The City Commission of the City of Clearwater met in regular session
at City Hall, Thursday, January 21, 1982, at 5:03 p.m., with the

The Mayor called the meeting to order. The Pledge of Allegiance was
led by Police Chief Klein. The invocation was given by Jerry Gregory of

ITEM 13 - Introductions and Awards.

The City Manager reported an Interim Development Agreement between the
Community Redevelopment Agency and the Radnor Corporation has been
prepared. The agreement identifies the interests and assures the
cooperation of the City to work with the Radnor Corporation for a six-month
period to determine the market conditions, design, and the agency
partiqipatlon that will be necessary to achieve the proposed projeots. The
Radnor Corporation is interested in developing a major office/retail
project on the north side of Cleveland Street between Garden and Waterson
Avenues. The agreement also identifies the executive Director of the
Downtown Development Board as the Project Manager for the City, acting at
the direction of the City Manager on behalf of the City. A six-month
period for preliminary evaluation has been provided and an additional
six-month period of time is also prOVided for the City to receive proposals
for a specific projeot, evaluate such proposals, and negotiate a
Development and Disposition Agreement with the sucoessful projeot spon~or.
The Planning Direotor requested that paragraph nine,
"Representations," be deleted from the agreement. The City Manager
reported paragraph nine was added at the request of the City Attorney to
proteot the City, but after discussion it was deoided that the City is
adequately proteoted in the agreement.

Water meter oonneotion oharges and water main tap fees have been

a. First Reading of Ordinance 02612-82.
The City Attorney presented Ordinanoe D2612-82 for first reading and
stated he would read by title only unless there was a request to read in
its entirety. The ordinance was read by title only. Commissioner Garvey
moved to pass Ordinanoe D2612-82 on first reading. Motion was duly
seoonded. Upon roll oall the vote was:
" Ayes": Garvey, Calderbank, Hatchett, and Kelly.
"Nays": LeCher.
Motion carried.
ITEM D10 - Aoceptance of Grant for Minority Outreach Recruitment Program.
The City'S efforts to reoruit minorities for the City Police
Department have been ineffeotive. A grant is available from the Eckerd
Foundation in the amount of $12,500 that will require an equal match by the
City for use in recruiting qualified minority applioants for the position
of pOlioe officer. This reoruitment effort involves the use of teams to
visit designated areas within the State, who will prOVide information about
Clearwater and the Police Department, and administer the examinations on
the sites. The sites chosen during the first year are Orlando, Daytona
Beach, Jacksonville, Tallahassee, and Opa Locka. The grant provides
funding for newspaper advertising, posters, etc. and will be for 2 years.
The City Manager reported a budget adjustment would be made at either
the first quarter or mid-year reviews. E. J. Robinson, Affirmative Action
Offioer, reported on the City's efforts and the poor response that was
received. He stated the City had done everything pOSSible.
Commissioner Hatchett moved to aocept the grant from the Eckerd
Foundation and that the appropriate officials be authorized to execute
same. Motion was duly seconded. Commissioner Kelly requested the funds be
found in the budget and the budget not be inoreased. Upon the vote being
taken, MUon carried Wlan imous ly .
By unanimous consent, the Commission agreed to oonsider Item D13a., Howard
Johnson Leasement Agreement, out of order.
ITEM D13a. - Lease Agreement - Howard Johnson Company.
The City Manager reported the license and lease agreements were
now aoceptable to both parties. The license agreement covers the period of
time during which construction will take place, and the lease agreement is
to be automatically implemented at the end of the six months' time frame
July 22~ 1982. Due to the City's site plan review process, he reported it
would "probably be three months before construotion could be started. The
lessee will be providing insuranoe as required in sohedule B.
Thomas Padulla, representing the Howard Johnson Company, stated the
tourist information center would act as a service to everyone. They
antioipate no charge for the servioe and would come back to the Commission
if a need develops. If an independent audit is requested by the City that
confirms the lessee's representation, the City will pay the oost of the
independent audit. If there is an error, the lessee would bear the cost.
Commissioner Hatchett moved to approve the lioense and lease agreement
with the Howard Johnson Company. MotiOb was duly seconded and carried
unanimously.

