meeting of March 18, 1982, as amended on page 4, Item 014, ItCommissioner
Berfield moved to amend Ordinance #2522-81 by estnblishing the minimum
distance between mobile homo units to be ten feet, including any habitable
or non-habitable roofed structure supported by a footine or foundation,
inclUding any storage bUilding,lI and submitted in written summation by the
ClerIc to each Commissioner. Motion was duly seconded and carried
unanimously.

fund the project which is estimated to cost 1.7 billion dollars. A private
entity entitled CEPCQT INC. Irlhich ntnnds for Clearwater Environmentally
Planned Community of Today will be created. The plan proposes a monor~il
transportat.ion system from near U.S. 19 through downtown Clearwater and to
the beach, Hith add i tiona 1 monorail picl<up points in several general
areas. Parking areas would keep automobile oongeotion out of the central
,. city as well 111'1 off of ClcarHator' Rench. Additional people-moving systems
Hill be constructed w1.thin the central City to fncil1.tate easy shopping and
there will be further service transportation from the residential sections
all tying in with the monorail system.
The four basic organizational components arc: 1) formation of CEPCOT
INC.; 2) croation of leeislation permitting the acquisition of the
SUbject land by the corporation; 3) creation of legislation establishing
a special taxing district within the subject geographical areaj and II)
creation of legislation affording ad valorem tax relief during the
construction phase of the development.
In summation. the project. as proposed, will use local developers.
businessmen. and contractors. All existing tenants will he grand fathered
and the corporatlon will pay relocation expenses wi thin this nelrl city
development. All existing landowners Hill have a tn:(-free exchange of the
equity value in their property for stock in the corporation. The board of
directors will be composed of 21 people. including the City Commission.
The corporation's attorneys Hill pay all legal expenses to implement the
project and will handle all legal expenses for the city that concern this
central project.
Helen Diller, founder of "Save ClenrHater Bayfront and Memorial
Causeway Parks", stated, that city-mined parklands are involved in this
corporate plan and these lands were deeded to the City and are covered by a
reverter clause. Her statement is attached for the record.
Frank HarraH, also spoke in opposition to using City owned land for
the project.
ITEM 08 - Clearwater Housing Authority Presentation.
Robert Levison, Chairman of the Clearlrlater Housing Authority. reported
on the prop;ress made by the CHA in the past year and the many significant
changes. He presented a check in the amount of $10,000 to the city in
lieu of taxes.
ITEM 19 - Non-Partisan School Board Elections - House Bill 0007.
The City Manager reported that the bill supporting non-partisan ochool
board elections had not passed the legislature and HithdreH the item. No

ITEM U13 - Rehabilitation Loan Program.
a. Operations f.lnnual.
A new mnnual has been drafted and provides for a 10"1 interest rate for
rehabilitation loans, advances and emoreency grants to residents who reside
in dwellings that are sub-standard. The objective of the program is to
up-grade existing housing stockt inCluding mobile homes that are
owner-occupied. Naximum income limits for eligibility have been increased
to reflect new area median income levels estnbl1nhed by HUD.
Commissioner Garevey moved to approve the Rehabilitation Operations
Manual. Hotion Has duly seconded and carried unanimously.
b. Budget Amendment.
The $198,100 allocated for the Rehabilitation Loan Program has been
expended or encumbered. Federal regulations require that the City meet the
housing assistance goals previously adopted and an additional $95tOOO of
funding is needed and is available from several projects.
Commissioner Garvey moved to approve a budget increase for the
C.D.B.G. Rehabilitation Loan Program by transfer of surplus funds from
other C.D.B.G. projectst and that the appropriato officials be authorized
to execute same. Hotion was duly seconded and carried unanimously.
ITEH IJ1J~ - Neighborhood Ifousin~ Services Contract Amendment.
The amendment to the current contract with NilS provides that NHS may
make variable Interest and Fixed Rate Housing Rehabilitation Loans in the
maximum amount of $16,000 at interest rates and terms determined by the
Loan Committee. The maximum levels for eli~ibility and the removal of the
interest' roduction loan programs are included to allo"l the existing
agreement to conform to current HUD policies.
Commissioner Hatchett moved to approve the Housing Rehabilitation Loan
Contract Amendment and that the appropriate officials be authorized to

ITEM 1115 - ClearHater Neighborhood Housin[l; Services. Inc.
The fund-raising committee of Clear_later Neighborhood Housing
Services, Inc., failed to generate sufficient revenue to cover a community
worker's salary and are requesting city assistance in the amount of $8,100.
Commissioner Hatchett moved to approve the agreement with Clearwater
Neighborhood Housing Services, Inc. to fund a community worker at a cost of
$8,100, and that the appropriate officials be authorized to execute same.

