The City Commission of the City of Clearwater met in regular session

ITEM 18 - Citizens to be Heard re Items Not on the Agenda.
Stacy Hammond, an intern in the BUdget Offioe, expressed
appreoiation to the Commission for the opportunity to work for the City.
Adam Midura, representing both the Tropic Hills and Japanese
Gardens Homeownersl Assooiations, requested a timed traffic signal on U.S.
19 at their interseotion and he presented a petition of support with 679
signatures.

Commissioner Garvey requested that a woman be appointed, as the
board is predominantly male.
Upon the vote being taken, Commissioners Hatohett, Berfield,
Calderbank and the Mayor voted "Aye"j Commissioner Garvey voted "Nay."

ITEM 111 - Request from the Society of St. Vinoent de Paul to Waive Rental
Fees at the City Hall Annex Auditorium for a Banquet to Benefit the Soup
Kitohen.
The Sooiety of St. Vincent de Paul will hold a banquet at City Hall
Annex Auditorium to raise funds to defray financial requirements for the
Soup Kitohen. The total fees requested to be waived approximate $116.
Commissioner Calderbank moved to waive the rental fees for a banquet
to be held October 1, 1982. Motion was duly seconded. Upon the vote being
taken, Commissioners Garvey, Berfield, Calderbank and the Mayor voted
"Aye" Commissioner Hatchett voted "Nay." Matioa carried.
ITEM 112 - Resolution '82-57
Applioation.
Community Servioes Trust Fund Grant
Funds have been appropriated by the Florida Legislature to be made
available to local governments for human service programs and applications
must be filed by August 1 for the program year beginning October 1, 1982.
The City applioation will fund three agenoies and ~'ill matoh the requested
grant of $8,~33. Religious Community Services would be funded for $6,000;
Quest Inn, $866; and Neighborly Senior Services, Ino., $10,000.
Commissioner Garvey moved to pass and adopt Resolution #82-57 and to
authorize the appropriate officials to execute same. Motion was duly
seoonded. Upon roll call the vote was:
"Ayes": Garvey, Calderbank, Hatohett, Berfield and LeCher.
"Nays": None.
ITEM 113 - Howard Johnson Company. Ino. - License Agreement.
The existing license agreement with the Howard Johnson Company, Inc.
expires July 21, 1982, and the company has advised that they will not go
forward with their proposal to oonvert the restaurant as approved by the
City Commission.
The City Manager reported that he met with the representatives on this
date and that they oannot continue the renovation unless their investment
oan be reduced by $50,000. They have requested that the City assume
landscaping responsibility and that the information center requirement be
eliminated.
Commissioner Garvey moved to authorize an extension of the existing
lioense agreement between the City of Clearwater and the Howard Johnson
Company, Inc. for a period of time determined by the City Manager as
appropriate, but not to extend beyond ~eptember 30, 1982; authorization to
negotiate with the second bidderj authorization to proceed to bid if the
problem is not solved; and that the appropriate officials be authorized to
exeoute same. Motion was duly seconded.
The City Manager reported that another restaurant is interested in the
site.
Upon the vote being taken, ~t1OD carried unanimously.
ITEM 11~ - Resolution 182-58 - Housing Mortgage Revenue Bonds.
Housing Mortgage Revenue Bonds will provide affordable housing to
persons who oould not otherwise afford it; will proteot and enhanoe the
real estate, housing and construction related industries in the ourrent
diffioult economic environment; and stimulate the redevelopment of
deolining neighborhoods.

ITEM 115 - Verbal Reports.
Request for Removal of a Condition of Approval of the Site Plan for
Fat Boy's Bar-B-Q Restaurant, Tract B, Master Subdivision in the HE! of
Seotion 31-26-16; located on the west side of U.S. Highway 19,
approximately 190 feet south of Enterprise Road (Freedom Investments, Ino.)
PSP-B2-2.
The property is ourrently vacant with the exoeption of a billboard.
The site plan was approved in February 19B2 with four oonditions.
Condition number 1 stated, "Existing billboard on the site be removed prior
to issuanoe of building permit and no permit be issued for replaoement or
other billboard on subject parcel." The applicant has requested that this
condition be removed.
George Greer, attorney for the applicant, stated that the owner is
dependent on the sign revenue and has requested removal of the condition to
allow future consideration of a larger sign.
Commissioner Hatohett moved to approve the request and that a modified
site plan be submitted at the administrative level for approval. Motion
was duly seconded. Upon the vote being taken, Commissioners Hatohett,
Calderbank and the Mayor voted "Aye"; Commissioners Garvey and Berfield

a. Millage Rate for Fiscal Year 1982/63.
The additional one-cent sales tax will provide a revenue of
approximately $2 million to the City. This revenue has been used to reduoe
property taxes approximately ten percent and the proposed budget reoommends
a millage rate of 4.059B.
Commissioner Calderbank moved to adopt a millage rate of 4.0598 for
fiscal year 1982/83, and that the appropriate officials be authorized to
execute same. Motion was duly seconded. Commissioners Garvey and
Berfield expressed concerns and reservations about adopting a millage rate
before seeing the budget.
The City Manager reported that an innovative approach will be used to
finance the Polioe sub-station. Upon the vote being taken,
~tlaa carried unanimously.
b. BOO L.F. of Dredge Pipe - Empire Pipe and Supply Company, Tampa
$11.01 per linear foot for a total prices of $B,808 delivered F.D.B.