By unanimous oonsent the Commission agreed to hear one presentation
for both items.
The site is vacant and contains 10.33 acres M.O.L. Plans are to
develop the site with retail and office uses to consist of two restaurants;
a finanoial institution and drive-in bank; a four-story office building;
and a ~O,150 square foot shopping center. The Commission had expressed
conoerns about the buffering, the setbacks, and the coverage.
Timothy Johnson, attorney representing the applicant, stated there
are 152 condominium units in the Woodland Villas project directly east, but
only ten units are directly affected by this project. There is a servioe
road for Woodland Villas that runs between the commercial portion of the
development and the Villas. He also stated that there would be no servioe
road behind the commercial portion for their deliveries and that the
developer will fenoe and landscape the project.
The Planning Director reported that the ten-acre traot inoludes a
r~tention pond. Although the recommendation is to approve, the Commission
should consider that there will be a 73-percent coverage of the tract. The
Code allows 75-percent but many other developments of this nature have less
coverage. There is no violation of the Code and the recommendation is to
approve, but to regUlate the use.
Commissioner Hatohett moved to approve the Community Impaot Statement.
The motion was duly seconded. Upon the vote being taken, Commissioners
Hatchett, Calderbank, and the Mayor voted "Aye"; Commissioners Garvey and
Kelly voted "Nay. II Motioa carried.
Commissioner Hatchett moved to approve the Preliminary Site Plan
SUbject to the following conditions: 1) dedication of a ~O-foot
right-of-way easement along U.S. 19 prior to issuance of a building
permit; 2) execution of a tree location/relocation agreement for the
purpose of saVing 50 percent of the existing trees on the site, prior to
the issuance of a building permit; and 3) the requisite initial building
permit(s) be issued within six months from the date of City Commission
approval of the preliminary site plan and all requisite certificates(s) of
occupancy be issued within two years from the date of issuance of the

The Sunooast Family YMCAs requested waiver of fee for a running
event. The City Manager stated a staff report on the oosts of providing
Police Department services for parades and running events would be

The City Manager reported the request of Mrs. Falzone to terminate the
lease of the Shell servioe station on Clearwater Beach. He reoommends the
lease be terminated and the City purchase the equipment in the amount of

The property is vaoant and contains 1.8 acres M.O.L. The proposed
plan and zoning amendments were initially part of the larger area whioh
includes properties to the west and south and were approved for a Land Use
Plan amendment to Residential/Office and a Zoning Atlas amendment to PS
(PrOfessional Services).
The owners of this property, inadvertently, were not notified and on
January l~, 1982, requested the item be continued to this meeting to allow
them to make a presentation to request withdrawal of the ohanges to their
property. The item was originally considered for reoeipt and referral as a
part of the Countryside Area 8 rezonings on November 5, 1961. The Land Use
Plan amendments and zoning changes for Area H8 have been resoheduled for
publio hearing before the City Commission on February 18, 1982.
Timothy Kerwin, representing the Royal Trust Bank, requested the Land
Use Plan remain Commeroial/Tourist Facilities and the zoning, CP, as both
are consistent with eaoh other and adjacent properties. He reported
Towngate Countryside, Inc. had purchased the south half of the property and
the new owner wants to develop under the Commercial/Pa~kway designation.

City Commission direction, staff re-evaluated the Oak Park Trailer Park and
a CTF-24 zoning district, which may be created with not less than four
acres. Additional properties were added in order to create a CTF-2~
district with at least four acres.
Jim Hagen, attorney representing the owner of property west of
Clearwater-Largo Road, requested that his olient's property be deleted as
the four-aore requirement oould be met on the east side of Clearwater-Largo
Road. He also stated that other properties being rezoned are already
constructed and in conformity with the CTF-2~ zoning, but his client's
property is vacant.

