Commissioner Hatchett moved to approve the minutes of the
regular meeting of May 6, 1962, as recorded and submitted
in written summation by the Clerk to eaoh Commissioner. Motion was duly
seconded and carried unanimously.
ITEM (J6 - Citizens to be Heard re Items Not on the Agenda.
Evelyn Gibson requested action be taken on the height violation of
the Boldog fenoe. She also stated there had been misrepresentation by the
owner and antioipated the fenoe would be four feet in height instead of six
feet.
Charles Finton, David MoCollum, Gordon MoDougall. Frank Morrow. John
St. Clair, and Arthur J. Earl, spoke in opposition to a fishing pier on
the Bayfront. A suggestion was made to use the funds for the purohase of
the Sunset Point-Edgewater property for a park.

ITEM '7 - Other Commission Action.
The Mayor questioned whether Hospice faoilities are available to
City employees under the City's health insuranoe plan.
He reported on a trip to Toronto, departing August 25,
the Bluejays' baseball team.

as Pinellas County is a very densely populated, small oounty.

Commissioner Berfield moved that the City Commission go on reoord
along with the Governor in opposing the oonstruction of a prison in
Clearwater. Motion was duly seoonded. Upon the vote being taken,
Commissioners Hatchett, Calderbank, Berfield, and the Mayor voted "Aye."
Commissioner Garvey abstained oiting Commission policy that items discussed
under "Other Commission Aotion" not be voted upon at the same meeting.
Commissioner Calderbank discussed the reoommendation of the City
Clerks Department for cost reduction on agenda paokets.

Commissioner Garvey requested that agenda cover sheets more olearly
identify areas to be zoned by ordinances.
Commissioner Calderbank requested oonsideration of the waiver of
fees for the Annual Bucs/Bombers Charity Ballgame to be held June 27,
at Jaok Russell Stadium.
He reported that the Pinellas Sports Authority had favorably received
Clearwater's suggested site for a baseball stadium.

He stated he would like to attend the educational forum to be held
Saturday, May 23, 1982, to raise funds for the Scientology Viotims' Defense
Fund. The City Attorney advised all Commissioners not to attend as there
is ongoing litigation.
The Commission requested the City Attorney respond to the Committee
with an explanation of the situation.
Commissioner Berfield noted a number of letters with oomplaints
regarding ditohes. In general, they are not City property and are the
produot of the developer. It is not the City's responsibility to olear
ditohes, unless the flow of water is impeded. He suggested that a flyer be
sent in utility bills to explain City policy.
He requested the time frame for construotion of the Nursery Road
sidewalk which is dependent on aoquisition of an easement. He questioned
the right of ingress and egress on private property by Florida Power and
General Telephone for access to an easement. The City Manager was
requested to write a letter to the utility oompanies requesting that they
indentify themselves to the resident before entering property.
Commissioner Berfield requested the time frame for budget work
sessions and hearings which will take place in July and August, and
adoption in September.
He noted a benefit ball game on Wednesday, May 26, 1982, at 7:30 p.m.
at Clearwater Comprehensive High Sohool to support the United Negro College
Fund, Inc. Members of the Commission are invited to participate as members
of Mayor LeCher's "All Stars."

The City Manager reported that the application was prepared in
response to a request by a private property owner desirous of oonstructing
a marina on property currently zoned PS. The property owner, at this time,
has requested the PS portion of the recommendation be withdrawn.
The Planning Direotor suggested that the Commission withdraw the
entire item and direct staff to look at the whole question, i.e. the
definitions of marinas and their plaoement in the Code as part of the Code
update.
Anne Garris requested that the Commission hear the item as citizens
were present.

- The enlargement of Tower No.2 by an additional 28,000 aq. ft.
would. by our measurement, extend the length of the bUilding by
some 14 ft. The projection of this additional building dimension
perpendicular to Gulf Boulevard would continue to meet the side
yard and building separation distances calculated as the minimum
under the original plan. I would point out that while I will
recommend approving this plan amendment. it further reduces the
amount of open space on site in a manner inconsistent with the
original rationale for variance to building height that was
granted.
- The revised parking around Tower No. 2 does not substantially
change the parking arrangement as originally approved and we
have no objection to this amendment.
The recreation building is proposed to be increased by some
400 sq. ft. More importantly. its length would increase, by
our measurement, from some 60 ft. to 72 ft. This would exceed
the required setback and separation distance ares requirements
by a small amount for the lot as a whole, but more importantly.'
further reduces the amount of open space and increases the
amount of area blocked from view by the project from the road
to the gulf w by some 12 ft. or'20 percent over that previously
approved for this building. I will recommend that no increase
in the length of the building, as measured essentially parallel
to Gulf Boulevard, 'be approved and that any additional floor
area that you deem necessary be constructed in an east/west
direction perpendicular to the road.
The parking spaces proposed on parcel 4 D are not permitted and
this item is Qat eligible for consideration as a plan amendment.
It is the position of this department that such use is not
provided for under the RM-28 district; that development rights
have been previously transferred from this parcel to the main
parcel west of Gulf Boulevard; that the parking layout, even
were it permitted, does not meet the clear space requirements
of the Code. This item should either be removed from the plan
or be identified In,8 request to the Commission to override
the interpretation and application of the Code by staff.
- The addition of a wall not to exceed 21 6" at the main entry
and exit drives is permitted under the Code and is eligible
to be added to the site plan as an amendment. subject to the
requirements of Section 131.205 of the Code, with specific
reference to landscaping requirements which will require the

