Commissioner Garvey moved to amend the minutes of the regular meeting
of July 15, 19821 page 4, ITEM '16 "Other Pending Matters" a. Millage Rate
for Fisoal Year 1982/83 to record the vote as follows: Commissioners
Hatohett, Berfield, Calderbank and the Mayor voted "aye"; Commissioner
Garvey votod "Nay". Motion oarried. tIotlaa was duly seoonded and

Commission disoussion ensued on Commissioner Calderbank's request

ITEM '6 - Citizens to be Heard re Items Not on the Agenda.
Herb Donald oommended the Planning and Zoning Board and the Commission
for their prior aotion in support of a "Share a Home" projeot whioh is
in existenoe and working well. He also spoke in support of Congregate
Living Faoilities in genoral.
Ann Garris spoke in support of oontinued leasing of the Shell Gasoline
Service Station on Beaoh Causeway to the present interim lessee. The
oonsensus of the Commission was in support and the City Manager noted that
although the Commission oould legally decide not to go out for bid it was
polioy to do so on long term leases. He also stated he would negotiate
with the interim lessee and report baok to the Commission.
ITEM #7 - Other Commission Aotion.
Commissioner Garvey requested olarifioation of Commissioner Berfield's
proposal to out the budget. He stated his intent was to provide a zero
inorease in the general operating fund only with the exoeption of the
Polioe and Fire Departments whioh were to remain as they have been
projeoted for 1982/83. These two departments constitute 43J of the General
Fund monies.
Commissioner Hatchett requested a status report on
the new VASI (Visual Approach Slope Indioator) System.

Soientology Hearings whioh has just been reoeived at City Hall. Attorney
Flynn is still reviewing the transcript and will make a recommendation
in approximately four weeks.
Commissioner Berfield requested the status of the Airpark litigation,
and expressed conoerns about the future of Clearwater.

ITEM 19 - Advisory Commitee for Information Center
Johnson Faoility.
The proposed Howard Johnson Faoility on Clearwater Beaoh will inolude
an information oenter and letters were sent to groups and assooiation~
on the beaoh requesting their reoommendation of individual~ to serve on

ITEM 10 - Resolution 182-65 - Amending Resolution 181-53 to inorease the
oalendar year Non-Resident fee.
Commissioner Hatohett moved to pass and adopt Resolution 182-65 and to
authorize the appropriate offioials to exeoute same. Motion was duly

ITEM 111 - Parks and Reoreation Fees - Glen Oaks Golf Course.
The recommended fee inoreases are in line with fees oharged at other
public golf courses of comparable size. These inoreases coupled with other
oharges, will aid in balanoing the budget at Glen Oaks.
The City Manager reported he had several alternative proposals to
present to the Commission: (1) to transfer the Glen Oaks golf course from
the Enterprise Fund to the General Operating Fund; and (2) to provide a
disoount for Senior Citizens across the board. This would require removing
unlimited play by the club memberShip and allow all senior citizens of
the city to play at a reduced flat fee which is proposed to be $3.00 year-
round. Two citizens spoke in opposition to eliminating the memberships
and the inorease in fees. Concern was also expressed on the condition
of the course.
Commissioner Garvey moved to approve the inorease in the Greens Feesj
to implement a $3.00 year-round discount Greens Fee for City of Clearwater
Senior Citizens over 65; that the Club membership be oontinued but that
no membership fees be assessed when the current cards expirej to budget
Glen Oaks as a General Fund reoreation activity but aocounted for as an
Enterprise Fund aotivity; and to authorize the City Manager or his designee
to establish and adjust Greens Fee rates during the year. Motion was
duly seconded and upon the vote being taken, carried unanimously.
ITEM #12 - Parks and Reoreation Fees.
Fees charged by the Parks and Recreation Department are for general
reoreation programs and activities and are reviewed each year for
increases. The recommendation is to increase the Street Tree fee from
$35 to $~O per tree. Recreation fees capture much of the cost of
recreation programs but the Department has requested the City Manager have
the authority to adjust program fees.
Commissioner Garvey moved to increase the Street Tree Program Fee
to be effective October 1, 1982 and to authorize the City Manager or his
designee to establish and adjust all fees oonnected with Parks and
Recreation Programing including golf memberShip fees. Hotiaa was duly
seconded and carried unanimoulsy.

of Seotion 12-29-15 Pinellas Groves; looated NE and abutting the Clearwater
Executive Airpark.
This lease commits the City to a payment of $72,000 over three years
with the option to purohase the property for $600,000, to extend the lease
for $42,000 per year for another three years, or to allow the lease to
expire and to vacate the property. A review appraisal places tllC value at
$525,000 to $550,000. The property would be used for .expansion of the
City Garage.
Commissioner Garvey moved to approve the lease agreement with J &
J Properties and that the appropriate officials be authorized to exeoute

ITEM '22 - A Publio Hearing on Lot Clearing Violations. Lint '82-7. .
Complaints of lots needing to be cleared have been investigated by
the Sanitation Division and owners were notified by oertified mail to olear
the property within ten days or a public hearing would be held to authorize
olearanoe. List'7 with three (3) property owners who failed to olear
their properties within the ten days was presented.
City Inspeotor James Maglio stated the lots remaining to be oleared
oonstituted a menaoe to PUbli~ health. safety, and welfare. No oitizens

The "Final Statement. of Community Development Objeotives and Projeoted
Use of Funds" was prepared and reviewed by the Neighborhood Advisory
Committee who have reoommended approval.

ITEM 126
Redevelopment Trust Fund Ordinance.
Funds earmarked for the redevelopment of Downtown Clearwater may begin
to accrue to the Community Redevelopment Agency with the adoption of this
ordinanoe and will come from increased city and oounty tax receipts
oolleoted in the redevelopment area. They will be administered by the
City Commission sitting as the Community Redevelopment Agency.
The Ordinance outlines the projects on which the funds are to be
expended and include beautifioation, parking, and traffic improvements
which are consistent with the adopted redevelopment plan for Downtown
Clearwater.
Principal revisions were made to the projected tax base and tax
increment revenues based on information not previously available for both
the taxable value and estimated millage rates for the 82/83 budget year
as well as an adjustment to the tax base to recognize those owner oooupied
residenoes in the downtown area which do not pay the one-mill downtown
tax levy but whose value will be included in the measure of tax increment.

The City Attorney reported in the City vs. Cose Belle Company Ino.
litigation, Judge Fogle has indioated the City did not have the authority
to impose the two year oonstruotion limit on the site plan of the Cose
Bell predeoessor and that the two year oondition is outside the soope of
the then existing power of the City.
In the City VB. Earle Case the rUling of the Trial Court waB appealed
and the Court of Appeals reversed the deoision and found in the City's
favor that the City did not inversely condemn the property.
