The Mayor called the meeting to order. The Pledge of Allegianoe was
led by Police Chief Klein. The invocation was given by the Reverend' George
Harper of Mt. Zion United Methodist Church.

ITEM 15 - Minutes of the Regular Meetings of January 14 and 21, 1982.
Commissioner Garvey moved to approve the minutes of the regular
meeting of January 14, 1982; and to amend the minutes of January 2', 19B2,
Item 045, to record her "Nay" vote; as recorded and submitted in written
summation by the Clerk to each Commissioner. Motion was duly seconded and
carried unanimously.
ITEM #6 - Citizens to be Heard re Items Not on the Agenda.
Charles Shank suggested an opinion poll be requested from the
residents on oontroversial issues and that legislation be implemented to
place tax-exempt churoh property on the tax rolls. He also spoke in
support of the annexation legislation.
ITEM D7 - The City Commission adjourned at 5:25 p.m. and convened as the

ITEM - Development Services Agreement Between Clearwater Community
Redevelopment Agency and the Clearwater Downtown Development Board.
A Development Services Agreement has been prepared and is essentially
a statement of the oooperative arrangement whereby the D.D.B. and the
C.R.A. will work together to achieve the objeotives of the Downtown Plan.

Commissioner Calderbank moved to approve the Development Servioes
Agreement with the Clearwater Downtown Development Board and that the
appropriate offioials be authorized to execute same. Motion was duly
seoonded and carried unanimously.

Boulevard.
The property is located in a CO (General Business) zoning distriot
whioh prohibits retail sales and displays, except where a speoial permit
has been prooured from the City Commission. This oonoession 1n addition to
retail sales will help draw prospeots for the Lifetime of Vaoations
resort. This is an after-the-faot request, and upon the Building
Department's investigation, an order to oease the operation was issued.

By unanimous consent, the Commission proceeded to Item D11m.
ITEM 111m. - Preliminary Site Plan - Addition to the Bay Queen Motel. Lots
1 and 2 and the west 3q feet of Lot 3, SunnYdale Subdivision in Section
3-29-15; located at the southeast interseotion of Sunnydale Drive and
Edgewater Drive (Bay Queen Motel, Ino.) PSP-82-3.
Current zoning is RM-28 (High Density Hulti-Family Use) and the
applicant plans to add nine residential apartment units at the east end of
the property. There 1s a motel with 17 effioienoy motel units and two
apartments on the property. The applicant requested that the slab on
SUnnydale Boulevard be allowed to remain so that it oould be used for
deliveries. Discussion ensued on retaining the slab and olosing a ourb-
out.
Commissioner Calderbank moved to approve the preliminary site plan
subjeot to the following oonditions: 1) that a !.I-foot wide sidewalk for
deliveries be allowed; 2) that one ourb-cut be olosed; 3) that
the requisite initial building permits be issued within six months from the
date of City Commission approval of the preliminary site plan and that all
requisite oertifioates of oooupany be issued within two years from the date
of issuanoe of the initial building permit. HOtloa was duly seoonded and

The Mayor suggested eleotion regulations be amended to allow
candidates to run for a speCific seat, but be eleoted City-wide.
Commissioner Hatohett requested
information on Enterprise Zones.
Commissioner Calderbank thanked staff for their efforts in plaoing
the "no parking" signs on the north side of Memorial Causeway and requested
that the soooer fields reoeive attention.
In response to Commissioner Kelly's questions on Little League, the
City Manager reported that they are negotiating with Clearwater High Sohool
for use of two fields for Little League and have also disoussed
installation of lights. He reported the fields will be ready in the
spring.
The Mayor read into the reoord a letter of oommendation from
Governor Bob Graham to Police Offioer Edward Morgan.

