The Mayor called the meeting to order. The Pledge of Allegiance was
led by Police Chief Klein. The invocation was given by the Reverend Dr.
J. Jey Diefell, Jr., Trinity Presbyterian Church.
ITEM 13 - Introductions and Awards.

ITEM IS - Minutes of the Regular Meeting of August 5. 1982, and the
Special Meeting of August 2. 1982.
Commissioner Hatchett moved to approve the minutes of the regular
meeting of August 5, 1962, and the speoial meeting of August 2, 1982,
as recorded and submitted in written summation by the Clerk to each
Commissioner. Motion was duly seconded and carried unanimously.
Officer C. C. Kimball replaced Chief Klein at 5:25 p.m.
ITEM 16 - Citizens to be Heard re Items Not on the Agenda.
Richard L. Stewart, a contractor, requested the status of
ocoupational licensees' who use a post office box as their address. The
City Manager responded an ordinance text change is under consideration
to allow small businessmen to register their home address instead of a
post office box and continue to operate.
ITEM 17 - Other Commission Action.
The Mayor spoke in support of a building moratorium on Sand Key
and the City's inability to implement such action. Discussion ensued on
the cost and need to widen roads in the area.
Commissioner Calderbank requested that the City pursue State and
Federal support to control development on Sand Key in the undeveloped area
by not allowing subsidies for flood insurance or other activities. The
City Manager reported that water and sewer service to the area is
adequate. The City shares the concerns of the oitizens and supports
reasonable growth. The beach renourishment program will help to control
water surge in the event of a stOMm.

John Richter, Chief Planner, reported the revised site plan inoluded
the ohange from an apartment to a motel, and density is the issue. A
sleeping room is oonsidered a unit, therefore suites are considered two
units and the proposed 16 suites in the south wing are considered 32
units.
Roy Ayres, Building Director, reported an inspeotion revealed there
are no ohanges that are not shown on the plan. The apartments could be
converted to additional units by opening and closing doors and looks could
be installed or do~rs hung to create privacy. The Building Direotor stated
he had approved a plan for 35 apartment units.
Mr. MoFarland noted that the initial request was for 35
convertible to ~8 motel units and the plan had been modified

Definitions, to Amend Section 131.106(h)(17) Board of Adjustment and Appeal
on Zoning, and to Add a New Section 131.2057, Home Occupations to Expand

The Zoning Code presentlY limits a home occupation to an occupation,

!TEM 110 - Site Plan Amendment - Clear Ba Terrace a ortion of M&B 12
in the SE of Seotion 3-29-15j located on the W side of Batty Lane at
the NW intersection of Sandy Lane and S of Sunset Point Road (Clearwater
Volunteers of America Elderly Housing, Inc.) PSP-62-9.
The site plan was approved in March 1982 subject to seven conditions.
Condition No. II states, "Construction of Betty Lane by HUD and accepted
by the City prior to the issuance of building permits." The condition
is erroneous on two counts: first, the construction of Betty Lane will be
accomplished by the Volunteers of America, Inc. (VOA) with financial
assistance from the City; and second, the witholding of bUilding permits
pending road construction is punitive and unusual.
Commissioner Calderbank moved to amend Condition No. II as follows:

ITEM III - C.D.B.G. - Volunteers of America Housing Project west of Betty
Lane and south of Sunset Point Road.
The Commission had approved an allocation
of $81,000 to provide
support for VOA in the development of assisted housing for the elderly
in the form of off-site street, sewer, and water improvements. The
Clearwater Housing Authority is also developing an assisted family housing
development project directly to the north of the VOA project. The
City and the Authority have entered into an agreement for the design and
construction of the eight-inoh water line at a cost not to exceed $17,000.

He reported the Nursery Road sidewalk has been completed and the City
did the best job possible on the existing right-of-way. Within the next
year, the County is expected to fill in the ditoh, and at that time the

ITEM 153 - Acceptance of Deeds, Easements, and Restrictions.
The City Attorney presented the following easements:
a. Two easements for utilities and right-of-way for U.S. 19 in the
SEq of ~ection 19-29-16 (LeCher).
b. Easement from the City of Clearwater to Florida Power Corporation
for cable on Sand Key in Section 17-29-15. (Replacing easement
accepted 11/19/81)
Commissioner Calderbank moved that the easements, as outlined by the
City Attorney, be accepted in Section 19-29-16 and to grant easement in
Section 17-29-15 and that the City Clerk be directed to record same in
the Publio Records of Pinellas County, Florida. Motion was duly seconded
and carried unanimously.
ITEM - Payment re Sub pone as - Cazares/Church of Scientology Suit.
Commissioner Calderbank moved to approve payment of $229 to Attorney
Chanfrau of Daytona Beach re the Cazares law suit. Motion was duly
seconded and carried unanimously.
ITEM - Code Enforcement Board Counsel.
The City Attorney announced that Elizabeth Daniels would act as
counsel for the Code Enforcement Board beginning with the meeting of
September 2, 1982.
The City Attorney stated an accusation had been made at this meeting
regarding a Charter violation. He advised the Commission that their
interpretation and applioation of the charter was part of the decision
making prooess required of them and was not tantamount to a orime.