Commissioner Garvey moved to approve the establishment of an
admission fee for Moooasin Lake Nature Park (25~ for ohildren under 12 and
50~ for adults); to authorize the establishment of three new permanent
part-time Reoreation Aide II positions serve as oashiers; that oonsensus of
the Commission was not to oharge oivio groups; and that the appropriate

e. Application for a Hetail Sales Conoession (Hot Dog Stand) at
409 Mandalay Avenue (Foroella).
The applicant has oontracted for an agreement of lease with the owner
of a vaoant lot looated at 409 Mandalay Avenue on Clearwater Beaoh. The
applicant requires a speCial permit whioh may be granted by the City
Commission. The applioant will remove the wagon from the site eaoh evening
at the close of business and there will be no construotion or building at
the site.
Commissioner Hatchett moved to approve the request of John A. Foroella
Motion was duly seoonded. Commissioner Hatohett moved to amend
his motion to add that the applioation would be reviewed in 60 days and
that the speoial permit will be withdrawn if the applicant oreates a
nuisanoe by littering. The amendment was duly aooepted.
The City Attorney reoommended that the City Commission be speoifio as
to type of conditions and the site in the motion.
Commissioner Hatohett moved to further amend and to clarify his motion
from 60 to 90 days, with the special oondition of not oreating a nuisanoe,
effective at the time of issuanoe of a permit for the specifio site at 409
Mandalay Avenue. The amended motion was aocepted. Upon the vote being
taken, Commissioners Hatchett, Calderbank, Berfield, and the Mayor voted

ITEM "8 - A Publio Hearing on Lot Clearing Violations, List 182-6
A complaint of a lot needing to be oleared has been investigated by the
Sanitation Division and the owner was notified by certified mail to olear
the property within ten days or a publio hearing would be held to authorize
olearanoe.
List 182-6 with one property owner who failed to olear the property
within the ten days was presented.
City Inspeotor James Maglio stated the lot remaining to be oleared
oonstituted a menaoe to public health, safety, and welfare.
No citizens spoke in objeotion.
Commissioner Garvey moved to authorize clearance of the property in
violation of Ordinanoe 11894, and billing of the property owner for oosts

Statement and Addendeum for the Metro Gulf-to-Bay development subjeot to
the following oonditions: (1) The expanded satisfaotory analysis of
drainage, environmental, eoonomic and transportation faotors in the
Development of Regional Impaot (DRI) prooess; and (2) The following maximum
floor area ratios be established as initial guidelines for development of
the property, subjeot to being revised by the City Commission as (i)
additional information relating to impaots and proposed uses becomes
available through the DRI prooess and (ii) there is further delineation of
on-site relationships between building size and looation, impermeable
surfaoe coverage and open space through an authorized site plan review

The Planning Direotor reported that the AL zoning enoompasses a
portion of Paroel B and a small part of Paroel Do
Ell! Mills, developer, stated he did not feel the AL zoning was a
major problem. A physical inspeotion will be made to determine the AL
portion.
Citizens have expressed oonoerns on the buffer between the project and
their residential area. This will be addressed at site plan review.
Marshall Harris stated an adequate buffer was imperative.

ITEM 128 - Coastal Zone Management Element, Clearwater Comprehensive
~.
The element proVides goals and objeotives to gUide publio and private
investment. Speoifio recommendations are provided on a neighborhood by
neighborhood basis as a result of an analysis of funotional, environmental
and urban design oharaoteristios. It reoognizes the inherent oonflict
between urban and environmental interests, but it is a mandatory element
and when adopted, will be a part of the City's Comprehensive Plan.
Commissioner Hatchett moved to approve the Coastal Zone Management
Element and to direct the City Attorney to include in an ordinance. Motion
was duly seoonded.
The City Manager stated he would have a report to the Commission on
the reoent erosion problem on Clearwater Beaoh.

ITEM 129 - Zoning Ordinance Text Change to Chapter 131 Zoning, Artiole III
Distriot Regulations, Division 13 CTF-24 Commeroial-Tourist Faoilities Use
District, Seotion 131.090 General Description to Modify the Requirement of
a Minimum Parcel Size for Creation of a CTF-2~ Distriot (City).
Currently, the Code requires that a new CTF-2~ district must contain
four acres. The Commission direoted staff to apply for a ohange to the
Zoning Code, providing an opportunity to create a CTF-2~ district with less
than four acres, when justified.
Commissioner Calderbank moved to approve the text change and to direot
the City Attorney to inolude in an ordinance. MotlOD was duly seoonded
and carried unanimously.

ITEM 116 f. - Zoning Ordinance Text Change - Home Occupations.
Currently, the Zoning Code limits a home ocoupation to an oocupation,
craft or profession carried on entirely within a dwelling unit. The
proposed change proposes a new seotion to the Code outlining supplemental
definitions for hcme oocupations and will allow for oonsideration of home
occupations, the operation of whioh is other than exolusively within the
residenoe, suoh as a window-washer.
The proposed amendment provides a system of administrative review.
Current ocoupational lioenses issued to post offioe box numbers and like
addresses would qualify as home oooupations under the proposed
regulations so as to permit them to oontinue in business without
applioation and review by the Board of Adjustment and Appeal on Zoning. No
new occupational licenses would be issued to post office box numbers, and
new requests for home oooupations would continue to be reviewed by the
BAAZ.