ITEM 018 - Public Hearing and First Reading Ordinanoe 82586-81 - Zoning
Property Annexed in Ordinanoe #2585-81.
This request for annexation was approved, subject to oonditions, on
February 19, 1981.
Representatives of Mission Hills Condominium Villas, at that time,
spoke in opposition to the change in zoning on the basio premise that
industry, light or otherwise, should be located away from residential
development. They also cited traffic oongestion and pollution and
expressed ooncerns on the height and lot coverage permitted.
The oonditions imposed by the City Commission inoluded submission of
an application for an industrial planned development for a portion of the
site provided that bUilding heights not exceed two storiesj establishing
building setback lines not less than 100 feet from the west property line,
50 feet from S.R. 590, and 200 feet from the oenter line of McMullen-Booth
Road right-of-way; and to limit the general nature of proposed uses to
oorporate office and. related light industrial activities.
Disoussion ensued on notification of the residents of Mission Hills
Condominiums. The notification of all owners within 200 feet was held to
be legally oorreot. Notification of officers of the condominium
assooiation were sent in error as the names provided were incorreot.
Howard Cusack, Director of Operations at Mission Hills, stated he had
authority to waive notice to the condominium association and requested the
ordinance reading prooeed.
John Bonner, attorney for the applioant, stated the binding agreement
had been recorded and all the required easements, for sewer, right-of-way,
and a parkland dedication/fee had been aocomplished. He also stated it
would be an attraotive development. He noted that although the
notifioations were inoorrectly addressed the notices should have been
turned over to the proper officers.
Bradford Crossman, a resident of Mission Hills, also spoke in
opposition.

Commissioner Garvey moved to deny the requested CG zoning and approve

to a 10-foot drainage and utility easement along the north property line;
to direot the City Attorney to include in an ordinancej to direct staff to

1 -29-1 ; located on the west side of MoMullen-Booth Road, north of and
abutting Kentucky Avenue right-of-way (Freeman) A-81-~O, LUP-B1-7~.
The 5.0 aores M.O.L. site is largely vacant with the exoeption of a
single family residence on the northeast portion of the site. Plans are to
oonstruct club faoilities for the Clearwater Moose Lodge. The applioant is
requesting a waiver to the parkland dedioation/oash payment reqUirement.
The Planning Direotor stated he recommended the annexation and ISP
zoning for the area subject to dedication of three rights-of-way, whioh the
City needs.
George Greer~ attorney for the applicant, requested deletion of the
Bay Street right-of-way and Kentucky Avenue right-of-way, but agreed to the
17-foot right-of-way on McMullen-Booth Road. The organization has the
option of starting construction in the County, but needs City sewer.
The City Manager reported all developers along McMullen-Booth Road had
been required to give the additional right-of-way for the widening of
MoMullen-Booth Road by the County at a future date and it was a major City
polioy issue.

Commissione~ Hatchett - requested a proclamation be issued for
Clearwater Bowling Week the week of February 15 for a bOWling tournament at
Shore Lanes whioh will benefit the Muscular Dystrophy Assooiation.
He also requested the status of the new street sweeper which is still
on order, but has not arrived; the Airpark fence on the west side
oontinually being knooked down; and the status of Vision Cable's
lockboxes.
Mayor LeCher - noted a request by citizens for a left -hand turn
signal from Belcher Road to Druid Road and a left-hand turn signal from
Beloher to Harn Boulevard.
He reported a citizen complaint on the cleaning of ditohes. The City
does not have the funds available to olean the 400 miles of ditohes
throughout the City.
The Mayor reported Polish Solidarity Day would be held January 30 at
Crest Lake Park and a request will be received for use of the Park.

Countryside High Sohool and if it had been oorreotedj and if the response

The City Manager - reported a hearing will be held by the Pinellas
County Board of Navigation on February 23, 1982, relative to the City's
request for a dook permit on the Bayfront.
