.ITEM #8 - Selection of Consultant for Legislative Hearing.
The basis for the hearings will be the improper activities oonducted
by the Church of Soientology in Clearwater. The City Attorney has advised
that munioipalities have the legal authority to regulate improper
activities if there is a compelling demonstrated publio interest.
The City Manager recommends employment of Miohael J. Flynn as a
oonsultant to assist in conduoting legislative hearings to determine
whether there is compelling publiC interest reqUiring the adoption of
oharitable solicitation and oonsumer affairs types of ordinances. The City
Manager reported that the proposed budget for the hearings is estimated to
be $110,000 and will be appropriated from the Florida Power franohise fee
revenue.
The proposal by Mr. Flynn contemplates three phases to the projeot:
1) preparation for the hearing; 2) presentation before the Commission;
and 3) a final report and analysis of the record created before the
Commission.
Hugh Wilhere read into the record a letter from the Churoh of
Scientology requesting that the City fund $106,275 so that the Church's
position could be represented at the publio hearing. The City Attorney
reported a letter had been forwarded to Peter Martin, the Churoh's
attorney, advising that they could present witnesses at the hearings at
their expense.
Discussion ensued on phases I and II.
Commissioner Hatchett noted that all non-profit groups would come ,
under the new ordinances, if implemented.
Commissioner Calderbank moved to approve implementation of phases I
and II re the Soientology hearings before the City Commission and that the
City Commission re-evaluate at that time and determine whether or not to
proceed. HotiOD was duly seconded and carried unanimously.

ITEM '10 - Proposed Clearwater Bayfront Pier - Action.

By memo of February 25, 1962, the City Manager recommended to the City
Commission the following actions be taken: 1) Direct the City Manager and
City Attorney to petition for a rehearing before the Water and Navigation
Authority to consider a modified permit which would include the length of
the "T" at 110 feet, but would eliminate the dolphins and tie pilings
required to dock the Captain Anderson. It would allow the dock to be
constructed for fishing. 2) Authorize the City Attorney to file suit
against the Water and Navigation Authority to determine whether they have
the power to require permitting for city publio dooks. 3) A pUblic hearing
be held to consider marina expansion for the purpose of dOCking the Captain
Anderson and the location of required additional parking on the Beaoh.
The County Commission, acting as the Pinellas County Water and
Navigation Authority, approved a modified permit for construction of
Bayfront Pier on February 23, 1982. The permit would allow a "Tll of
20 feet, reduced from the requested 110 feet.

Commissioner Calderbank noted that Charter amendments are being
drafted to preserve the Causeway and the parkland.
Commissioner Berfield expressed concerns about the expenditure of tax
funds and the citizens' apparent opposition to the pier. He supports
preservation of the bluff, questioned the City's finanoial obligation
and whether or not supplies already purohased could be used
elsewhere. In responset the City Manager reported the contract could
probably be oancelled without any finanoial obligation to the City and the
supplies would be used elsewhere.
Commissioner Berfield reported a conflict of interest as he had
represented the Need-a-Diver firm. (Copy is attached hereto).
Commissioner Garvey noted that the legislative bill relating to the
reverter clause had been withdrawn by Representative Kiser. She supports a
Charter amendment on the reverter clause.
Commissioner Calderbank moved to direct the City Manager and City
Attorney to petition for a re-hearingt to authorize the City Attorney to
file suit, if necessary, and that a public hearing be held to consider
marina expansion and location of required additional parking on the Beach.
Motion was duly seconded. Upon the vote being taken, Commissioners GarveYt
Hatohett, Calderbank and the Mayor voted "Aye"; Commissioner Berfield voted
"Nay." Motion carried.

Publio Hearings
ITEM 117 - Lot Clearing Violations - List 082-1.
Complaints of lots needing to be cleared have been investigated by the
Sanitation Division and owners were notified by certified mail to olear the
property within ten days or a public hearing would be held to authori7.e
olearance. List 082-1 with two property owners who failed to clear their
property within the ten days was presented.
City Inspector Albert Brandenberger stated that both lots had been
oleared. No citizens spoke in objection.
Commissioner Calderbank moved to authorize billing of the property
owners for administrative charges as they were in violation of Ordinance
01894. MOtloa was duly seconded and carried unanimously.
ITEM 018 - Petition for Annexation. RS-75 (Single-Family Residence)
District zonine and F.D. 12 of the W 80 feet of M&B 45 in the NW~ of
Seotion 4-29-1 ; located on the N side of Main Street approximately 400
feet W of MoMullen-Booth Road (Hamm) A-82-2.
\ The site is vaoant and the applicant plans to construct a
single-family residence on the north portion of the property. The
applicant is also seeking city water and sewer servioe.
Commissioner Calderbank moved to approve the request subject to the
following oonditions: 1) Granting of a five-foot drainage and utility
easement along the west side of the property; and 2) Granting of a
ten-foot drainage and utility easement along the north side of the
property; and to direct the City Attorney to include in an ordinance.
Motion was duly seconded. There were no oitizens' comments. MOtion
carried unanimously.

