The Mayor called the meeting to order. The Pledge of Allegiance was
led by Police Chief Klein. The invocation was given by The Reverend J. Jay
Diefe11, Jr. of Trinity Presbyterian Church.

ITEM 06 - Evaluation of Mobile Home Park Board Chapter No. 1~0. as
Amended.
When Ordinance #2268-81 was adopted, the City Commission requested an
evaluation after nine months. The amendment allowed the board greater
authority which has not been utilized to this date and the Boardts activity
has been minimal. Staff reoommends that the board be oontinued, as the
past nine months have been off-season for mobile home residents. Staff
will work closely with the board and the residents to establish an avenue
of good communications between the groups and will also continue to monitor
the viability of effectiveness of the ordinance and update the Commission
on its progress when applicable.
Commissioner Garvey moved to aocept the report and to direot staff to
continue to monitor the effectiveness of Chapter 1~0. Motion was duly
seconded and carr.led unanimously.

ITEM '7 - Operation PAR. Ino.
The organization is a residential treatment oenter which has reoently
relocated outside the City limits of Clearwater. They have sponsored teams
in the oity's Adult Athletio Leagues for several years, but sinoe they are
now outside the oity limits, are required to pay a non-resident fee of $25
for eaoh of their players. They have requested the fees be waived and
oited the value of PAR to the community, their bUdget restrictions and the
theraputio value of the athletio program for PAR partioipants.
Commissioner Hatohett moved to deny the request.

Disoussion ensued and Charles Soh loss berg and Ream Wilson spoke in
support of the program. Concerns were expressed for setting a precedent.
Commissioner Calderbank withdrew his second and Commissioner Garvey
seconded the motion. Upon the vote being taken, Commissioners Hatchett
and Garvey voted "Aye"j Commissioners Calderbank and Kelly and the Mayor
voted "Nay." Motion talled.
Commissioner Calderbank moved to approve the request to waive the
individual non-resident fee of $25 for each player. Commissioner Kelly
seconded the motion and moved to amend the motion by adding, "for one year
only for any program and any number of participants." The maker of the
motion agreed to the am(:ndment. Commissioner Kelly requested the group
provide in-kind service to the city for this waiver and to report back next
year. Upon the vote being taken, Commissioners Hatchett, Calderbank and
Kelly and the Mayor voted "Aye"; Commissioner Garvey voted "Nay.1I Motion
carried .
ITEM DB - Clearwater Bayfront Public Pier -Need-A-Diver. lnc $5B.003.0B.
The contraot proposes to construct a 200 L.F. "T" head pier on the
Clearwater Bayfront immediately south of the Memorial Causeway Drawbridge
at a oost of $5~,591.0B and to demolish the old pier, $3,412, for a total
of $5B,003.0B.
The projeot has been delayed pending resolution of bottomland
ownership and the reverter clause. The issue has been addressed by the
Legislative Delegation and it appears the ownership reverter clause is no
longer an impediment to oonstruction of the proposed pier. The lioense
agreement with Anderson Bay Cruises, Inc., however, will not be executed
until final legiSlative approval is granted.
Two citizens spoke in opposition to the pier, citing noise and
aotivity and no public purpose. One citizen spoke in support.
Commissioner Hatchett moved to award the contract to Need-A-Diver,
Ino.. whioh is the lowest responsive and responsible bid received in
aooordance with the plans and specifications and that the appropriate
officials be authorized to exeoute same. Motion was duly seconded and
carried unanimously.
ITEM 19 - Betham Gardens Ltd. Nursin Home Pro ect - Resolution
1-105. A resolution supplementing Ordinanoe 255 - 1 to provide for the
acquisition, oonstruction, and equipping by the City of Clearwater of a
projeot for a nursing home.
The City Attorney reported a revised bond purchase agreement had
inoorporated the Commission's concerns relating to the validation of the
bond issue and termination rights, and a new Section 19, titled "Choioe of
Law," which states this agreement shall be governed by and construed in
accordance with the laws in the State of Florida. National Health
Corporation has been substituted for American Medical Services, Ino., as
the management agent for this projeot.

Commissioner Hatohett moved to pass and adopt Resolution 081-105 and
to include in Seotion 5, "Designation of Trustee," the First National Bank
of Florida, Tampa, Florida, to serve as trustee, and that the appropriate
officials be authorized to execute same. Motion was duly seoonded.
Commissioner Kelly brought to the Commission's attention a recent ad in the
paper relating to the sale of the bonds in whioh the City of Clearwater's
name was in large print.