The City Manager requested the Commission reoonsider Item D11k listed
in the Consent Agenda to establish a public hearing date of February 18,
1982. The list attaohed to the item oontained the names and addresses of
residents with delinquent utility bills. Thu City Attorney requested the
third item on the first page relating to 1573 Washington Avenue South be
deleted as the property had been sold and repossessed.
Commissioner Garvey moved to delete aooount number 1168-00160-6.
MOtlaa was duly seoonded and oar.ried unanimously.
The Oath of Office was administered to 12 reserve polioe officers by
the City Clerk. The reserve polioe officers are all graduates of the
Polioe Aoademy and are all volunteers who work other jobs but volunteer
their services to the City and receive no remuneration.
Polioe Chief Klein was replaoed at this time by Offioer Ronald Heok.
City Commission returned to Item D9 - Verbal Reports.
The City Manager reported on the sales tax proposal ourrently before
the state legislature. All of the oounties are supporting the 1-peroant
allooated sales tax proposal, with the exoeption of Pine lIas and Broward
Counties. The 1-percent tax would be allooated back to looal governments,
and 70-peroent mandated for property relief. He suggested the citizens
write their legislators to support the proposal. He also suggested the
Commission consider a flyer with the utility bills to acquaint the
residents and/or donations be solioited to cover the cost of printing
individual letters.

ITEM '12 - Lot Clearing Violations, List 081-11.
Complaints of lots needing to be cleared have been investigated by the
Sanitation Division and owners were notified by certified mail to olear the
property within ten days or a public hearing would be held to authorize
clearanoe.
List '12 with 2 property owners who failed to olear their property
within the ten days was presented.
City Inspector James Maglio stated the lots remaining to be
oleared constituted a menace to publio health, safety, and welfare.
No oitizens spoke in objection.
Commissioner Garvey moved to authorize clearance of the properties in
violation of Ordinanoe '189~, and billing of the property owners for oosts
and/or administrative charges and the appropriate officials be authorized to
exeoute same. MOtloa was duly seoonded and oarrled unanimously.
ITEM '13 - Vaoation Request - Florida Clearwater Beach Hotel Compan~
V-Bl-17.
The applicant has requested the City vaoate the south 20 feet of
Baymont Street north of Lot 1, Clearwater Beaoh Park in Seotion 8-29-15.
The building presently construoted on 'the property enoroaches two feet onto
the right-of-way. There is also a block wall, a wooden fanoe, and a wooden
patio located in the right-of-way. The Board of Adjustment and Appeal on
Zoning granted a variance to allow the baloony of the new building to be
oonstruoted on the property to extend over the right-of-way.

The City Manager reported that vaoation of this right-of-way does not
end at a body of water. The right-or-way extends to a right-or-way for
Beaoh Drive whioh was dedicated in 1925 and used for driving on the beaoh.
If the right-of-way 10 reduoed by 20 feet as requested there will still be
45 feet left as publio aooess to the beaoh.
Harry Cline, attorney representing the applioant, stated they were
only requesting a portion of Baymont Street be vaoated. Baymont Street was
originally platted as 80 feet wide and Gulf Court Apartments extends into
the right-of-way. Baymont Street itself was never opened as a pUblio
street, but only used as acoess for the publio to the beaoh. He stated the
applioant is willing to maintain the right-of-way, oonstruot a walkway and
landsoape the area. The acoess area for the publio will remain and the
property would go on the tax rolls.
Edwin R. Hunter, President of the Clearwater Beaoh Hotel Co. and
speaking in support of his request, stated he would oooperate with the City
and will remove the ramshaokle struoture ourrently on the property to build
a new building. He reported that the arohiteot had been instruoted to
lower the height of the bUilding to ~O feet.
Disoussion ensued on the setbaoks and height. The transfer of density
whioh was not pertinent to the issue at this time was also disoussed.
Four oitizens spoke in opposition to the request oiting reduoed publio
acoess and that they opposed giving up any land on the beaoh.
Commissioner Hatchett moved to approve the request subjeot to receipt
of quit-olaim'deeds for a portion of Beach Drive and that the City Attorney
be direoted to inplude In an ordinanoe. Motion was duly seconded. Upon
the vote being taken, Commissioners Hatchett, Calderbank, Kelly, and the
Mayor voted "Ayetl;- Commissioner Garvey voted tlNay." Motioa carried.