The property is partially developed and contains 25 acres M.O.L.

Board had unanimouslY approved the revision.
Commissioner Garvey moved to approve the site plan subjeot to the
fOllowing conditions: 1) The site plan approved by the City Commission

ITEM 013 - Vacation Request, Portion of Madison Avenue between the N
Right-of-way Line of South Pine Street and Turner Street V-81-05 (Dwight
Carr). Turner Street Groves; Maryland Sub.
On April 12, 1981, the applicant requested vacation of a portion of
Madison Avenue. The request was approved subject to the City retaining a
drainage and utility easement and Obtaining a 100-foot diameter cul-de-sac
on the east end of North Pine Street. The applicant did not provide a deed
for the cul-de-sac and is no longer the owner of the property.
Commissioner Garvey moved to rescind the action approving the

on Zoning's deoision of November 12, 1981, whioh granted the hotel
permission to build a 50-foot do ok in navigable waters near Clearwater Pass
Bridge.

use as a special exoeption and oan only be denied if it is not in the
publio interest. He also stated that all evidence is reported to the

The Mayor reported a request from the Pinellas Sports Authority to
re-appoint a representative to the Authority as Mr. Tenney is out of

(City).
A parcel of land located at the northeast oorner of Flushing Avenue
and Harn Boulevard was rezoned in 1972 to Parkway Business and certain
conditions were imposed by the City Commission as refleoted in the minutes
of that meeting. The subsequent ordinance did not refleot the conditions
and a new ordinanoe has been drafted to amend and supplement the
cond i tions .
Commissioner Garvey moved to direot the City Clerk to advertise the

b. Bennigan's - Special Permit for Tent Use on St. Patriok's Day.
Commissioner Hatohett moved to approve the request of Bennigan's
Tavern, 2640 Gulf-to-Bay BOUlevard, for a speoial permit to use a 40 by 35-
or 40 by 45-foot tent 1n oonjunotion with their St. Patriok's Day

City of Clearwater.
The Chamber of Commeroe is renovating and expanding their faoility.
The amendment will allow the Chamber to renovate and obtain a mortgage in
an amount not to exoeed $96,000 to oover finanoial obligations for the
parking lot and purohase of a new oomputer. The agreement originally
carried a $50,000 maximum restriotion on the borrowing of money.
Commissioner Garvey moved to approve the amended agreement and that

The developer will construot a 101-unit apartment oomplex for the
low-inoome elderly and handioapped. There will be four three-story
apartment buildings~ each attaohed to the one-story oommunity oenter. The
Resouroe Development Committee at its meeting of February 11, 1962,
reoommended approval subjeot to oonditions, and the Board of Adjustment and
Appeal on Zoning also met on February 11 and granted varianoes to allow
for the three-story bUilding height, individual unit size of 637 square
feet, and a reduotion of 39 paved parking spaces, providing a permeable
area is reserved for parking of 39 vehioles. The site plan has been
revised to refleot the requirements of the Board of Adjustment and Appeal
on Zoning. The City will provide water, sewer, and sanitation servioes to
the property and the streets will be constructed by the developer and
turned over to the City as public streets upon completion of tho
development.
Citizens spoke in support and in opposition. H.U.D. has speoial
requirements for publicly-assisted housing for the elderly.
Commissioner Hatchett moved to approve the community impaot statement
and addendum, and the preliminary site plan for Clearwater Bay Terrace
subject to the following conditions: 1) prior to issuance of the initial
building permit, granting of aooess and utility easements as shown on the
plan and granting of drainage easements and utility easements over water
mains and hydrants as required; 2) dedication of right-of-way for
Pineland Drive prior to the issuance of the initial building permit; 3)
payment of parkland dedication fee prior to the issuance of the initial
building permitj 4) construction of Betty Lane by HUD and aocepted by the
City prior to the issuance of bUilding permits; 5) a transfer of density
of 1.84 units from the 0.23-acre parcel west of Pineland Drive to the
larger tract east of Pinel and Drive and oovenants be executed to run with
the land refleoting the transfer of densitYi 6) a water main be
installed and tied from Mary L Road to Sunset Point Road per City standards
prior to issuance of Certificates of OocupancYi and 7) the requisite
initial building permit(s) be issued within six months from the date of
City Commission approval of the site plan and all requisite certifioates of
ocoupancy be issued within two years from the date of issuanoe of the
initial building permit. Motion was duly seconded. Upon the vote being
