1982, as reoorded and submitted in written summation by the Clerk to eaoh

ITEM '6 - Citizens to be Heard re Items Not on the Agenda.
Floyd Stahl, Jr., presented a petition with 17 signatures requesting
the ordinance that allowed a private property owner to erect "no parking"
signs in front of his property be amended. The petition states the signs,
at Lot 18, Montclair Lake Estates SUbdivision, are a safety hazard and a
form of harrassment to the residents nearby.

ITEMS 19 and 110 - Moccasin Lake Nature Park and Mocoasin Lake Nature Park
Interpretive Center BUilding.
Mike Kenton, Assistant Public Works Direotor, Environmental
Managementt presented slides of the Moccasin Lake area and of the bUildings
now under construction. The estimated completion time for the project is
March 22t 1982. Additional funds in the amount of $23,828 will be needed
to oomplete the park, as well as an additional $25t~67 to construot extra
facilities not originally budgeted and to include boardwalks around the
bUilding, sidewalks, sod, and a security fence. The additional funds may
be transferred from the special development fund in which undesignated
funds have been set aside for development of parks and reoreation areas.
Commissioner Calderbank moved to approve the budget increase of
$~9,295 to the Mocoasin Lake Nature Park Capital Improvement Projeot budget
and to inorease projeot funding by transfer from the speoial development
fund and that the appropriate officials be authorized to execute same.
Hotlaa was duly seoonded and carried unanimOUSly.
Ream Wilsont Parks and Recreation Directort reported the original
estimate for construction of the interpretive oenter building was done two
years ago and two years of inflation and the fact that the nature and
energy center is a very unique proposition made it diffioult to arrive at
acourate estimates. An additional $~9t926 increase is necessary. He
reported that these funds will provide only for a shell of the building.
It is hoped the private seotor will provide funds to complete the
interior.
Commissioner Garvey moved to award the contract for the Mocoasin Lake
Nature Park Interpretive Center Building to F. J. Ward and Assooiates, for
the sum of $96t426t whioh is the lowest responsive and responsible bid
received in acoordanoe with the plans and speoifioations and to approve
transfer of $50tOOO from the Capital Improvement Project oode 3234 to
C.l.P. oode 3215t and that the appropriate offioials be authorized to
exeoute same. MOtlaa was dUly seoonded and carried unanimously.
ITEM #11 - Raintree Village
for Streets and Sewers.
Request for City to Assume Responsibility
George A. Barkert representing the residents of Raintree Villaget
requested the City aocept the responsibility to maintain streets and
sanitary sewer lines within the development.

Request for Waiver of Tree Planting Policy - J. Patrick
In April of 1978 an ordinance was passed banning the planting of
street trees in the right-of-way as these plantings confliot with the
existing and future utilities, street pavement, sidewalks, and the
treatment of sewage. A provision of the ordinance allowed the planting of
street trees within five feet of the property line. Mr. MoElroy requested
the waiver beoause other trees on his street planted prior to 1978 are in
the right-of-way.
Commissioner Calderbank moved to approve the waiver request. Motion
was duly seoonded. Discussion ensued on the problems encountered with
roots in the City sewers, and pictures taken by the City's television
camera were presented by the Public Service Division. Commissioner Garvey
requested a policy statement by staff to establish parameters and a time
frame for waivers of the tree-planting pOlicy.
Upon the vote being taken, .otlon carried unanimously.

Tampa.
Parking Bond Escrow Agreement
Exchange Bank and Trust Co. of
Commissioner Hatchett moved to approve the esorow agreement with the
Exohange Bank and Trust Co. of Tampa, providing for the defeasance of the
City's Parking Revenue Bonds at a cost of $5,000 plus use of surplus cash
balances 1n the Esorow Acoount, and to amend the 1981/82 Parking Fund
Operating Budget appropriating $5,000 for this cost, utilizing proceeds
of the sale, and that the appropriate offioials be authorized to execute
same. MOtlaa was duly seoonded and carried unanimously.
ITEM 114 - Lease Agreement - Howard Johnson Company.
In October of 1981 the City Commission awarded the lease of the
City-owned property located at 56 Causeway Boulevard to the Howard Johnson
Company and staff was instructed to bring baok a lease agreement for
consideration. The lease proposed by the Howard Johnson Company was not
acoeptable to staff. Both parties are now in agreement with the exception
of paragraph 10. "Default," and paragraph 15. "Eminent Domain
Condemnation."
Burton Peltz and George Greer, Attorneys, representing the Howard
Johnson Company, expressed oonoerns in the event another governmental
agency were to invoke eminent domain condemnation, the Howard Johnson
Company would be unable to collect damages from that agency. The City, at
that point in time, would terminate the lease and repay the Howard Johnson
Company for the unamortized lease hold improvements investment in the
bUilding but would deny them the right to prove any other damages that they
might otherwise be entitled to from another agency. There is no
requirement in the lease that the City pay for future profits but if the
State or other governmental agenoy is the taking party, then the Howard
Johnson Company should have the ability to collect damages. Mr. Greer

