ITEM 14 Resolution 182-68 Thanking Mr. and Mrs. Timothy A. Johnson for
their generous contribution to the Coaohman Park Bandshell Project.
The intent of the City Commission is to name the bandshell "The
Charles Wharton Johnson Pavilion," in honor of Mr. Johnson's grandfather,
a Clearwater pioneer who homesteaded here in 1672.
Commissioner Garvey moved to pass and adopt Resolution #82-88 and to
authorize the appropriate offioials to exeoute same. Motion was duly
seoonded. Upon roll call the vote was:
"Ayes": Garvey, Calderbank, Hatohett, Berfield and LeCher.
"Nays": None.
The City Manager announced the bandshell designs are on display in the
Main Library.
ITEM 15 - Servioe Pin Awards.
Twelve service pins were presented to City employees.

Commissioner Hatohett moved to approve the minutes of the regular

Commissioner Hatohett moved to approve the use of the bandstand with
esoort to ooordinate the move with the Parks and Reoreation Department
and to waive the fee. Motion was duly seoonded. Commissioners Hatchett,
Calderbank and the Mayor voted "Aye"; Commissioners Garvey and Berfield
voted "Nay." Motion oarrled.

Marilyn Cleary of the Gulf Beaches Safety Committee reported a
petition had been presented requesting a building moratorium on Sand Key
as it would be diffioult to leave the beaohes during an emergency. The
City Manager stated a moratorium oannot be declared unless an aotual
emergenoy exists and a specific time frame is referenced. The City
Attorney stated an ordinanoe declaring a moratorium must also indicate
a solution.
Terry Jennings, Public Works, suggested education and early warnings
would be an effective way to deal with the situation.
Theresa Mortham, representing the Harbor Condominium Association,
protested comments made by David Healey regarding the Belleview Biltmore
Cabana project. David Healey, Planning Director, responded that the
project meets Code.
Jeanne Pisano of U.S. Recording Industries requested $5,000 for the
Music Performanoes Trust Fund.

Col. Frank Morrow expressed conoerns about evaouation from the
beaches and suggested the City contact the federal government for aid.
Tom Miller requested the status of trash oans for the north beach
area and protested eviction of many beoause of aotions of a few unruly
youths.
Anne Garris reported a six-year old pile of dirt at the Youth
Maritime Center.
Police Chief Klein was replaced by Officer G. D. Colton at 6:~5 p.m.
ITEM 18 - Other Commission Action.
Commissioner Garvey requested an item be placed on the agenda for
Ootober 21, 1982, re oonsidering removal of the traffic light at Belcher
Road and Harn Boulevard and installation of stop signs.
Commissioner Calderbank reported Dizzy Gillespie will be this year's
headliner for Jazz Holiday, and there will be a free concert October 29,
1982. He requested an item on the next work session agenda to discuss
contacting the Department of Natural Resources re controlling development
on the waterfront. He, brought to the Commission's attention that the new
Restaurante Europea has improved downtown.
Commissioner Berfield queried whether Plas-Tec Industries had taken
advantage of the City. The City Manager stated flammable material was
stored there for some time before it oame to the attention of the City.
The City Attorney reported the City acted quickly in the matter.
Commissioner Berfield requested that the proposed BUdget Review Board be
plaoed on the next agenda.

ITEM '13 - fleview of City Code Aequirements Pertaining to Taxioabs and
Public Conveyanoes.

The language of the Code setting forth the various requirements
regarding taxicabs and publio oonveyances needs to be revised. The
requirements and an increase or deorease in oontrol of the industry should
be addressed.
Commissioner Garvey moved to instruot the City Manager to review
Chapter 61 - Taxioabs, and 62 - Publio Conveyanoes, of the City Code and
to prepare a reoommendation for the Commission. Hattan was duly seoonded
and oarr1ed unanimously.
ITEM 114 - Aequest by Clearwater Beach Taxi, Ino., for 17 Additional
Taxioab Permits.
Allen Weatherilt, President and Seoretary of Clearwater Beaoh Taxi,
Ino., d/b/a Beaoh Taxi, 28 Papaya Street, has requested the additional
permits so he can operate oity-wide. Currently he holds eight permits
for service to Clearwater Beach only. Beoause of the number of permits
requested, it is reoommended that a publio hearing date be set in order
to formalize the investigation which Section 61.22 of the City Code
requires.
Commissioner Garvey moved to set Ootober 21, 1982, for a publio
hearing oonoerning the request of Clearwater Beach Taxi, Ino. Motion
was duly seoonded and oarried unanimously.
ITEM '15 - Verbal Reports.
The City Manager reported a Chamber of Commeroe Christmas Parade on
November 30 at 6:30 p.m.
The Commission has been invited to partioipate in a softball game
to benefit Timmy Lane on Friday, Ootober 15.
He reported the dirt pile at Belcher and Druid Roads has been leveled
to an acceptable height.
A memo from the City Attorney re moratorium on speoial permits stated
the procedures for adoption of an ordinance must follow the same
advertising requirements as a zoning ordinance.
Controls have been established for the Glen Oaks Golf Course inventory
problem. Commissioner Calderbank requested expenditure report.

