach.
He requested an additional street light for the recreation area near
the beach tennis oourts.
He reported that a Resolution adopted by the Suncoast Chamber of
Commerce endorses and reaffirms its support of the efforts of the Pinellas
Sports Authority to locate a baseball stadium in Pinellas County and he
would like a supporting resolution from the City of Clearwater. The City
Manager will have a resolution prepared.
The Mayor reported a letter will be drafted from the Commission
to the Sand Key residents' organization expressing the Commission's
awareness of the residents' concerns.

exceed $10tOOO, to defray additional city costs of issuance.

ITEM '11 - Presidential Development Corporation/Continental Care Center,
Inc. - Industrial Development Bonds.
The Presidential Development Corporation has requested the issuance
of Industrial Revenue Bonds to finance the construction of a for-profit,
l80-unit elderlY congregate living faoility in tandem with a skilled
nursing center. Staff investigation has confirmed the existence of a need
for this facility and that the requested financing is appropriate within
applicable law.
James E. Hertz, Vice President and General Manager of Presidential
Development Corporation, said they will acquire mortgage insurance and
a commeroial market analysis. The congregate living facility would
oonsist of rental units. Tax-free finanoing will prOVide the benefit of
a lower interest rate which will be passed directly to the elderly tenant
in the form of a lower rent payment. The City assumes no legal obligation
for repayment of the bonds.
The City Manager explained that there is a gap 1n minimal care
facilities for the elderly in this area.
Tim Nicholson, Vice President of Continental Care Center, Inc., said
the nursing faoility will accept Medicare and Medicaid payments. Thore
is no provision for non-paying residents.
A representative of Golden Years Placement, Inc.t outlined the need
for these faoilities.
Resolution D82-100 - Authorizing Execution and Delivery of a Letter
of Intent and an A reernent Induoement with res ect to the Issuers Issuance
of Revenue Bonds not exceeding 9,900,000.

ITEM 012 - Zoning Atlas Amendment of an RPD-15 (Residential Planned
Deve1opement) District and Preliminary Site Plan for Drew Gardens, M&B 12-2
in the SW~ of Section 8-29-16; located at the NE intersection of Drew
Street and Fairwood Avenue (U.S. Home/Presidential Development Corporation)
PSP-82-33.
The developer plans to construct a 180-unit, three- and four-story,
adult congregate living facility and a 120-bed, one-story, nursing home
on the 14.01-acre MOL site.
The LUP classIfication is Medium Density Residential. The zoning
designation is RPD-15 established with approval of a site plan for the
Drew Street Condominiums. Approval of the Drew Gardens final site plan
would constitute an amendment to the RPD zoning designation and would void
the previously approved site plan.
The adult congregate living facility and nursing facility will operate
as separate establishments, although there will be some sharing of
recreation and food preparation facilities and services.
Commissioner Ca1derbank moved to accept the request for amendment
of an RPD and PSP, authorize staff to .review and process the final site
plan and direct the City Clerk to advertise for Public Hearing. Motion
was duly seconded and carried unanimously.
ITEM '13 - Lease of City-owned Gasoline Station, 49 Causeway Boulevard.
As a result of the latest meeting with Messrs. Hunt and Davy and their
attorney, a lease agreement was prepared with copies sent to Mr. Davy's
attorney and approval was anticipated. A letter setting forth additional
amendments was received from Mr. Davy's attorney on October 27, 1982.
The requested amendments are not considered satisfactory by staff.
Charles D. Davy stated he could not live with the lease.
Commissioner Calderbank moved to advertise for bids for leasing of
the city-owned gasoline station at 49 Causeway Boulevard (with the final
lease as minimum bid specifications.) Motion was duly seconded.
Commissioners Ca1derbank, Hatchett, Berfield and the Mayor voted "Aye";
Commissioner Garvey voted "Nay." Motion carried.
Mr. Davy will continue to operate until a new lessee is approved and
he receives notification from the City to vacate the premises.
ITEM '14 - Retail Sales and Vaoant Lots - Applications for Retail Sales
Concessions.
The properties are located in General Business (CG) Zoning Districts
which prohibit retail sales and displays in vacant yards, temporary
parking lots, tents or structures except where speCial permit has been
procured from the City Commission with the assurance that additional
parking requirements are met and access has been approved by the Traffic
Engineer. (Section 131.1l43( 11)).
By Ordinanoe '2879-82, the City Commission began the legal process
to declare a moratorium on granting any approval for a use pursuant to

Requirements, which states that "It shall conform to all zoning and
building reqUirements."