ITEM 115a. - Addendum to the Community Impact Statement for Countryside
Village Countryside Traots 45, 72, 73 and 74, in Seotions 30 and
31-26-1~i located at the northwest interseotion of U.S. 19 and Enterprise
Head (The Lane Company). (see page 12)
AND
ITEM 115b. - Revised Preliminary Site Plan for Countryside Village (same
as above) PSP-61-9.
The Planning Direotor reviewed the history of the Countryside Village
CIS and PSP and his reoommendation to approve a 22,000-square-foot
addition.
The property is partially developed with retail stores and offioe
buildings and is currently zoned CP (Parkway Business) District. The
addendum was prepared by the developer in support of the planned revisions
to the site plan. The developer requests an additional 44,600 square feet
of retail floor area in addition to the 100,000 square feet previously
approved. The additional retail floor spaoe would be deleted from the
original office development allooation.
Commissioner Calderbank moved to approve the addendum to the community
impact statement for Countryside Village, subject to qualifioation and
reservation oonoerning: 1) the assumptions and oonclusions of the
traffio analysis, and 2) the methodology and ourrent validity of the
market analysis. KotiOD was duly seconded and carried unanimously.
Elizabeth Daniels, attorney representing The Lane Company, stated
the site plan meets all the requirements of the Code and there is a need
for the 44,800 square feet. Joseph C. Lane, developer, stated he purchased
the property three years ago and felt there would be less impact with the
plan he is proposing of low campus type buildings than the usual shopping
oenter oonfiguration.
Commissioner Garvey moved to approve the revised site plan for
Countryside Village subjeot to the additional retail floor area not to
exoeed 22,000 square feet. Commissioner Calderbank seoonded the motion and
withdrew his seoond after discussion. Kotion died for lack of a second.
Commissioner Calderbank moved to oontinue the item to after the public
hearings for further discussion. KotiOD was duly seconded and carried

The .96 aores M.O.L. was originally part of the Happy Trails Mobile
Home Park, but 1s planned to be utilized commeroially and will not remain
part of the existing mobile home park. An amendment to the Land Use Plan

east and west sides of Clearwater-Largo Road, south of Woodlawn street

The area is developed with retail uses: a motel, a travel-trailer
park, mobile homes, oottages, a duplex, and a single family residenoe. The
City Commission denied a request for RMH zoning and direoted a zoning atlas
amendment for CTF-24 to be advertised. The Code requires that no new
CTF-24 distriot may be oreated whioh oontains less than four acres. The
size of the area requested to be rezoned has been increased from the
initial area of the Oak Park Trailer Park to a larger area lying east and
west of Clearwater Largo Road.
The Planning Director reviewed the history of the site.
Tom Judge spoke in opposition and requested his property be deleted
from the rezoning.

classification.
The Countryside Country Club and Golf Course is private and open to

open to the general pUblio. The Planning and Zoning Board reoommended that
the wording, "inolude making the faoility open to the general pUblio" be
inoluded in the reoommendation for the Countryside Country Club and Golf

To date however, only 33 individual units have been built. In December of
1981, the City Commission approved a revalidation of the site plan for the
Oaks of Northwood to allow permits to be drawn through June 30, 1982, and
the projeot to be completed by June of 1983 whioh will allow the project
to oontinue to be developed with three- and four-story buildings as
originally planned. This aotion was taken in consideration of the property
being rezoned to RM-16 whioh restriots building height to 25 feet so as to
extend the time period allowed for project completion.
Commissioner Garvey moved to approve a Zoning Atlas amendment to
RPD-16 to allow the approved site plan to continue and the developer to
resubmit an amended plan within six months and to direct the City Attorney

ITEM '40 - Aooeptanoe of Deeds. Easements, and Restriotions.
The City Attorney presented the following instruments:
a. Quit olaim deed from Harriet A. Finkenbinder for part of Lot 16 in
the SE~ of Seotion 1-29-15, Pine11es Groves SUbdivision. for extension of
Sunnydale Boulevard: \
b. Correotive deed from Pine1las County for real property in
Chautauqua Subidivision originally oonveyed to the City of Clearwater in
1977 in a portion of the SW~ of Seotion 32-26-16 less the road right-of-way
for Lake Shore Drive and Seoond Street East, and to establish,
speoifical1y, the west boundary of the traot of land known as Traot B, and
o. Aooess and drainage easement from the Lakeview Oaks Condominium in
a part of the NE! of Seotion 21-29-15.
Commissioner Oarvey moved to aooept the above instruments and to
direot the City Clerk to reoord same in the Publio Reoords of Pinellas
County, Florida. MOtloa was duly seoonded and carried unanimoUSly.
ITEM 1~1 - Other Commission Aotion.
Commissioner Oarvey - requested the status of the bathhouses at the
Pier Pavilion, and the status of work oomp1etion by Vision Cable.
Commissioner Hatohett - requested the status of the Naroonon program
whioh the Sohoo1 Board has rejeoted.
Commissioner Ca1derbank - requested oonsideration of a new zone or
distriot to ooordinate Mandalay Avenue.
He reported dooumentation is being gathered on the "Cooonuts"
nightolub in Morningside Estates to establish it as a nuisance.
Commissioner Kelly - requested support by resolution of the Missing
Children Act and requested the City Manager respond to Mr. Alpert in
writing re comp1ianoe with City Codes.
She also questioned the charitable oontribution to be made of the
Disneyworld gate peroentage at the reoent Clearwater Days.