ITEM 110 - Motor Vehicles, Kenyon Dodge, Clearwater
$93,715.86.
Sealed bids were reoeived from seven bidders for eleven replacement
and five new vehicles. The City Manager reviewed the requests for the five
new vehicles. Commissioner Hatohett requested a vehiole inventory summary
sheet from the fleet maintenance report.
Commission expressed conoerns on better utilization of the vehicles
that are currently available and a need to trim the budget and reduce the
number of cars by attrition.
Commissioner Hatchett moved to award a contract to purchase motor
vehicles as specified in IFB 16-82, dated 11-16-81, from Kenyon Dodge at
prices recorded on the bid tabulation which are the lowest responsive and
responsible bids submitted in accordance with the specifications in the
amount of $93,715.86. Motion was duly seconded. Upon the vote being
taken, Commissioners Garvey, Hatohett and the Mayor voted llAye";
Commissioners Calderbank and Kelly voted "Nay." Motion e&rI"led.

Verbal Reports.
The City Manager cited one of the many problems that exists with the
enclaves is police jurisdiction and enforcement.
The Mayor reported the airlift to Poland is ourrently on hold.
The City Manager presented a request from Timothy Johnson, Jr.,
attorney representing the U.S. Home Pebble Lake project, Tract 20,
Countryside. This preliminary site plan was approved on October 16, 1980,
with the condition that the building permit be obtained within six months
and the project completed within two years of the approval. An extension
is requested to provide that a building permit should be obtained within
six months from the grant of the extension and that the projeot should be
completed within two years from the grant of extension as sale of the
property is oontingent on the time constraints. The project was approved
as an RPD-10 development with 132 condominium units in one- and two-story
buildings.
Commissioner Hatchett moved to approve the extension request.

extensive testing due to unforseen requirements levied by the State of

The change order represents the aotual quanities used and will
increase the contract $1,778.90.
Commissioner Calderbank moved to approve change order '1 and final to
Baker Marine Enterprises, Inc., for a new total. contract of $74,030.90, and
that the appropriate officials be authorized to execute same. MOtion was
duly seconded and carried unanimously.
c. Pinellas Planning Council Municipal Planning Assistance Grant -
Phase II.
Staff recommends a city application for one of the two supplemental
planning grants to be awarded in 1981/82 by the Pinellas County Planning
Council. The project design would be for a bandshell in Coachman Park.
The awards are for a maximum amount of $5,675 with the successful applicant
providing a 25-percent funding match. The city's funding match would be
with in-kind services.
Commissioner Garvey moved to authorize the Planning Department to
submit an application for a P.P.C. grant to be used to oonduot a design
competition for a bay front bandshell and that the appropriate officials be
authorized to execute same. Motion was duly seconded and carried
unanimously.

ITEM 015 - Vacation Request - The east three feet of the ten-foot utility
easement at the rear of Lot 31, Forest Wood Estates in Section 4-29-16'
located at 1852 Oak Forest Drive West (Berger) V-81-16.
The applicant requests this vacation to build a pool in his rear yard.
The Engineering, Planning and Utilities departments reoommend denial due to
the property to the west being undeveloped. It is unknown where the
extension of Landmark Drive will be in this area and where utilities will
be located when adjoining property is developed.
Rosalie Ramqulst spoke in opposition, citing flooding problems.
Commissioner Hatchett moved to approve a one-and-one-half-foot vacation of
the ten-foot utility easement at the rear of Lot 31, Forest Wood Estates,
with the stipulation that the Building Department have the plan reviewed by
the Engineering Division for drainage and site plan consideration.
Motion was duly seconded.
The applicant requested the vacation be three feet as the pool will
extend one-and-one-half foot into the easement.
Commissioner Hatchett moved to amend his motion to three-foot.
Commissioner Calderbank seconded the motion. Upon the vote being taken on
the amended motion, Commissioners Hatchett, Calderbank, Kelly and the Mayor
voted "Aye"; Commissioner Garvey voted "Nay." HotiOlJ carried.
ITBM #16 - Land Use Plan Amendment from Commercial/Tourist Facilities

The Planning Director reviewed the area and reported the owners of the
property oppose the change. Staff met with representatives to discuss
alternatives to allow for future property improvements while maintaining
the current medium density charaoter of the development. The Planning and
Zoning Board recommended a compromise to approve the RM-12 designation for
all of the property less that area occupied by Congregational House and th~
maintenanoe bUilding.
Rick Hall, Chairman of the Board of Bayview Gardens Housing, Inc.,
stated it is a non-profit organization started in 196~ and was 100-percent
finananced by the federal government. He is opposed to the zoning change
as it will restrict development of additional facilities and, at some time
in the future, they may need a health faoility on the premises. He
requested the the flM-28 (High Density Multi-Family) zoning be continued.