ITEM U18 - A Public Hearing on Lot Clearing Violations, List #82-11.
Complaint of a lot needing to be cleared has been investigated by
the Sanitation Division and the owner was notified by certified mail to
clear the property within ten days or a public hearing would be held to
authorize clearance.
List Ull with one property owner who failed to clear 'their property
within the ten days was presented. City Inspector Albert Brandenberger
stated the lot remaining to be cleared constituted a menace to public
health. safety, and welfare. No citizens spoke in objection.
Commissioner Garvey moved to authorize clearance of the property in
violation of Ordinance 1189~, and billing of the property owner for costs
and/or administrative charges and that the appropriate officials be

ITEM #23 - Petition for Annexation, FD 01, PS (PrOfessional Services)
Distrct Zoning and a Land Use Plan Amendment from Low Density Residential
to Residential/Office for Parcel 1 and CO (General Business) Distriot
Zoning and a Land Use Plan Amendment from Low Density Residential to
Commercial/Tourist Faoilities for Parcel 2, a Portion of M&B 24 in the
SWn of Section 23-29-15; located at the SE corner of Highland Avenue and
Nursery Road and runs to the N side of Belleair Road (Whitson) A-82-13,
LUP-82-64.
Plans are to develop the property with commeroial and professional
office uses.
David Healey, Planning Director, reported concerns about the impact
this commercial development would have on the residential area, however,
a smaller Shopping center could be beneficial. The City's Land Use Plan
indicates low density residential for the property. P.S. (Professional
Services) zoning allows ~OO square feet of commercial use as a special
exception.
George Greer, representing the applicant, requested that the
application be approved as submitted. He presented a letter from Frank
Mudano, the arohitect, regarding the development and what impact it would
have. Edmund S. Whitson, Jr., the applioant, said the shopping center
would be set back from the road and landscaped with one driveway on
Highland. The application has been amended to reduce commercial.
Charles Cope, representing owners of property to the east, stated
oonoerns regarding commercial and professional development and the effect
on the scenic oorridor (Belleair Road). They would not object to a planned
development.
Four oitizens, mostly county residents, spoke in objection to the
proposed annexation.
Mr. Healey said it would take apprOXimately five months for the entire
annexation process after the application has been resubmitted.

the Commission and that surrounding property owners who expressed concern

Requirements, Seotion 131.214 and 131.215 to ClarifY the Term "Change of
Land Use" and the Requirements for Parking with Certain Land Use Changes
(City) .
This text change has been prepared at the direotion of the City
Commission beoause there was no olear definition 1n the Code as to the
meaning of "ohange of land use." Interpretation beoomes partioularly
oritioal when applying off-street parking requirements to a piece of
property whose partioular land use is undergoing a change.
Commissioner Calderbank moved to appro~e the text ohange and to
direot the City Attorney to inolude in an ordinanoe. There were no citizen
comments. Motion was duly seconded and carried unanimously.
ITEM 127 - Beach Drive Property in Clearwater Beaoh Park Subdivision in
Section 8-29-15.
The City Commission on September 2, 1982, direoted staff to advertise
for public hearing oonsideration of whether the aoquisition of the Beach
Drive property is so important as to require oondemnation aotion. It is
neoessary to acquire the property, whioh is estimated to be worth $30,000,
in order to provide full and oomplete public use of and access to the beach
areas.
Andy Nioholson, Oceanographer, desoribed the property as the lots
located westward of the Clearwater Beaoh Park Subdivision lots and consists
of approximately five aCres. Ownership has not been determined.
Thirteen oitizens spoke in support of acquisition and a petition in
support of acquisition with 20 signatures was presented.
J. H. Fletoher suggested staff meet with him and other adjaoent
property owners to negotiate transfer of the property to the City.
Four citizens spoke against the aquisition.
Commissioner Garvey moved it is in the best interest of the public
to aoquire the beach property and all riparian rights, and to direct staff
to return to the Commission with a recommendation after meeting with the
property owners. MOtion was duly seconded and carried unanimously.