Faoility.
Commission approved, as part of the 1981 Community Development Blook
Grant Program, the construotion of a restroom faoility to serve the
Chesapeake Park ballfield. A staff committee has reviewed written requests
and heard presentations from three architectural firms. The seleotion
oommittee has recommended the following seleotion order: 1) Myers,
pliska. Ott Architects, P.A.j 2) Henderson-Ames-Bortles and Associates;
and 3) Cecil LeRew A.I.A.
In accordance with the Competitive Negotiation Act, the architects
have been selected based upon their qualifications and experienoe.
The City Manager will provide the Commission with the cost of the
faoility.

Master Agreement.
Utility Relooation
City utilities located within Florida DOT rights-of-way are subjeot
to relooation by the City if conflicts with utilities arise due to
improvements or alterations proposed by the DOT. Exeoution of a master
relocation agreement will alleviate the requirement for agreements on eaoh
DOT projeot. The City, at any time, will have the option to enter into
a detailed relooation agreement for a particular projeot. DOT required
relooation costs will be reported to the Commission through normal
proourement prooedures.

The City Manager reported that the TV 20/20 news program will have
a Scientology segment on Thursday evening, November 11, 1982.

ITEM '19 - Other Pending Matters.
a. Streetscape Maintenance Assessment.
Of eleven property owners, seven have agreed to contribute to the
annual maintenanoe cost of the sidewalk landscaping project in the ~OO ,
Blook of Cleveland Street. In order to fairly'apportion this maintenance
cost, it is suggested that prOVision for establishing a special assessment
for maintenance be incorporated into the Clearwater Code of Ordinanoes.
This provision would also apply to future blocks and areas.
Commissioner Hatchett moved to direct the appropriate officials
to proceed to develop a special assessment program, providing for the oost
of on-going maintenaoe of sidewalk landscaping. Motion was duly

ITEM 121 - A Public Hearing on Lot Clearing Violations, List n82-13
Complaints of lots needing to be cleared have been investigated by the
Sanitation Division and owners were notified by certified mail to olear the
property within ten days or a public hearing would be held to authorize
clearance.
List '13 with six property owners who failed to clear their property
within the ten days was presented. City Inspector James Maglio stated the
lots remaining to be cleared constituted a menace to public health, safety,'
and welfare.
City Inspeotor Albert Brandenburger presented photographs and spoke
to the property located at 1029 Iroquois Street, which the city cannot get
access to clear, The front portion will be cleared in a week.
The City Attorney stated the City could request an administrative
warrant to enter the property and the City Manager will proceed.
Three citizens requested action be taken to clear 606-606! Belleview
Boulevard.
Commissioner Garvey moved to authorize clearance of the properties
in violation of Ordinance n189~, and billing of the property owners for
costs and/or administrative charges and that the appropriate officials be
authorized to execute same, Commissioner,Calderbank seconded the motion
citing safety and health reasons. Motion oarried unanimously.
ITEM '22 - Oooupational License Request - Pelican World Air Corporation.
On September 9, 1982, Howard Knapp, President of Pelioan World Air
Corporation, applied for an occupational license for an air taxi service
operating from Clearwater Bay Marine Ways, Ino. This application has been
reviewed by the Marine Advisory Board and the Airport Authority and both
bodies have reoommended approval with conditions. The oity may not prohibit
the aotual landings and takeoffs of the plane unless the business proves
to be a nuisance or a hazard'in which case there is provision in the oode
for revooation.
Howard E. Knapp, President of Pelican World Air Corporation, stated
his request is to operate within the City of Clearwater, not from the
Clearwate~ Executive Air Park. He has aoquired the Fire Marshal's approval
for a gas tank on a land area and would not reqUire any services from
Clearater Exeoutive Air Park. He requests a license 50 he can sell tickets
for the plane to make one trip in and out per day.

The rooms became available when the lease for Jack Ransom Realty
expired on September 30, 1982, and was not renewed.
Commissioner Garvey moved that rooms Band 20, located in the
Clearwater Marina bUilding, be declared surplus to City of Clearwater needs
at this time and be advertised for oompetitive bids for a five-year lease
with bids to be evaluated and awarded by the City Commission on the basis
of oompatibility with marina functions and not necessarily on the basis
of highest monetary return and that the appropriate offioials be authorized
to exeoute same. Commissioners Garvey, Hatchett, Berfield and the Mayor
voted "Aye"; Commissioner Calderbank voted "Nay." HotiOll carried.
ITEM 124 - Resolution '82-101. Assessement - Tulane Avenue Paving, Drew
Street N 400-feet, plus or minus.
After a March 3, 1982, pUblic hearing, the project was awarded on June
3, 1982, to R. E. Purcell Construotion Company for the low bid of
$15,083.50, and it was completed at a total oost of $14,352.65. The Cityrs
share is $7,028.90 and the assessable cost is $7,323.75. The assessment
project was grandfathered 1n at a cost of $27 per assessable front foot.
Commissioner Calderbank moved to pass and adopt Resolution 182-101
and to authorize the appropriate officials to execute same. Motion was
duly seconded.
There were no citizen comments.