Lakeview Road at Seaboard Coast Line Railroad, south of and abutting
Clearwater Cemetery (Plumb) LUP-81-72, Z-81-102.
The site is developed with a single-family residence which will be
demolished to develop the property with professional offices. There were
no citizens to speak.
Commissioner Garvey moved to approve the request and direct the City
Attorney to include in an ordinance. Motion was duly seconded and
carried unanimously.
ITEM 018 - Petition for Annexation. RM-8 (Single-Family Duplexx-Apartment
Residential) District Zoning and Fire District H2 for Lots 20 and 21, Bell
Cheer Subdivision and M&B 8 in the NE~ of Section 2~-29-15; located at the
southwest intersection of Bell-Cheer Drive and Belcher Road across from the
intersection of Harn Boulevard (Hanna Development Corporation) A-81-38.
The area is undeveloped with the exception of an existing
single-family residence. The developer plans townhouses on the property
and the single-family residence will be removed. There is a 1.7-acre
M.O.L. lake located on the western portion of the property leaVing
apprOXimately 3.5 net acres to be utilized in determining maximum allowable
density on the site.
Emil Mardquardt, Jr., attorney for the applicant stated the land cost
would not justify a single-family residential zoning. They plan
approximately 28 units for the three and one-half acres.
Charles Barber, attorney presented a petition for the record. He was
representing 41 property owners opposed to the RM-8 zoning and requesting
single-family zoning. He stated the area is surrounded by single-family
residential units. He suggested this change could be considered spot
zoning and suggested. as an alternative, RPD (Residential Planned
Development) zoning classification.
Six citizens spoke in opposition to the RM-8 zoning request and in
support of single-family residential zoning.
The Planning Director reported this is a long, narrow parcel and the
plan does conform to the low-density land use plan of the city and the
county.
Attorney Mardquart stated the plan was consistent with the Land Use
Plan, meets all of the requirements, and the five-Ianed Belcher Road, a
major highway, separates and acts as a buffer between the property and the
owners across the street who are in opposition. It will be an

stated that, if required, the developer would covenant that only townhouses
would be built on the property.
Commissioner Calderbank moved to table the item to allow the
alternative of an RPD to be addressed. Motion was duly seconded and

ITEM 019 - Redevelopment Plan for Downtown Clearwater.
The Board of County Commissioners, the Local Planning Agency, and the
Community Redevelopment Agency, have all approved the plan. The plan
proposes pUblic improvements to faoilitate private-sector investments in
Downtown Clearwater, and inoludes street and road, parking system, utility,
park and recreation improvementsj plus land acquistion, code enforcement,
design and ammeniiy improvements, and relocation of residents, if
necessary.
Charles Finton questioned the changes to the plan which he and other
citizens had not seen.
The City Attorney reported that the redevelopment plan and the
redevelopment projects will come back to the Commission for review before
they are implemented.
Commissioner Hatchett moved to adopt the Redevelopment

reported on the financial impact to the City. The actuary estimates it
will cost the city $72,000 of additional unfunded deficiency in the
Employees' Pension Plan if the option is accepted by the one employee who
is eligible at this time. The deficiency would be funded over a 26-year
period,.

ITEM '59 - Seoond Reading, Ordinanoe '2578-61 - Approving the Aooeptanoe
of the Herald Company Contingent Guaranty Agreement. PACT.
The City Attorney presented Ordinance 02576-61 for seoond reading and
stated he would read by title only unless there was a request to rea~ in
its entirety. The ordinanoe was read by title only. Commissioner
Calder bank moved to pass and adopt Ordinance 02578-81 on second and final
reading and to authorize the appropriate offioials to execute same. Motion
was duly seoonded. Upon roll oall the vote was:
"Ayes": Garvey, Caldel'bank, Hatohett, Kelly and LeCher.
"Nays": None.
ITEM
Pirolo Suit.
The City Manager requested the City Attcrney report the status of
litigation in the Pil'olo suit vs the City of Clearwater re Civil Rights
Issues.
The City Attorney reported that at a recent hearing, the court took no
aotion, and gave no indioation of what it would do, and took the matter
under advisement.
Commissioner Hatchett moved to authorize the City Attorney to take
whatever action is necessary to protect the City in the Pirolo suit.
MOtioa was duly seconded and carried unanimously.
ITEM '65
other Commission Action.
The Mayor - Took exception to a newspaper artiole relating to the
rezoning of Area 7 at the December 10 meeting. The newspaper article noted
that the area could become another Miami Beach. He reported that before
1971 there were no zoning restrictions and no height limitations on
Miami Beach. He oited an instance where a Clearwater property owner was
granted 112 units and under Miami Beach zonIng could have constructed over
700 units.
Commissioner Garvey - Noted a memo will be going to the Commision on
the six-laning of U.S. 19 and requested the Commission support a car pool
and bus lane only.
Commissioner Calderbank requested consideration of a beach
neighborhood commercial zoning district in the new zoning code being
codified.
He questioned the status of boats docked west of Island Way north of
the causeway and noted they appeared to be within the area covered by the
reverter clause.
He requested the status of the Flynn Report and the outside attorney's
report. The City Manager stated he would try to have a status report ready
for January 7 and a recommendation by January 21, 1962.