require elimination or relocation of the portions of the
wall extending parallel to the right-of-way north of the
main entry drive and south of the exit drive.
The addition of the 4-ft. wall south of Tower No.1. 8S ap-
proved by the Board of Adjustment and Appeal on Zoning on
Harch 25, 1982, is a legitimate addition to the plan and
will be included in the list of amendments to be ratified
by the Commission.
- Refars to the seawall. a portion which has already been
constructed, with the remainder proposed. It is my under-
standing, based on infonnation provided by you. that this
has been sepatately approved by the appropriate permitting
authorities and is therefore eligible to be identified on
the plan as an amendment which will be recognized by the
City Commission.
- The addition of boardwalk cross-overs behind Tower No. 1
and Tower No.2, subject to permitting by the appropriate
authorizing agencies, is not a change from the certified
plan and does not require identification as a plan amendment.
The addition of the docks on 'the east side of Gulf Boulevard,
as approved under a separate procedure by the Board of Ad-
justment and Appeal on Zoning, and County and State agencies.
is appropriate to identify on the plan so as to be recognized

- The proposal to change the exit drives at the north and south
limits of property to entrance and exit openings is a significant
change and objectionable to this department. We strongly recom-
mend reconsideration of this in order that the principal entry
drive and deceleration lane serve the purpose for which they
were originally intended and not compound traffic flow by adding
two additional points of entry on busy Gulf Boulevard. This
change is eligible to be considered for plan amendment, but is
one to which we will object.
- The sidewalk adjustment detail) based on water meter location,
will be coordinated with the Utilities and BUilding Departments
relative to a recommendation for plan amendment approval.
Addition of the landscape islands in the parking lot south of
Tower No. 1 is a welcome improvement and will be recommended
for approval.
- The revised shape of the swimming pools presents no problem and
is a minor adjustment that will he included with the other amend-

ITEM 19 - Parking Meter Rate Increases on Clearwater Beach.
A parking rate inorease of August 1974 was approved for those meters
which are used primarily by people who are at the beach for reoreational
purposes. The meters in the business area had no rate inorease, nor did
any of the parking meters in the downtown area. A rate increase from $.20
to $.30 per hour is recommended for the majority of the meters on the
beaoh. Those meters whioh presently oharge $.05 per hour will increase to
$.10 per hour. Meters in the Marina Lot and the Civio Center Lot are
exoluded from the reoommendation. The anticipated annual revenue inorease
is $152,000. Conversion of the meters is estimated to oost $18,000.
Commissioner Hatchett moved to approve the parking meter rate
increases. Motioa was duly seoonded and carried unanimously.
ITEM 110 - Clearwater Beach Trolly (Jolly Trolley).
The trolley will run on Clearwater Beaoh making round trips between
the Sheration Sand Key and the intersection of Mandalay Avenue and Aoacia
Street. A six-month trial period is proposed and the trolley will be
operated by the Central Pinellas Transit Authority which will furnish the
drivers, insurance, and regular vehiole maintenance. The estimated cost of
the six-month trial is $20,840.47.
The leasing cost of the vehicle for the six-month period is $9,000.
There will be no lease fee after the six-month trial period. The trolley
will provide transporation between the motels, restaurants, shops, and
publio beaoh areas. The reoommendation is that there be no charge to ride
the trolley. A fare oan be instituted at a later date if necessary.

Dredging operations were interrupted by the disoovery of a leak in the
main pump shell. When the pump was disassembled it was noted that many of
the parts were substantially worn. The unit has been in service for two
years and the City Manager directed that repairs prooeed immediately as an
emergenoy item.

System for Clearwater Airpark.
This system will assist pilots to fly a proper glide slope to avoid
obstruotions, prinoipally high trees, on the south end of the Airpark
runway. This navigational aid oonsists of a series of white lights whioh
indioate to an approaohing pilot the correot glide slope to avoid on-the-

payloader. As the Bum of $1ij,OOO indioates that the maohine is beyond
eoonomioal repair, quotes were requested to determine if B replaoement
maohine was available at a reasonable cost. The lowest, most responsive
quote was field tested and determined to be oapable of performing the

l~ and the northerly 23.5 feet of Lot 12, Unit 2, Island Estates in Seotion

The site is vacant and the developer plans a 12-unit condominium of
four stories. The site plan was initially approved in 1980, sUbjeot to the