Resolution ~82-33 - Amendment Rule 10, Rules of Procedure of the
Clearwater City Commission - Amending Rule 10 to change the time of "Other
Commission action," in the order of business of the City Commission.
Commissioner Hatchett moved to pass and adopt Resolution I1S2-33, and
that the appropriate officials be authorized to execute same. Motion was
duly seconded. Upon the vote being taken, Commissioners Hatchett,
Berfield, Calderbank and the Mayor voted ttAye"; Commissioner Garvey voted
"Nay." Motion carried.
The City Manager requested direction for location of the
Moonwatohor, a sculpture being prepared by an A~tist-in-Residence. By
unanimous consent, the Commission requested the City Manager make n
recommendation on a location.
The City Manager reported a ~eque3t that all pOlice officors and
firemen be sworn in at ~cgular City Commission meetings. By unanimous
consent Commission approved.
Soientology Hearings - had hoen tentatively scheduled to commence
April 20, 1982. Conflicts have arisen and the City Nanager requested that

initial building permit(s) be issued within six months from the date of

permit; and 3) that the developer provide playground equipment and
relocate the fence on the south property line onto adjaoent City property

The site is part of the parkinc lot for Gr::.tnt Plaza Shopping Center
and the applicant plans a 9t858-square-foot restaurant on a portion of the
cxisting parking lot. The Board of Adjustment and Appeal approved a
variance for on-~ite parking spaces rcquired for the restaurant use and
shopping center.
Commissioner CaldeT'banl~ moved to approve the preliminary site plan

The city is considering expandinB a marina slip for the purpose of
docking the Captain Anderson. A li.cense agreement Hill be entered .tnto
with the Captain Anderson to operate out of Clearwater Marina annual review
to determine Hhether the impact of the Captain Anderson is acceptable to
other operations in the area. Staff requests authorization to advertise
bids and specifications for constructlon of a parking lot adjacent to the
Youth Maritime Center on Clearwater Deach.
Citizens spoke in support of ground-level parl~ing only, more tennis
courts instead of parking, concerns on providing parking for a private
enterprise, a need for restrooms on the beachj and the owner of the bait
stand requested consideration for expansion and improvement of the
bait/pier operation.
Commissioner Garvey moved to approve expansion of the City Marina to
dock the Captain Anderson and to authorize needed parking for Clearwater
Beach and, in addition, to direct staff to return with pertinent cost
fir,ures and financing proposals for expansion of the Harina and
construction of a parking lot at the Youth Maritime Center. Motion was

Charles Cope, attorney representin~ the applicant, presented a new
proposal and stated they would accept the current zoning \lith a request to
correct the Land Use Plan from Recreation/Open Space to Low Density
Residential.
John Ehrig, architect of Mudano Associates, presented sli~es of the
old hotel and otated that Edgewater Drive is a scenic corridor. He
requested the Land Use Plan designation be corrected to Low Density
Residential. He stated the old hotel would probably be torn down when the
new Stevenson Creek bridge is constructed and the road widened. They are
currently planning a facility of four stories, with three livable floors
over parking.
Citizens spo\,c in opposition, citing a need for a park and requesting
that the city purchase the area. A petition, with 338 si~natures opposing
the change was presented for the record. Concern was expressed for erosion
in the area. Citizens suggested that the city has some rights to the
property as rip-rap had been placed to prevent erosion of the road.
Discussion ensued on a transfer of density to the property to the
sou th .
Commissioner Garvey moved to deny the requested CTF-28 zoning and to
allow the property to remain RS-50. Motion was duly seconded and
carried unanimously.
The City Attorney returned at 9:35 p.m.
ITEt1 /12JI - Land Use Plan Amendment from Reoreation/Open Space to
Commercial/Tourist Facilities for a Portion of M&B 22 (23.02) NW~ Section
3-29-15. (Sunset Point Developers, Inc./City-Applicant) LUPS2-B.
Commissioner Calderbank moved to deny the requested Commercial/Tourist
Facilities Land Use Plan classification and to direct the City Clerk to
readvertise for a Land Use Plan Amendment to Low Density/Residential for
all of M&n 22 and that the City Attorney research the city's interest in
the property. Motion was duly seconded.
Charles Cope, attorney, requested a reasonable use of the property and
questioned the time frame for the readvertising.
Commissioner Calderbank, for the record, noted that the action being
taken by the Commission was as rcquestcr! by the applicant's attorney.
Upon the vote being taken, motion carried unanimously.

The site is developed with a single family residence and the applicant
plans an office-retail complex. The Planning Director reported there is an
agreement with the County to limit commercial zoning on NE Coachman Road.
Joe Booth, representing the applicant, had requested CTF but stated PS
(Professional Services) zoning would be acceptable. There is a hou~e on
the property but it is not suitable for residential use.

Commissioner Garvey questionod the starting timo for the new $1.00
parking system to be implemented on Clearwater Beach.
Recommended a time frame be set for removal of mobile homes from
Commercial' Zones. The City Manager responded that staff would,rovtcw in
one year.
Requested maps of f10bile Home Parl{s showing density and questioned
the density of Happy Trails Trailer Park.
Commissioner Calderbnnk noted that Pierce 100 residents had requested
traffic be monitored during peak hours at their location. I
The Hayor requested the status of the $5,000 for Band music.
The City ~1anager noted the Scientology Hearings could start the last
\omek in April or' the first week in Nay on a continuing basis excepting
Sundays.
